There is no nationwide retention period or single access rule for automated license plate reader (ALPR) records in the United States. The controlling answer depends on the state, the agency operating the system, the kind of record involved, and whether the information was preserved for an investigation or legal request.
North Carolina and Vermont show why a national number is misleading. North Carolina requires an agency policy and sets a one-year destruction rule for data preserved after a request, while Vermont’s cited law allows 18 months for covered active data and requires destruction of the original, copies and backups. Neither example should be treated as a rule for every state.
Why ALPR retention has no single national answer
ALPR systems capture images or plate-associated information when a camera system observes a vehicle. The legal lifespan of that information is not set by one federal schedule. State statutes, local rules, the operating agency’s written policy and the status of the record all matter.

A statute may address ordinary system data, information retained because someone made a preservation request, or material connected with an investigation. Those categories can have different deadlines. A policy may also describe who receives accounts, how searches are logged, when information can be shared and how deletion is performed.

The National Conference of State Legislatures’ overview of state ALPR laws catalogs differences in retention, sharing, agency-policy and public-records provisions. It does not establish a universal period. A vendor’s default setting is not a substitute for the law and policy governing the agency that operates the system.
First identify the jurisdiction and the record type
Before asking “How long do police keep my plate data?” identify four facts:
- Jurisdiction: the state and, if relevant, the city, county or other agency operating the cameras.
- System operator: the law-enforcement or public-safety department that controls the database, rather than merely an agency that can query a shared system.
- Record category: ordinary captured data, data preserved after a request, or information associated with an investigation or legal proceeding.
- Access question: whether you mean an employee’s ability to query the system, another agency’s access, disclosure under legal process, or a public-records request.
These distinctions prevent a common error: applying a special evidence-preservation deadline to every scan, or assuming that an employee account means the public can obtain the same search history.

Ordinary captured data
Ordinary data is information held as part of the system’s routine operation. The applicable statute or agency policy may set a maximum period, a deletion schedule or conditions for keeping it longer. The supplied examples do not establish a national ordinary-retention period, so an exact answer requires the operator’s current policy and the law of that jurisdiction.
Preservation-request data
A preservation request changes the analysis. It tells the custodian to hold specified information that might otherwise be deleted. North Carolina’s law illustrates this structure: the destruction clock described in the statute runs from the initial preservation request, not from the date an individual vehicle was observed.

Investigative or legally retained evidence
Information connected with an investigation or proceeding may be governed by additional evidence, records-management or legal-process rules. Do not assume that a general ALPR deletion deadline automatically erases material that has been lawfully preserved for another purpose. Ask the custodian which rule applies to the particular record.
Copies and backups
Some laws expressly address copies and backups. Vermont’s cited provision requires destruction of the covered information and copies or backups when its permitted period expires. Where a statute is silent, the agency policy and applicable records rules determine how replicated data is handled.
North Carolina: policy requirement and a one-year preservation rule
Written policy before operation
North Carolina General Statutes § 20-183.31 requires an agency using an ALPR system to adopt a written policy before the system becomes operational. That policy is the starting point for questions about retention, authorized users, sharing and deletion. The statute does not turn the policy requirement into a nationwide model; it applies to the North Carolina agencies covered by the law.
One year after an initial preservation request
North Carolina General Statutes § 20-183.32 says captured plate data subject to a preservation request must be destroyed under the custodian’s retention policy one year after the initial request, unless another preservation request arrives within that period. A later request resets the period. This is a rule for the specified preserved data, not evidence that every ALPR scan in North Carolina lasts exactly one year.
The practical questions are therefore: when was the first preservation request made, did a subsequent request reset the period, and what does the custodian’s retention policy require? An agency may need those dates to determine whether the statutory destruction point has arrived.

Who may receive preserved data
The same provision limits disclosure to a criminal justice officer at a state or local law-enforcement agency, or a similar federal official, when the recipient has a legitimate law-enforcement purpose and submits a written request. This describes a controlled law-enforcement disclosure route; it does not create a general public right to search the database.

No sale of captured plate data
North Carolina’s statute states: “Captured plate data shall not be sold for any purpose.” That prohibition concerns sale; it does not answer every question about authorized governmental sharing, a court process or public-records treatment. Those issues must be checked separately.
Vermont: 18 months for covered active data, then destruction
Designated personnel and authorized queries
The version of 23 V.S.A. § 1607 identified as effective July 1, 2025 limits active-data access within a department to designated personnel who have been granted accounts for authorized queries. An account is therefore an internal authorization, not proof that anyone may browse the records or that the public can obtain a plate history.
Expiration of the permitted period
For the covered information in that provision, the permitted retention period is 18 months. When the period expires, the Department of Public Safety and local agencies holding the information must destroy it and cause copies or backups to be destroyed as well. The statute expressly says the agencies “shall destroy it and cause to have destroyed any copies or backups made of the original data.”
The 18-month figure is tied to the statutory version and covered information described above. It should not be presented as Vermont’s answer for every conceivable investigative record or as an industry average.

North Carolina and Vermont compared
| Question | North Carolina | Vermont (version effective July 1, 2025) | Nationwide answer |
|---|---|---|---|
| Policy requirement | Agency must adopt a written ALPR policy before the system is operational (G.S. 20-183.31). | The cited provision governs covered information and access; the agency’s current policy still matters. | No single national policy requirement. |
| Retention period shown by the cited rule | Preserved captured data is destroyed under the custodian’s policy one year after the initial preservation request, unless another request arrives and resets the period. | Covered information may be retained for 18 months; expiration triggers destruction. | No national period established. |
| Who can query or receive data | For the preservation-disclosure route: a state or local criminal justice officer, or similar federal official, with a legitimate law-enforcement purpose and written request. | Active-data accounts are limited to designated personnel making authorized queries. | Depends on state law, agency policy and the type of disclosure. |
| Copies and backups | The cited preservation provision states the destruction rule; ask the custodian how its policy handles replicated data. | Copies and backups must also be destroyed when the permitted period expires. | Varies by jurisdiction. |
| Public access | Not granted by the cited preservation-disclosure language; other public-records rules must be checked. | An internal account restriction does not establish public access; public-records treatment must be checked separately. | Varies under state public-records law and exemptions. |
“Who can access them?” means several different things
Agency user access
An agency may authorize particular employees or roles to query active data. Vermont’s designated-personnel rule is an example. Ask whether access is limited by job role, whether searches require a stated purpose and whether the agency keeps an audit trail. Those operational details belong in the current policy.
Interagency sharing
One department’s ability to share or receive information is a separate question from an individual employee’s account. A law may permit a defined law-enforcement disclosure while restricting other transfers. Confirm which agencies may receive data, for what purpose and under what written-request or approval condition.
Legal-process access
A preservation request, subpoena, court order or other legal process can place information in a different category from routine system data. Ask the custodian whether the record was preserved, the date of preservation and the legal authority for any disclosure. Do not infer the answer from the ordinary deletion schedule.
Public-records access
Public-records treatment varies. A rule that authorizes designated officers to query a system does not say that the general public can inspect plate histories. Conversely, a public-records statute may require disclosure of some administrative material while exempting operational or investigative information. The agency’s response should identify the law and exemption it relies on rather than simply saying “ALPR records are private” or “all records are public.”

There is no universal right established by these sources for a person to obtain every record associated with their vehicle or plate. A request may be denied, narrowed or redirected depending on the state’s public-records rules, investigative exemptions, identity verification requirements and whether the data still exists. Request the agency’s explanation and the specific legal basis for any withholding.

How to find the exact answer for a particular agency
- Name the operator. Locate the department or public-safety agency that runs or controls the ALPR database. If several agencies appear involved, list each one.
- Obtain the current written policy. Ask for the ALPR policy covering retention, authorized users, permitted searches, sharing, preservation requests, deletion and backups. In North Carolina, the policy is required before operation.
- Classify the requested information. State whether you seek routine scans, a specific preservation request, an investigative record, an audit log or a policy document. A precise category avoids an answer based on the wrong deadline.
- Check the current statute. Use the state citation and verify the version in force on the relevant date. Vermont’s 18-month rule, for example, is identified with a July 1, 2025 effective version.
- Ask about dates. For preserved information, request the date of the initial preservation request and whether a later request reset the destruction period. For other data, ask when the agency’s ordinary retention clock begins.
- Separate access routes. Make clear whether you are asking for an employee query, an interagency disclosure, a legal-process request or a public-records release. These routes can have different standards.
- Request a written response. Ask the agency to identify the retention rule, the access authority and any exemption or redaction basis. Keep the response with your request and any appeal deadline.
A precise request you can send
A focused request is more likely to produce a useful answer than “Send me all ALPR data.” You can write:
Please identify the agency’s current automated license plate reader policy, including ordinary retention, preservation-request retention, authorized users, interagency sharing, deletion of copies and backups, and public-records procedures. For the record category described below, please state whether the data exists, the date its retention period began, the rule governing access, and the legal basis for any withholding.
Then describe the vehicle, date range, location and record category without asking the agency to make assumptions about what you mean. If you seek your own information, say that explicitly but recognize that the applicable public-records law may not require release.
Common mistakes and how to avoid them
- Quoting “one year” as a national rule: North Carolina’s one-year period applies to captured data after an initial preservation request and can reset after another request.
- Quoting “18 months” for every system: Vermont’s figure applies to the covered information and statutory version identified above.
- Confusing an account with public access: A designated employee account authorizes internal queries; it does not create a public search portal.
- Ignoring copies and backups: Vermont expressly includes them, while other jurisdictions may address them in policy or another rule.
- Assuming deletion is immediate: A preservation request or investigative hold may change the ordinary schedule.
- Assuming the vendor controls the legal period: The operating agency’s law and policy control the public-law question.
- Requesting a plate history without a category or date: Specify the agency, date range and purpose so the custodian can identify the relevant rule.
What these examples establish—and what they do not
The North Carolina and Vermont provisions demonstrate lawful variation: different clocks, different access controls and different treatment of copies or backups. They do not establish an average retention period, a universal right to obtain your own records or a rule for every state, locality or ALPR system.
For a reliable answer, use the agency’s current policy together with the current statute and public-records rules for the jurisdiction. If the agency says the record was deleted, ask which schedule required deletion, whether a preservation request changed the date, and whether copies or backups were included. If access is denied, request the specific exemption or legal authority rather than relying on a general statement about ALPR data.
