Archiving business WhatsApp messages for compliance is a records-management process, not a switch in WhatsApp. First decide which business uses are permitted; then capture required messages and related content into a controlled records system, apply the retention rules and legal holds that govern your organization, and test that the archive can be searched, reviewed, exported, and audited. The right rules depend on your jurisdiction, industry, and use of the channel.
Can WhatsApp messages count as business records?
Yes. A message may be a business record because of its content and purpose, even if it was sent through a third-party app or a personal account. In its May 2, 2025 memorandum, the U.S. National Archives and Records Administration (NARA) says messages created or received in the course of federal agency business can be federal records regardless of the account used. That guidance applies to U.S. federal agencies under the Federal Records Act; it is not a retention rule for every private company.

For other organizations, the relevant question is whether a communication must be retained under the laws, regulations, contracts, or records schedule that applies to that organization and use case. Do not treat a chat as disposable simply because it is short, informal, or held in a messaging app.
Decide whether business WhatsApp use is permitted
Set channel rules before choosing an archive. Identify approved and prohibited business uses, accounts, users, and features, including disappearing messages. For regulated organizations, legal and compliance owners should assess whether the particular channel and account setup can be captured, retained, searched, and supervised as required. If those requirements cannot be met, prohibit that use or move the business communication to an approved channel.

WhatsApp’s Business Messaging Policy, last updated September 23, 2026, applies to both the Business App and Business Platform. It requires businesses to obtain applicable notices, permissions, and consents, secure opt-in before messaging, honor opt-outs, and comply with applicable law. The Business App terms also place responsibility for determining legal and regulatory requirements on the business and do not represent that the app meets heightened confidentiality needs of regulated healthcare, financial, or legal services entities.
How to archive and audit business WhatsApp messages for compliance
- Inventory the communications. List business use of the WhatsApp Business App and Business Platform, as well as any personal accounts or devices used for work. Record users, message types, attachments, group chats, and disappearing-message or auto-delete settings. Include business communications that may be sent outside an approved account.
- Document permitted channels and features. Define which uses are allowed, which are prohibited, and who can approve exceptions. Identify an owner for policy, records, technical capture, and supervision so that a failure or exception has a clear escalation path.
- Capture required content into a governed records environment. Select an authorized capture method that covers the business messages and related content your obligations require. NARA notes that third-party applications are available to capture WhatsApp and other messaging-app messages and manage them in records systems. That availability is not an endorsement of a provider, nor does installing a tool by itself establish compliance.
- Map records to retention and preservation rules. Assign each relevant record category to the schedule that actually governs it. Preserve material subject to legal holds or other preservation duties before routine deletion, and document disposition under the applicable schedule. Do not use WhatsApp’s deletion behavior as a substitute for an approved retention decision.
- Control access and privacy. Limit archive access to authorized roles and assess notices, permissions, data protection, and transfer obligations for the relevant users and locations. Record who may search or export messages and how access is approved.
- Test retrieval and supervision. Verify that authorized staff can search, review, and export captured messages with relevant context and attachments. Keep records of searches, exports, review actions, exceptions, and disposition where appropriate to your program. Train users, review red flags, and periodically test whether approved-channel messages are reaching the archive and whether prohibited channels are being used for business.
What retention period should you use?
There is no universal WhatsApp retention period. Use the schedule and legal requirements that apply to your organization, record category, and jurisdiction. NARA’s 2025 guidance offers a federal-agency example under General Records Schedule (GRS) 6.1:
| Federal-agency category under GRS 6.1 | NARA retention example |
|---|---|
| Capstone officials | Permanent retention |
| Non-Capstone officials | Three to seven years, depending on the agency’s election |
These are federal-agency schedule periods, not recommended periods for businesses generally. NARA also cautions agencies to determine whether a message is genuinely transitory rather than assuming all third-party messages are disposable.

Can a company use WhatsApp auto-delete?
Only if the organization’s obligations and controls allow it. A setting that deletes messages automatically can destroy material that must be retained or preserved. NARA’s May 2, 2025 memorandum warns that third-party app auto-delete functions may violate federal recordkeeping requirements if users cannot identify and preserve federal records before destruction. That warning is specifically about federal records; other organizations must assess their own retention and preservation duties.
FINRA’s October 2019 examination report recommends defining permitted and prohibited channels, limiting features that obstruct retention, storing permitted communications appropriately, and supervising them. A policy that says “do not use auto-delete” is not enough on its own: configure controls where possible, train users, and check whether the settings and actual practices match the policy.

Compare solutions against the organization’s requirements, rather than assuming a product label or vendor claim establishes regulatory sufficiency. NARA, FINRA, and WhatsApp do not certify a particular vendor or architecture. Use these questions in procurement and testing:
- Coverage: Which accounts, devices, message types, group chats, edits, deletions, and attachments are captured? What is excluded?
- Capture integrity: How does the system detect capture failures, identify missing records, and preserve timestamps and relevant context? What is the capture latency?
- Retention and holds: Can retention schedules, disposition, preservation, and legal-hold workflows be configured to match your obligations?
- Audit and supervision: Are access, searches, exports, review actions, exceptions, and policy controls logged and available for review?
- Search and export: Can authorized staff locate and produce records in usable formats, including relevant attachments, and transfer them to existing records or e-discovery systems?
- Security and privacy: Assess access controls, encryption, administrative boundaries, data location, subprocessors, and deletion practices against your organization’s requirements.
- Platform fit and resilience: Confirm that the capture method is authorized and works with your exact WhatsApp service and account setup. Check monitoring, failure alerts, recovery, support, and ownership of exceptions against current platform terms and technical documentation.
Why written rules need operational checks
A policy cannot prove that employees followed it. The SEC’s 2025 administrative order concerning Robinhood Financial LLC and Robinhood Securities LLC describes a particular enforcement matter in which WhatsApp and other unapproved communications were generally not monitored, reviewed, or archived. It illustrates the risk of inadequate methods for detecting policy breaches; it is not a universal ruling about every business’s use of WhatsApp.

Quick Recap
Who these rules cover
- NARA: Its May 2, 2025 memorandum addresses U.S. federal agencies and the Federal Records Act. Its retention examples should not be applied automatically to private companies.
- FINRA: Its October 2019 examination material concerns securities-industry firms and related supervision and recordkeeping expectations, not every business.
- SEC: The 2025 Robinhood order is an enforcement example about named respondents, not a blanket WhatsApp rule.
- WhatsApp: Its business policies govern use of its business services. A customer’s legal and recordkeeping duties depend on its own jurisdiction, sector, records, and use of the channel.
