You may be able to challenge a stop, search, or evidence linked to an automated license plate reader (ALPR) by examining whether the system read the plate correctly, whether the underlying alert was current and accurate, what officers knew before acting, and whether police lawfully obtained any stored location records. An ALPR hit is a lead—not proof that a vehicle or its occupants are involved in a crime—and it does not, by itself, establish that evidence must be suppressed. The legal result depends on the facts, the evidence trail, and the law in the jurisdiction where the case is pending.
If you have an active criminal case, speak promptly with a local criminal-defense lawyer. Preservation and motion deadlines vary, and potentially useful camera or system records may not be kept indefinitely.
What an ALPR hit does—and does not—mean
An ALPR camera and software read a license plate, compare the result with lists associated with matters such as stolen vehicles or investigations, and may alert police to a possible match. Some systems also retain scans with time and location information for later searches. The alert is a starting point for investigation: the underlying image, machine-read text, source record, and officer response all matter.

A plate can be misread; a source entry can be stale; or a correct plate match can relate to a vehicle or person different from the one police are investigating. Even when the read and record are accurate, the alert does not automatically answer whether a particular stop, frisk, vehicle search, arrest, or later search was lawful.

Which part of the police action are you challenging?
Keep the initial stop separate from any later search or historical-location query. Each action can have a different factual basis and legal analysis. A lawful traffic stop, for example, does not automatically resolve whether a later vehicle or home search was justified.
| Issue | Facts to examine | Why they matter | Important limit |
|---|---|---|---|
| Plate read or alert record | Original image, machine-read characters, alert details, source-list entry, status and update history, and vehicle descriptors. | May show a misread, stale entry, mismatched vehicle description, or other factual problem with the alert. | An error does not automatically invalidate police action; the effect depends on what officers knew and the governing law. |
| Initial stop | What the stopping officer knew beforehand, whether the plate or alert was checked, what dispatch reported, and any independent observations. | Helps assess whether the stop had an adequate legal basis on the facts known at the time. | Courts may accept an ALPR alert as part of the justification under particular facts; the alert alone is not a nationwide rule. |
| Later search or arrest | When the search began, what new information officers had, and the legal basis for a frisk, vehicle search, arrest, or warrant. | Tests the authority for that separate action rather than assuming the stop decides it. | The answer depends on the specific action, facts, and controlling law. |
| Stored location-data query | Query purpose, time span, geographic scope, records returned, requesting users or agencies, and any warrant or other legal process. | Shows whether police used only an immediate alert or searched a history of vehicle locations. | Courts have rejected some arguments comparing ALPR history searches to cell-site tracking; results depend on the system and jurisdiction. |
How to investigate a possible plate-read or database mistake
Ask counsel to compare the camera’s original image with the machine-generated plate text and the vehicle involved. The source record should also be checked for its reason, status, source agency, descriptors, and last update. Those details can help distinguish a wrong character from a stale stolen-vehicle or warrant entry, or from a correct plate associated with the wrong vehicle or person.

Green v. City & County of San Francisco (Ninth Circuit, 2014) describes false-hit risks and verification practices, including visually confirming a plate and checking current status through dispatch or a mobile data terminal. Its account also notes that the agency lacked a policy assigning verification responsibility at the time. It is useful for identifying records and procedures to investigate; it does not establish a universal legal requirement for every police agency.

The sequence can matter as much as the alert itself. Counsel can compare reports, dispatch records, and video to establish what each officer knew and when. A practical timeline should include:

- When and where the camera recorded the vehicle, and when the system generated an alert.
- What the querying or stopping officer knew before the stop, including any visual plate confirmation or dispatch response.
- Whether the database entry was active and what it actually described at that time.
- What the officer observed independently, and when any frisk, vehicle search, arrest, or other search began.
- Whether officers later searched stored ALPR records or obtained a warrant, and what evidence followed from those steps.
This can clarify whether a challenge concerns the initial stop, a later search, historical data collection, or the connection between an allegedly unlawful action and evidence found afterward. Depending on local law and the record, a court may also consider doctrines such as good faith, attenuation, or inevitable discovery when deciding whether evidence is excluded.
When stored ALPR location history raises a separate issue
For a retrospective query, the relevant facts include how many records police obtained, how far back the search went, its geographic scope and purpose, and whether police secured a warrant or other legal process. Arguments based on Carpenter v. United States, which concerned historical cell-site location information, have been raised in ALPR cases. They do not automatically require a warrant for every ALPR use.
In United States v. Yang (Ninth Circuit, 2020), the court affirmed denial of suppression in a case involving historical ALPR location data for a rental vehicle not returned by its contract due date; it treated the circumstances as distinguishable from Carpenter. United States v. Porter (Fifth Circuit, 2026) also rejected a Fourth Amendment ALPR challenge on the facts before that court. These decisions illustrate why the type and scope of data, the purpose of the query, and controlling local precedent need to be assessed rather than assuming one national rule.
Check state law, agency policy, and retention rules
State statutes and agency policies may regulate permitted uses, access, logging, audits, or retention. They can point counsel toward relevant records or a separate statutory argument. But a policy or statutory violation does not automatically result in Fourth Amendment suppression; whether a remedy is available must be assessed under the law that applies to the case.

- North Carolina: General Statutes §20-183.32 generally limits preservation of covered law-enforcement ALPR data to 90 days, subject to statutory exceptions. It also addresses preservation requests, updates, confidentiality, and disclosure.
- Virginia: Code §2.2-5517 lists permitted law-enforcement use categories and addresses retention of data or audit trails relevant to ongoing matters.
These examples apply only within their statutory scope. They should not be treated as retention rules for other states or agencies.

Discovery rights, preservation procedures, and access to records depend on local law and the case. A lawyer can assess which materials to preserve or request, including:
- Original ALPR image or images, related video, and machine-readable plate result, including any maintained confidence or error fields.
- Alert or hit details; the source-list entry; status and update history; and the time each item was accessed.
- ALPR query history, search terms, user identity, audit trail, and system access logs.
- Camera location, time synchronization, device configuration, and relevant vendor or system records.
- Dispatch audio, computer-aided dispatch (CAD) records, radio traffic, body-camera and dash-camera footage.
- Police reports, warrant or stolen-vehicle records, and communications between agencies.
- Applicable ALPR policies, training materials, verification instructions, retention schedules, and audit reports.
- Applications, affidavits, and returns for any warrant obtained after an ALPR query.
The National Association of Criminal Defense Lawyers’ practitioner primer recommends detailed discovery requests when it is unclear how police located a vehicle and notes that counsel may pursue a motion to compel. Whether records can be obtained, and what preservation remedy is available, depends on local rules and the case record.

What the cited cases can—and cannot—tell you
| Decision | What it addressed | Where its relevance is limited |
|---|---|---|
| Green v. City & County of San Francisco (Ninth Circuit, 2014) | False-hit risks, verification practices, and the agency’s then-existing lack of a policy assigning verification responsibility. | It is a source for investigating reliability and procedures, not proof of a universal verification rule. |
| United States v. Yang (Ninth Circuit, 2020) | Historical ALPR data concerning a rental vehicle not returned by its contract due date; the court affirmed denial of suppression. | The court distinguished the circumstances from Carpenter; the result does not decide every historical ALPR query. |
| United States v. Porter (Fifth Circuit, 2026) | Rejected an ALPR Fourth Amendment challenge and considered an alert as a basis for reasonable suspicion under the facts and collective-knowledge analysis in that case. | Binding only within the applicable federal circuit, subject to precedent and case posture. |
| State v. Simonson (Washington Court of Appeals, 2026, unpublished) | A Flock-derived lead and suppression arguments that included verification and preservation issues. | Its unpublished status and Washington setting limit its use elsewhere. |
| Robinson v. Commonwealth (Virginia Court of Appeals, 2026) | A suppression challenge involving Norfolk’s fixed-camera system and stored vehicle information. | It is Virginia-specific authority. |
| Commonwealth v. McCarthy (Massachusetts Supreme Judicial Court, 2020) | A limited fixed-camera configuration under Massachusetts and federal constitutional law; the court discussed how broader ALPR coverage could raise different privacy questions. | Its analysis is tied to the system and legal setting before the Massachusetts court. |
Federal appellate decisions do not create one nationwide answer for every ALPR system or search. State constitutional protections can differ from federal protections, and state statutes may add rules. A local lawyer should identify controlling authority for the court handling the case.
Quick Recap
What to do if an ALPR hit may be involved in your case
- Give a local criminal-defense lawyer the date and location of the stop or search, charging documents, police reports, warrant papers, and any mention of an ALPR alert or vehicle-location query.
- Ask promptly whether camera images, hit records, query histories, and agency or vendor logs should be preserved before routine deletion or statutory retention limits affect them.
- Ask what discovery is available and whether a suppression motion, state constitutional claim, or statutory argument fits the facts and local law.
- Confirm the filing deadline and any hearing requirements with counsel; there is no single national deadline established for these cases.
