The FCC’s former national TV ownership cap limited an owner’s attributed audience reach to 39% of U.S. television households. It was not a limit on the number of stations or a cap on ownership of each individual station: the rule combined the markets of commercial stations in which an owner had interests, counting VHF markets in full and UHF markets at half. On August 6, 2026, the FCC announced that it had voted to repeal the fixed cap and replace it with case-by-case public-interest review. The order’s effective date and subsequent court status are not established by the available official materials.
What the FCC’s 39% TV ownership cap limited
The former National Television Multiple Ownership Rule set a ceiling on the aggregate, attributed audience reach of an entity’s interests in commercial television stations. The FCC described the ceiling as 39% of U.S. television households. It measured regulatory reach using station markets, not a company’s actual audience share or the number of people who watched its programs. FCC announcement; FCC 26-53.

The cap therefore did not mean a company could own only 39% of a station, nor did it impose a fixed maximum number of stations. It applied to the combined reach of stations for which an owner held interests that FCC attribution rules counted. Direct ownership records alone might not show every interest included in the calculation: licensees had to account for stations in which they were deemed to hold attributable interests. The calculation used the television households in the Nielsen Designated Market Areas (DMAs) where the relevant stations were located, divided by the total number of U.S. television households. The applicable DMA data were those in effect at the time of a license grant, transfer, or assignment. The rule then attributed different shares of each market based on the station’s band:

| Station type | Share of its DMA households counted toward reach |
|---|---|
| VHF | 100% |
| UHF | 50% |
The UHF discount meant a station in a UHF market contributed only half that market’s households to the regulatory calculation. As a result, 39% was a threshold for attributed reach under the rule, not a simple count of every household in every market where an owner had a station. The 39% ceiling and 50% UHF attribution were rule parameters, not independent estimates of audience share or actual viewing. FCC 26-53; FCC television ownership rules.
What the FCC changed in 2026
On August 6, 2026, the FCC announced that it had voted in Report and Order FCC 26-53 to repeal the 39% national television ownership rule and replace it with case-by-case public-interest review. The announcement describes no new national percentage threshold. Instead, the Commission said it would assess individual transactions and approve deals that satisfy the public-interest standard, while rejecting those that do not. FCC announcement.

| Question | Former rule | FCC’s announced 2026 approach |
|---|---|---|
| What governs? | A fixed 39% national attributed-reach ceiling. | Transaction-specific public-interest review; the announcement gives no replacement national percentage. |
| What is assessed? | Attributed household reach, calculated from station DMAs with VHF and UHF counted differently. | The public interest in an individual deal, including localism, viewpoint diversity, and competition, as described by the FCC. |
| When is the constraint applied? | A uniform limit on aggregate reach. | Review of a particular transaction under the public-interest standard. |
| What is established about legal status? | The former rule’s calculation and threshold are described in FCC materials. | The FCC’s vote and order are documented, but the available materials do not establish an effective date, Federal Register publication status, a stay, or a final court ruling. |
The Commission’s stated rationale was that video distribution and competition had changed, including the nationwide reach of digital platforms, and that transaction-specific review could examine localism, viewpoint diversity, and competition in each deal. Those are the FCC’s reasons for its policy change, not findings independently established here. The FCC announcement also cited a figure about streaming-service reach, but without its underlying study, measurement date, and methodology; it is not needed to explain the cap.
Can a company own stations reaching more than 39%?
Under the former rule, the 39% ceiling applied to attributed regulatory reach. The FCC’s announced replacement would consider transactions individually under the public-interest standard rather than apply that fixed national percentage. That does not mean every deal above the former threshold is automatically approved: the Commission said a deal must satisfy its public-interest review. Nor do the announcement and order materials establish that the repeal has taken effect or that its legal validity has been settled by a court. FCC announcement; FCC 26-53.

Why the repeal’s authority is disputed
FCC commissioners expressed opposing legal views. Commissioner Anna M. Gomez dissented, arguing that Congress set the cap in federal law and only Congress could change it; she characterized the decision as unlawful and beyond the FCC’s authority. The Commission majority, by contrast, said it retained authority under the Communications Act to change ownership limits and that Congress had not withdrawn that authority. These are competing arguments by commissioners, not a judicial resolution of the issue. Commissioner Gomez’s dissent; FCC 26-53.
