A GST-registered Indian SaaS company that buys software or another service from a supplier outside India may have to pay IGST under the reverse-charge mechanism. The key test is whether the supplier is outside India, the recipient is in India, and the place of supply is in India. Paying in Indian rupees does not, by itself, change the result. The company should verify the supplier, the Indian GST registration receiving the service, the place-of-supply rule, the service classification, and current filing requirements before recording or paying tax.
Start with the import-of-services test
For an overseas subscription, the central GST question is not simply whether the invoice says “SaaS,” whether the supplier accepts rupees, or where the company’s employees log in. The transaction must be assessed against the import-of-services conditions in the IGST Act: the supplier is located outside India, the recipient is located in India, and the place of supply is in India. CBIC’s sectoral FAQ says that a registered business receiving foreign software for use in its firm is liable to IGST under reverse charge when the relevant conditions are met.
These are three separate facts to establish. A foreign supplier does not alone settle the question: the place of supply still matters. Likewise, an Indian customer does not alone settle it if a statutory place-of-supply exception changes the analysis. Treat the result as a transaction-level assessment rather than a rule that every payment to a foreign software company automatically attracts the same tax treatment.
1. Identify the actual supplier
Use the legal entity that supplies the service, not just the product name, website, or brand shown in the interface. Check the contracting entity, invoice issuer, billing entity and relevant agreement. Where an intermediary is involved, establish who is supplying what; the law also has rules relevant to intermediaries in the OIDAR context. If the contracting and billing details point to different entities, retain the documents and have the relationship reviewed rather than assuming that the platform name is the supplier.

2. Identify the recipient in India
For a company with more than one Indian GST registration, identify which registered establishment or fixed establishment is most directly concerned with receiving the service. The IGST Act’s recipient-location framework accounts for cases in which more than one establishment is involved. Do not allocate a subscription to a GST registration solely because it paid the invoice or because the employees using it sit there; document the facts that support the recipient determination.
3. Determine the place of supply
The general cross-border services rule places the supply at the recipient’s location, subject to statutory exceptions. OIDAR has a recipient-location rule of its own. The service’s actual features and arrangement therefore matter: confirm whether an exception applies rather than treating the general rule as unconditional. If the subscription includes several distinct services or unusual delivery arrangements, get the classification and place-of-supply analysis checked for the actual contract.
Payment currency does not decide GST treatment
CBIC directly addresses the case of foreign software bought for use in a GST-registered firm and says that “the factum of which currency was used to pay the consideration is immaterial.” Paying by an Indian bank transfer in rupees, rather than in foreign currency, is not by itself a way to avoid reverse-charge IGST. The relevant analysis remains the supplier, recipient and place-of-supply facts.

Keep the payment record because it helps reconcile the subscription and invoice, but do not use the payment currency as a substitute for the import test. If the supplier accepts INR or a local payment intermediary appears in the transaction, that fact does not necessarily change which entity supplied the service or where the recipient is located.
Use a consistent finance workflow for each subscription
A repeatable intake process helps a finance team distinguish an overseas imported service from a domestic purchase or a transaction requiring a different analysis. Apply it when a subscription is first purchased, renewed, transferred to another Indian establishment, or materially changed.
- Collect the transaction record. Keep the supplier’s legal name and location, contract or order confirmation, invoice, subscription term, payment evidence, and the GST registration or establishment that receives the service together. Note any intermediary or separate billing entity.
- Record the service being supplied. Describe the subscription’s functions and delivery arrangement in practical terms. A product label such as “cloud,” “database,” or “SaaS” is not a substitute for determining the nature and classification of the service.
- Run the import and place-of-supply checks. Confirm the supplier’s location, the Indian recipient, and whether the applicable place-of-supply rule places the supply in India. Record the reason for the conclusion, especially where an exception or multiple establishments could be relevant.
- Determine reverse-charge treatment and the applicable rate. If the import conditions are met for the registered business, CBIC’s guidance says IGST is payable by the recipient under reverse charge. Confirm the current classification and rate entry for the specific service instead of applying a rate based only on the word “software.”
- Create the recipient-side invoice record where required. CBIC states that a registered person liable to reverse charge for services received from a person located outside India must issue a self-invoice on the date of receipt. Its FAQ also says to report that invoice in the GST return for the month in which the supply takes place. Because filing mechanics and statutory wording can change, check the current rules and the company’s circumstances before relying on the FAQ for the operational date or return treatment.
- Reconcile the tax and supporting records. Match the invoice or self-invoice record to the contract, payment and subscription period. Keep the working that supports the supplier, recipient, place-of-supply and rate decisions so another reviewer can follow the conclusion.
- Assess input tax credit separately. Do not treat payment of reverse-charge tax as an automatic guarantee that the same amount is immediately available as credit. Review the current statutory conditions, business use, documentation and any applicable restrictions for the company’s facts.
Registered businesses and unregistered recipients are not the same case
CBIC’s FAQ distinguishes a registered recipient obtaining online database access from abroad from an unregistered recipient. In its registered-recipient example, the recipient pays applicable IGST under reverse charge. In its unregistered example, CBIC describes the service as OIDAR and says the service provider is liable to register and pay tax. That is a useful distinction, but it should not be stretched into a blanket rule that every unregistered business is treated exactly like a private consumer.

The statutory category relevant to the supplier-side OIDAR rule is a “non-taxable online recipient”: an unregistered person receiving OIDAR for a purpose other than commerce, industry, or a business or profession. Whether that category applies depends on both registration and purpose. An unregistered person using a service for business or professional activity should not assume that the FAQ’s simplified consumer-facing description resolves the treatment of their own transaction.
What counts as OIDAR
The IGST Act defines OIDAR by the way the service is supplied: it is delivered through the internet or an electronic network, is essentially automated, involves minimal human intervention, and cannot be supplied without information technology. Cloud services are expressly included. A service should be assessed against those characteristics rather than classified as OIDAR merely because a customer accesses it online.
Why supplier identity still matters
For the non-taxable online recipient situation, the Act places liability on a supplier in a non-taxable territory supplying OIDAR to that recipient, subject to rules concerning intermediaries. If a platform, reseller, or other entity appears between the customer and the service provider, identify the relevant supplier and arrangement before deciding which party has the obligation. The direct-supplier and intermediary cases should not be collapsed into one assumed outcome.

Do not assume every SaaS subscription has an 18% rate
CBIC’s rate schedule lists a total rate of 18% for the general category of other professional, technical and business services under heading 9983. That is a category-level entry, not proof that every overseas software or SaaS subscription belongs in heading 9983. The specific service’s classification and the applicable current entry must be confirmed before quoting or applying 18%.
For a finance team, this means keeping the rate analysis distinct from the reverse-charge analysis. The import test addresses whether the transaction is an import of services and who bears the tax under the relevant treatment; classification establishes the rate applicable to the service. A correct answer on one does not automatically establish the other.

Keep evidence that supports the decision
For each subscription, retain a compact file that allows the company to explain its conclusion without reconstructing the transaction later. The exact documents will vary, but the record should connect the commercial arrangement to the GST analysis.

- Supplier evidence: contract, order confirmation, invoice details and the supplier’s legal identity and location.
- Recipient evidence: the Indian GST registration or establishment most directly concerned with receiving the service, including a note where more than one establishment is involved.
- Service evidence: a description of what the subscription does and how it is delivered, especially if OIDAR status or a classification question is material.
- Tax working: the import-of-services and place-of-supply conclusion, any exception considered, classification and rate basis, and reverse-charge decision.
- Accounting and filing evidence: invoice or self-invoice record where applicable, payment reconciliation and the return period treatment, checked against current requirements.
- Credit assessment: the separate analysis of whether input tax credit is available under current conditions for the company’s use and documentation.
These records are particularly useful when renewals use a different billing entity, a subscription moves between Indian registrations, or an agreement bundles software access with other services. Revisit the conclusion when those facts change rather than automatically carrying forward an old classification or recipient allocation.
Common mistakes and how to avoid them
- Using INR as the deciding factor. Currency is immaterial to CBIC’s answer on foreign software for a registered firm. Apply the import conditions instead.
- Calling every online product OIDAR. OIDAR has statutory characteristics, including essential automation and minimal human intervention. Examine the actual service.
- Assuming “SaaS” means heading 9983 at 18%. The schedule’s 18% entry applies to a stated general category; it does not establish the classification of every subscription.
- Assuming the cardholder or payer is always the recipient. For multiple establishments, determine which is most directly concerned with receiving the service and retain the basis.
- Treating the self-invoice FAQ as a complete current filing manual. CBIC gives a self-invoice and reporting statement, but current statutory rules and the facts of the supply should be checked for timing and mechanics.
- Taking input tax credit automatically after paying reverse-charge tax. Credit eligibility is a separate question that depends on applicable conditions and the company’s facts.
- Applying the consumer OIDAR example to every unregistered business. The non-taxable online recipient definition also turns on whether the purpose is outside commerce, industry, business or profession.
When to escalate the analysis
Ask a GST adviser to review the transaction when the supplier identity is unclear, a reseller or intermediary is involved, multiple Indian registrations could receive the service, the service bundles different deliverables, or the place-of-supply rule may have an exception. The same applies when the correct classification or input-tax-credit position is material to the company’s accounts. The relevant official guidance establishes the framework, but it does not determine the result for every vendor contract, payment flow or feature set.
Before filing, verify the current consolidated law and rules rather than relying solely on FAQ language that may reflect older statutory wording. In particular, validate the self-invoice timing and return mechanics for the company’s period and circumstances. A documented transaction review is more reliable than treating an old subscription setup or a generic “SaaS” label as a permanent answer.

- Is the actual service supplier located outside India?
- Which Indian recipient or GST registration is most directly concerned with receiving the service?
- Under the applicable general or special place-of-supply rule, is the place of supply in India?
- Do the facts amount to an import of services for which the registered recipient must pay IGST under reverse charge?
- What is the correct classification and current rate for this particular service?
- What invoice, reporting and record-keeping steps apply under current rules?
- Does the company meet the separate conditions for any input tax credit claimed?
If the answers support an import of services received by the registered Indian business, CBIC’s published guidance points to recipient-paid IGST under reverse charge. The currency used to settle the invoice does not change that conclusion; the transaction facts and current statutory treatment do.
