You can challenge many IRS decisions through the Independent Office of Appeals, but the instructions and deadline in your IRS letter control. Send your request to the address specified in that letter—not directly to Appeals. If you need help with a dispute, a Low Income Taxpayer Clinic (LITC) may offer free or low-cost representation; the Taxpayer Advocate Service (TAS) may help with qualifying IRS service problems.
How does an IRS administrative appeal work?
For most IRS decisions, taxpayers can seek a fair and impartial administrative appeal, including for many penalties. The IRS says taxpayers have a right to a written response about the Office of Appeals’ decision. Appeals is separate from the IRS office that first reviewed the matter; it considers the taxpayer’s position, the IRS’s position, and the relevant facts and law. An appeal is a review, not a guarantee that the IRS will change its decision.
For many examination disputes, you request review in writing. The IRS office that handled the case considers the issues first. If it cannot resolve them, it may forward the case to Appeals. Follow the appeal-rights letter’s filing instructions and send your request to the address printed there. Mailing it directly to Appeals can delay the case or prevent it from being considered.
What should you do first?
- Read the entire notice and its appeal-rights section. Identify the response method, filing address, required form or protest, and deadline. Keep the notice and its envelope.
- Calendar the deadline immediately. A formal protest is generally due within 30 days of the letter date, according to IRS Appeals, but this is a general rule. The date and procedure in your specific notice control; other appeal types have different rules.
- Identify every issue you dispute. Note the tax periods and each proposed adjustment or action you believe is wrong.
- Gather records that support your position. Organize relevant documents and explain how they relate to the disputed issues. Use the instructions in the notice and current IRS guidance for the submission requirements.
- Send the request as directed by the notice. Use its address and retain a copy of what you submit and evidence of mailing or delivery.
If you need a representative, contact an LITC promptly. Clinic intake does not extend an IRS deadline, so continue to follow the notice while seeking help.

Should you file a small case request or a formal protest?
For an examination, a small case request may be available when the total proposed additional tax and penalties are $25,000 or less for each tax period. The letter may provide Form 12203 or other specific instructions. Above that threshold, a formal written protest is generally required. A formal protest is also required for certain categories regardless of amount, including partnership and S corporation cases, employee plan cases, and exempt organization cases. IRS Publication 3498 explains these categories; the notice determines the procedure for your case.
A formal protest should generally include:
- A statement that you want to appeal.
- Your name, address, and contact information, plus the affected tax periods and disputed issues.
- An explanation of why you disagree with each proposed change, including supporting facts and any legal authority you rely on.
- The declaration required under penalties of perjury, and the signature and other details required by current IRS instructions.
Use Publication 5, Your Appeal Rights and How To Prepare a Protest If You Don’t Agree, together with your notice for the current declaration language and case-specific requirements. Do not assume that a letter or form used for one kind of IRS decision will work for another.

What if the letter concerns collection or an offer in compromise?
Collection matters involving liens, levies, seizures, or installment agreements have procedures distinct from many examination appeals. Follow the notice’s directions and consult IRS Publication 1660, Collection Appeal Rights. For example, IRS Appeals says a rejected offer in compromise may be appealed within 30 days of the rejection letter. Do not apply the general formal-protest deadline to a different procedure without checking its notice.

Statutory notice of deficiency
A statutory notice of deficiency proposes additional tax. If you timely petition the United States Tax Court, you can dispute the proposed adjustment before paying it. The petition deadline is separate from an administrative appeal deadline and is specific to the notice. Check it immediately; requesting Appeals review is not a substitute for filing a timely petition.

Refund dispute
A refund suit is another distinct route. In general, a taxpayer who has fully paid the tax and had a refund claim denied—or whose claim has gone unacted upon for six months—may be able to sue in a U.S. District Court or the U.S. Court of Federal Claims. A refund-denial notice has its own limitation period. This is not an Appeals protest; check the applicable rules and deadlines for the particular claim.

| Option | Best suited to | What it does |
|---|---|---|
| Independent Office of Appeals | A decision with appeal rights in an IRS notice | Provides administrative review. File as the notice directs, through the IRS office that handled the matter. |
| Low Income Taxpayer Clinic (LITC) | An individual with an IRS dispute who meets the clinic’s criteria | May provide free or low-cost representation in audits, appeals, collection disputes, or court, and may offer taxpayer-rights education. |
| Taxpayer Advocate Service (TAS) | A qualifying problem involving financial hardship, an unresolved IRS issue, or a failing IRS process | Helps with qualifying IRS service problems; it is not an Appeals protest. |
| VITA or TCE | A person who needs eligible basic return-preparation help | Provides free tax-return preparation; it is not representation in an IRS controversy. |
| Tax Court or refund suit | A qualifying deficiency or refund dispute | Provides a court route with separate procedures and deadlines. |
Low Income Taxpayer Clinics
LITCs are independent of both the IRS and TAS. They may represent qualifying people before the IRS or in court, including in audits, appeals, and collection disputes. Clinics also provide education about taxpayer rights, including for some taxpayers who speak English as a second language. Services are free or low cost, but each clinic decides whether an applicant meets its income and other criteria. Use the IRS or TAS clinic locator, or IRS Publication 4134, to find clinics and language services.

Taxpayer Advocate Service
TAS may be appropriate if an IRS problem is causing financial difficulty, you have tried and failed to resolve it through regular IRS channels, or an IRS system, process, or procedure appears not to be working as it should. Call 877-777-4778 or use TAS’s contact page to look for local help. Requesting TAS assistance does not extend a deadline in an IRS notice.

These programs prepare returns; they are not substitutes for LITC representation in an IRS dispute.
Quick Recap
Which route fits your situation?
- You disagree with a proposed IRS adjustment: use the appeal-rights letter to determine whether a small case request or formal protest applies, then file it with the specified IRS office.
- You received a statutory notice of deficiency: check the Tax Court petition deadline at once if you want to dispute the proposed tax before paying it.
- You need representation in a dispute and may meet income or other criteria: contact an LITC through the IRS or TAS locator or Publication 4134.
- You face financial hardship or cannot resolve an IRS service problem through normal channels: consider contacting TAS, while keeping any notice deadline on track.
- You need help preparing a return rather than contesting an IRS decision: check VITA or TCE site eligibility and availability.
