Employee deductions for workplace meals may be outside GST when the canteen is a contractual employment perquisite, but that does not automatically make the GST on the canteen provider’s invoice eligible for input tax credit (ITC). Treat employee recoveries and ITC as separate questions: document the employment arrangement, check whether a law requires the facility, and allocate credit carefully.
When are employee canteen recoveries subject to GST?
CBIC Circular No. 172/04/2022-GST, issued 6 July 2022, clarifies that perquisites provided by an employer to an employee under their contractual agreement are not subject to GST when provided in accordance with that agreement. The circular explains that such perquisites are in lieu of the employee’s services in relation to employment. Read the CBIC circular.
For a canteen arrangement, the relevant question is whether the meals and any employee contribution form part of the employment-linked arrangement in practice—not merely whether payroll deducts an amount. Keep the employment terms or applicable HR policy and canteen arrangements aligned with how the facility actually operates.

Schedule III of the CGST Act treats services by an employee to an employer in the course of or in relation to employment as neither a supply of goods nor a supply of services. That is an employee-to-employer rule; the employer’s provision of meals is addressed separately by CBIC’s clarification on contractual perquisites. See the CGST Act.

Why a blanket answer is risky
Advance rulings have reached different conclusions on canteen recoveries. In KION India, the Tamil Nadu AAR treated nominal employee recovery as not subject to GST under the circular. The Federal-Mogul Goetze AAR records a contrary approach, including analysis of deductions as consideration and the employer’s activity as business. These rulings are fact-specific, not a universal nationwide judgment.
Under the CGST Act, an advance ruling applies within the statutory scope to its applicant and the concerned or jurisdictional officers. Another taxpayer’s ruling can be informative, but check your own facts, state, and any applicable binding court decision before relying on it.

Is ITC available on the canteen provider’s invoice?
Assess ITC separately from GST on employee recoveries. Section 17(5)(b) generally blocks credit for food and beverages and outdoor catering, but its proviso permits credit where the employer is obliged under a law in force to provide the relevant supply. Confirm the current consolidated statute and whether that legal obligation applies to the workforce and facility in question.

In KION India, the Tamil Nadu AAR applied the exception to a mandatory factory canteen, but limited ITC to the portion of the cost borne by the employer. It excluded the portion recovered from employees. That result is tied to KION’s facts; do not assume a voluntary canteen qualifies or extend the ruling to contract workers, visitors, or other groups without checking the applicable law and circumstances.
CBIC’s older GST Sectoral FAQs say tax paid to canteen providers is not creditable. Read that answer alongside the later statutory exception and CBIC’s interpretation of contractual perquisites; it should not be treated as an unqualified statement of the current rule for every legally mandated facility.
How to compare your arrangement with the rulings
Before deciding how to treat recoveries and ITC, compare the facts that can change the analysis:
Rank #4
- Who uses the canteen: distinguish direct employees from contractor personnel, visitors, or other groups.
- Whether the facility is legally required: identify the law that applies to the employer, facility, and covered workers.
- How the benefit is documented: check whether meals or the canteen facility appear in employment terms or an applicable policy.
- Who bears the cost: separate employee recoveries from the employer-funded share.
- Which jurisdiction applies: consider the state and any relevant ruling or court authority.
The GST Council’s AAR index lists applicant questions about whether a nominal salary deduction for factory food is a supply of service and whether ITC is available on catering services. Those are the applicants’ questions, not a general determination of the law.
How to record canteen invoices and employee recoveries
The following is a practical bookkeeping presentation inferred from the transaction. The cited GST provisions and circular do not prescribe ledger names or a mandatory journal entry.
Best Value
- Post the provider’s invoice. Record the gross invoice to canteen or employee-welfare expense, separating the GST charged. Identify any ITC that may be eligible under the blocked-credit rule and its legal-obligation exception.
- Track employee collections separately. Record salary deductions or other collections in a traceable employee-recovery account, or reduce canteen expense if that is the entity’s consistent accounting policy. Reconcile collections to provider invoices and meal records.
- Allocate ITC to the supportable amount. Document the legal obligation and covered workers. Where the KION fact pattern is relevant, its ruling limits credit to the employer-funded share and excludes the recovered share. Check other worker groups separately.
- Retain supporting records. Keep the canteen contract, employment terms or HR policy, analysis of statutory applicability, provider tax invoices, employee-recovery records, and the calculation of eligible and ineligible credit. This is practical documentation guidance, not a checklist prescribed by the circular.
- Reassess when circumstances change. Review the position if the law, employment or canteen contract, covered worker group, or relevant jurisdictional authority changes.
Illustrative bookkeeping mechanics
At invoice booking, an entity might debit canteen expense for the employer-funded amount, debit an employee-recovery receivable or clearing account for the recoverable amount, debit eligible input GST only to the extent supportable, and credit the provider payable for the invoice total. When payroll deducts the employee share, debit payroll payable and credit the recovery clearing account. Account mapping depends on the entity’s accounting policy and on how the provider invoice and employee amounts are structured; this is an illustration, not a prescribed GST journal.
