Start with the exact product and how it will be used—not with a generic CE-marking checklist. Identify the EU Member State and sales channel, find the rules for that product category, then confirm whether CE marking or another sector-specific process applies. Before shipment, complete any required assessment and documentation, prepare labels, instructions and warnings in the required language, and clarify the EU importer or responsible-person arrangements where relevant. Food, feed, plants and food-contact products may need additional checks.

Why EU compliance depends on the product

The EU does not have one safety and labelling checklist that applies to every export. Depending on the item, requirements may govern its design or composition, performance, manufacturing, testing, packaging, labels, instructions or warnings. Product-specific EU legislation may apply alongside general product-safety rules; where EU-wide rules do not settle an issue, national requirements may also matter. The European Commission’s guide to identifying product requirements explains why exporters must establish the product’s legal category and destination before choosing a compliance route.

For an Indian exporter, the first questions are therefore practical: What exactly is the product? What is its intended purpose? Is it sold to consumers or businesses? Which Member State will receive it, and will it be sold online, in a shop or through another channel? A product’s intended use and sales route can affect which rules and disclosures apply.

A practical workflow before shipment

  1. Define the product. Record its identity, intended use, materials and components, and whether it is intended for consumers or business users. Note the destination Member State and sales channel.
  2. Identify the applicable rules. Use the Commission’s general product-compliance guidance and its product-requirements guidance. For market-entry and trade checks, consult the Commission’s Access2Markets information on animal and plant products and its My Trade Assistant. The applicable tariff or import procedure cannot be determined from the destination alone: it depends on product classification and trade details.
  3. Check whether CE marking is legally required. Find out whether the product is covered by EU harmonisation legislation that requires the mark. If it is, identify the applicable conformity-assessment route and any relevant harmonised standards, then prepare the required technical documentation and EU declaration of conformity before affixing the mark.
  4. Map the safety and traceability information. Check the relevant sector rules and, where applicable, the EU General Product Safety Regulation (GPSR). Establish which product-identification details, business contact information, instructions, warnings and online-offer disclosures are required. Determine who will fulfil any applicable EU responsible-person role.
  5. Prepare labels, packaging and instructions for each market. Confirm the required content and the language or languages consumers can understand in each destination Member State. For prepacked goods, check the nominal-quantity declaration and keep appropriate quantity-control evidence if using the optional ℮ mark.
  6. Run separate checks for regulated food, feed, plants and food-contact products. Depending on the commodity and route, investigate authorization, establishment eligibility, official certificates, border controls, residue or pest conditions, origin marking and marketing standards.
  7. Keep the compliance record current. Retain relevant test results, declarations, technical documentation, label versions, batch identification and shipment records for the responsible parties. Recheck the rules before launch and when the product, destination or legislation changes.

CE marking: confirm the legal scope first

CE marking is required only for product categories covered by relevant EU harmonisation legislation. It is not a general mark for anything exported to Europe, a label of Indian or EU origin, or a general EU safety approval. The European Commission says it is forbidden to affix the mark to products that are not covered by the relevant directives or regulations. See the Commission’s CE-marking guidance for the scope and responsibilities.

When CE legislation does apply, the manufacturer—not a generic certificate provider—owns the applicable conformity-assessment work, technical file, EU declaration of conformity and affixing of the mark. The route and evidence depend on the product rules. Do not purchase or display a purported “CE certificate” without first establishing that the product requires CE marking and what assessment route its legislation specifies.

Labels, language, traceability and online sales

For products in scope, the manufacturer’s obligations apply whether it is based inside or outside the EU. The Commission’s general product-compliance guidance describes manufacturer duties that can include identifying applicable rules, completing the relevant assessment and documentation, preparing required declarations and information, and meeting labelling and traceability requirements.

Check the product and its offer together. Depending on the applicable rules, the product, packaging or accompanying documents may need product identification, business contact details, instructions or safety warnings. Online offers may also have required safety and traceability disclosures. The Commission’s 2025 GPSR business guidelines address these duties, including the EU responsible-person requirement in relevant cases for manufacturers outside the EU. The GPSR’s application and its interaction with sector-specific law depend on the product’s scope and when it is placed on the market, so check the applicable rules for the specific item rather than assuming GPSR replaces them.

Safety information must be in a language consumers can understand, as determined by the Member State where the product is sold. One language or label template should not be assumed to cover every destination. Confirm national language and any other applicable national requirements for each market.

Know which EU-based party has which role

The importer, an authorised representative and a GPSR responsible person are not interchangeable labels for the same service. Their roles have different legal bases and should be confirmed for the product and route.

Role What the guidance says What to confirm
Manufacturer EU guidance applies manufacturer obligations whether the manufacturer is inside or outside the EU. Where relevant, these include identifying the rules, completing assessment and documentation, and meeting declaration, labelling, language and traceability duties. (European Commission) Which product rules apply and which duties they assign to the manufacturer.
EU importer Must verify that the manufacturer has fulfilled applicable obligations before placing imported goods on the market and provide importer contact details as required. (European Commission) Who is importing the goods and what checks and contact details the applicable rules require.
Authorised representative An appointment for certain tasks where the applicable legislation provides for the role; it is not a generic substitute for the manufacturer or importer. (European Commission) Whether the product legislation allows or requires this appointment and precisely which tasks are delegated.
GPSR responsible person In relevant cases, a non-EU manufacturer must have an EU responsible person under GPSR guidance. (European Commission, 2025 guidelines) Whether GPSR applies and who fulfils this specific role; do not assume an authorised representative or importer automatically does so.

Food, feed, plants and food-contact products need extra checks

Do not treat these categories as ordinary consumer-product shipments with a few extra label fields. EU controls may depend on the commodity and can involve authorization, establishment listing or eligibility, official certification, border controls, traceability, plant-health protections, residue or pest conditions, and category-specific origin marks or marketing standards.

For food and feed, consult the Commission’s import-controls questions and answers. For animal and plant product requirements, use Access2Markets; its guidance includes India-specific rules for fresh produce. Food-contact articles also need their applicable category-specific checks rather than an assumption that general product-safety steps are sufficient.

Quantity declarations and the optional ℮ mark

Prepacked goods need a nominal quantity declaration. The ℮ mark is optional, not a general EU label or a substitute for that declaration. Using it brings quantity-control responsibilities, so check that the required controls and evidence are in place before adding it. The Commission’s guide to the ℮ mark sets out the quantity-information rules.

Do trade preferences replace safety or labelling rules?

No. A preferential trade arrangement does not waive EU health and food-safety standards. The Commission’s EU–India agri-food factsheet states that products imported under the agreement must still respect EU health and food-safety standards. Check any tariff preference separately from product compliance.
