For U.S. federal income tax purposes, staking rewards generally enter gross income when the taxpayer gains dominion and control over them—not simply when a protocol calculates or displays them. In a trust, who reports that income depends first on whether the trust is a grantor trust, a non-grantor trust, or partly each. A new IRS safe harbor issued October 6, 2026, applies only to a limited category of qualifying exchange-traded trusts; it is not a general rule for family or private trusts.
When are staking rewards income?
IRS Revenue Ruling 2023-14 addresses a cash-method taxpayer who stakes cryptocurrency and receives additional units as validation rewards. It says the fair market value of the rewards is included in gross income for the tax year in which the taxpayer gains dominion and control. The value is measured at the date and time control is obtained. The ruling applies the same holding when staking is done through an exchange.
The ruling describes control in terms of being able to sell, exchange, or otherwise dispose of the reward. A reward calculation or balance shown in an app is not necessarily enough to establish that point. For a locked, frozen, or custodially held reward, the relevant facts may include the terms governing access and the trust’s actual ability to dispose of the units. The ruling is framed for a cash-method taxpayer and does not resolve every trust-accounting question.

Who reports the income: the grantor or the trust?
Identify the trust’s federal income-tax classification before deciding where staking income belongs. The IRS’s 2025 Instructions for Form 1041 generally treat a grantor trust as disregarded for income-tax purposes: its income, deductions, and credits are attributed directly to the grantor or other deemed owner. If only part of a trust is grantor-type, that portion is reported to its owner through an attachment, while the non-grantor portion follows the ordinary trust reporting rules. Applicable income distributed from a non-grantor portion may be reported to beneficiaries on Schedule K-1.
| Trust portion | General federal income-tax reporting treatment | What to establish |
|---|---|---|
| Grantor trust | Income is generally treated as belonging to the grantor or other deemed owner, rather than reported as the trust’s own income in the usual way. | Who is treated as the owner under the trust’s tax classification and which assets or income belong to that portion. |
| Non-grantor trust | Follows normal Form 1041 trust reporting rules; applicable distributed income may be reported to beneficiaries on Schedule K-1. | Trust-level income and deductions, allocations, and any relevant beneficiary distributions. |
| Partly grantor, partly non-grantor | The grantor portion is reported to its deemed owner; the non-grantor portion is handled under normal trust rules. | The allocation of assets, rewards, income, and expenses between the two portions. |
These are general reporting distinctions, not a determination that every staking reward belongs on the same line or return. Apply the trust’s actual classification, ownership facts, and distribution history.

What does the 2026 safe harbor cover?
Revenue Procedure 2026-20, dated October 6, 2026, creates a limited safe harbor for certain exchange-traded trusts. If every requirement is met, authorization and resulting staking do not prevent a trust within the procedure’s scope from qualifying for federal income-tax purposes as an investment trust and a grantor trust. The procedure does not create a safe harbor for all trusts that stake digital assets.

- The trust’s interests must trade on a national securities exchange, and the trust must satisfy applicable Securities and Exchange Commission and exchange conditions.
- The trust may hold only cash and one type of digital asset on a permissionless proof-of-stake network.
- A custodian controls the private keys, while the trust retains tax ownership of the digital asset.
- The trust’s activities and staking purpose are restricted, and additional custody, liquidity, staking-provider, slashing, and reward-distribution conditions apply.
The procedure sets a distribution condition for qualifying trusts: net rewards must be distributed proportionately, in kind, for cash, or through both methods, no more than 60 days after the end of the calendar quarter in which the trust gains dominion and control over those rewards. This is a condition of this particular safe harbor. It does not replace the general dominion-and-control timing rule for other taxpayers or trusts.
The procedure allows certain trusts six months after October 6, 2026, to implement its requirements and permits reliance on the earlier Revenue Procedure 2025-31 safe harbor during a transition period. The procedure also says not to draw conclusions about federal tax consequences it does not expressly address, including whether staking income is effectively connected with a U.S. trade or business or is unrelated business taxable income. A trust should assess the procedure’s full terms with a tax professional before relying on it.

How to report staking activity on Form 1041
The return path depends on classification and the activity being reported. The IRS’s 2025 Form 1041 instructions include a digital-assets question that covers receiving new digital assets through staking. A fiduciary should answer the applicable question for the return year using that year’s form and instructions. The same instructions direct capital-asset dispositions to Form 8949 and Schedule D (Form 1041).

Determine whether it is grantor, non-grantor, or divided between those portions, and identify the deemed owner where applicable.
- Determine when control arose. For each reward, document when the trust or deemed owner could sell, exchange, or otherwise dispose of the units.
- Value the receipt. Record the reward’s U.S.-dollar fair market value at the date and time control was obtained, with the valuation source.
- Allocate and report. Apply the trust’s classification and allocation facts to determine whether the income is reported by the deemed owner, the trust, or through applicable beneficiary reporting.
- Report later dispositions separately. If the digital asset is later sold or otherwise disposed of and is a capital asset, calculate the disposition using Form 8949 and report it on Schedule D (Form 1041), as applicable.
How are a later sale and the original reward different?
Receipt of a staking reward and a later sale or other disposition are separate tax events. The reward’s fair market value at the time control is obtained is the amount included in gross income under the ruling. If the trust or deemed owner later disposes of the units, the disposition is calculated separately using the asset’s basis and the transaction details. IRS digital-asset guidance calls for records that support the basis and the disposition calculation; capital-asset dispositions are reported on Form 8949 and Schedule D when applicable.

What records should a trustee keep?
Maintain a transaction-level record for each reward and each later disposition. IRS digital-asset recordkeeping guidance calls for documentation of receipts, dispositions, and U.S.-dollar fair market value for digital assets received as income. For disposition calculations, it identifies the asset type, date and time, units, value, and basis as relevant information.
- For each reward: asset and network, units received, date and time control was obtained, the facts showing how control was established, U.S.-dollar fair market value at that time, valuation source, and the wallet or trust account that received it.
- Supporting documents: custodian or staking-provider statements and records of fees or withholding, if any.
- For each later disposition: asset type, transaction date and time, units disposed of, proceeds or other value received, and basis records.
- For trust reporting: workpapers showing which portion is grantor-owned or non-grantor and how rewards and related expenses were allocated.
As a practical reconciliation step, compare on-chain activity with custodian statements, exchange reports, and the trust ledger before preparing the return. Keep the underlying records and allocation workpapers together so the reported receipt date, valuation, ownership, and later basis can be traced to the supporting evidence.
Which facts can change the answer?
Before settling the tax treatment, examine the arrangement across these points:
- Classification: grantor, non-grantor, or partly grantor affects who reports the income.
- Control: the reward’s availability and the ability to dispose of it help determine the recognition date.
- Staking arrangement: direct staking and exchange or custodial staking can raise different factual questions, although Revenue Ruling 2023-14 applies its stated holding to exchange staking too.
- Activity: initial reward income and a later sale or other disposition are distinct reporting events.
- Safe-harbor eligibility: Revenue Procedure 2026-20 is relevant only if the trust meets all of its conditions.
This article addresses U.S. federal income tax guidance. State and non-U.S. tax treatment may differ.
