You cannot reliably tell from a price change alone whether a seller used your personal data, and no consumer trick is proven to make surveillance pricing disappear. The most useful response is to compare the exact item and final checkout total across sellers, treat private browsing or a VPN as an experiment rather than a fix, and save evidence if a seller’s pricing or promotion appears deceptive.
What surveillance pricing is—and what a price change does not prove
Surveillance pricing uses personal data and algorithms to tailor the prices, discounts, products, or offers shown to a consumer. It can overlap with dynamic pricing, in which prices change with factors such as demand, supply, time, or sales channel. A price that changes between visits—or differs between two shoppers—does not by itself establish that a seller used an individual profile to set it.
How personal data can affect what you see
Data sources may include information a business collects directly, advertising and analytics services, data brokers, and credit providers. Signals described by the Federal Trade Commission (FTC) include location, demographics, browsing and shopping histories, online behavior, mouse movements, and products left in a cart. Systems may use those signals to infer preferences or willingness to pay, then tailor prices, discounts, product rankings, or the products displayed. What the FTC has—and has not—publicly established
In January 2025, the FTC said its initial study reviewed documents obtained from Mastercard, Accenture, PROS, Bloomreach, Revionics, and McKinsey & Co. The agency reported that intermediaries it examined worked with at least 250 clients selling goods and services, including groceries and apparel. That figure is not a count of retailers proven to have charged individual shoppers different prices. The FTC also said its public examples were hypothetical to protect confidential business information; the example of a new parent being shown higher-priced baby thermometers was not a documented incident involving a named shopper or retailer. The agency’s public materials document that tools and intermediaries can support tailored prices and offers. They do not establish that a particular retailer used a personal profile to raise the price you saw. Nor do the reviewed FTC materials provide a reliable statistic for the share of retailers using surveillance pricing, the average extra amount a consumer pays, or the total annual household cost. The FTC staff says more research is needed to determine when the practice raises consumer prices and what its overall effects are.
How to compare prices without mistaking a difference for proof
Start with the purchase itself, not a theory about why a price changed. A lower number on a product page may turn into a higher total after delivery charges, fees, or different terms are included.

- Match the item and purchase terms. Check the exact model, size or quantity, condition, seller, delivery timing, shipping cost, fees, and return terms. Compare the same item across more than one retailer or sales channel where possible.
- Compare the final checkout total. Take the offer through checkout far enough to see mandatory charges before deciding. Read coupon eligibility, minimum quantities, account requirements, and other promotion conditions; a personalized discount or product ranking can change the effective deal even when the listed price does not.
- Record prices for expensive or recurring purchases. Note the date, seller, item, and final total. A short record can help you spot a change and compare offers over time, but it cannot show what caused the change.
- Use another session as a comparison, if useful. Compare the same product and terms in your usual session and in a private browsing window or through a VPN. Keep other conditions as similar as possible. A difference is a reason to compare carefully, not proof that your identity caused the price.
- Save evidence of a concrete representation. If a displayed price, coupon, or promotion appears inconsistent with what the seller promised, preserve dated screenshots and receipts. The FTC directs consumers to ReportFraud.gov for reporting bad business practices; report what you can document.
Do incognito mode or a VPN lower prices?
They might change what a shopping site can observe in a particular session, but the FTC has not established that either reliably lowers a shopper’s price. Its August 2026 announcement mentioned a VPN or private browsing as possible consumer measures, not guaranteed ways to defeat personalized pricing. A seller may still recognize a shopper through other signals, and an unchanged price does not prove that profiling was not used.

Claims such as “searching repeatedly makes the price go up,” “incognito always finds the cheapest fare,” or “a VPN beats surveillance pricing” are not supported by the cited FTC materials. There is no reliable consumer-side test established in those sources that identifies whether a single observed price came from an individual profile.

Reduce unnecessary data sharing without expecting a price guarantee
Review app permissions and optional account or loyalty-program settings when you do not need the associated feature. This is general data-minimization advice, not a demonstrated way to reduce a quoted price. Data used in pricing may come from multiple sources, so changing one setting should not be treated as proof that a seller can no longer personalize an offer.
State privacy laws may give consumers data access or deletion rights in some places, but requirements differ by jurisdiction. The FTC materials cited here do not survey state statutes, so check the rules that apply where you live before relying on a particular right.

What the FTC’s proposed policy means for consumers
On August 19, 2026, the FTC sought public comment on a draft enforcement policy statement concerning personalized pricing. The agency said undisclosed collection or use of personal data to set prices could violate the FTC Act or other laws it enforces. The comment deadline was September 18, 2026. As of the FTC announcement’s August 31 update, the policy was a proposal—not a final rule or a blanket ban—and the FTC said it could not prohibit personalized pricing in every circumstance. The announcement does not establish what final action, if any, followed the comment period. Read the agency’s August 2026 announcement for its stated position and status at that time.

The proposed policy focuses on the possible legal consequences of failing to disclose personal-data use in setting a price. It does not make every difference between two shoppers evidence of a violation.

A practical standard for deciding what to do
Use comparison shopping to find a better offer; use privacy settings to limit data sharing when that trade-off makes sense to you; and use records to support a report about a specific, documentable representation. Treat any conclusion about why a price differed as uncertain unless you have evidence beyond the difference itself.
