GST on international shipping in India depends on the service supplied, the supplier’s and recipient’s locations, and the destination of the goods—not simply on whether a shipment crosses a border. First determine the place of supply under the applicable IGST Act rule; then check the current rate or exemption, any reverse-charge rule, and input tax credit separately.

Start with the service on the invoice

“International shipping” can describe several supplies with different tax questions. Identify what the supplier actually agreed to provide before applying a place-of-supply rule.

  • Transportation of goods: carriage by air, sea, road, rail or another mode. The cross-border rule discussed below excludes mail and courier.
  • Mail or courier: section 13(9)’s destination rule expressly does not cover transportation by mail or courier.
  • Freight forwarding or agency: arranging or acting for a carrier is not automatically the same supply as transporting the goods.
  • Port cargo handling or another port service: classify the particular activity and contract; a port-related charge is not automatically governed by the rule for carriage.

A combined invoice may contain more than one service. Its description alone may not establish how each charge should be treated.

What is the place of supply for international freight?

The parties’ locations determine which statutory framework to examine. For transportation of goods other than by mail or courier, section 13(9) of the IGST Act states: “The place of supply of services of transportation of goods, other than by way of mail or courier, shall be the place of destination of such goods.” The rule is about the place of supply; it does not, on its own, set the GST rate or settle the rest of the invoice’s treatment. Read the IGST Act on CBIC.

Situation Place-of-supply point to check What this does not decide
Supplier or recipient is outside India; the service is transportation of goods other than mail or courier IGST Act section 13(9): the destination of the goods. The applicable rate, exemption, reverse-charge treatment or input-tax-credit eligibility.
Supplier and recipient are both located in India; transportation is supplied to a registered person Section 12(8) generally places the supply at the registered recipient’s location. Its proviso instead makes the destination the place of supply when the goods are transported to a place outside India. Whether a particular recipient may claim input tax credit, or how a particular invoice should be taxed.
The service is mail, courier, forwarding, agency, handling or another separately supplied service Do not assume the section 13(9) destination rule answers the case. Identify the service and apply its relevant place-of-supply provision. A definitive result without the contract, route, parties and applicable rule.

CBIC Circular 184/16/2022-GST discusses the section 12(8) proviso and the associated input-tax-credit question. Consult the circular for that context rather than treating the place-of-supply result as an automatic credit decision. Read Circular 184/16/2022-GST.

Does international freight automatically count as an export of services?

No. A route that crosses a border is not enough to make the supplier’s service an export of services. Under the IGST Act definition, all of the following conditions must be met:

Amazon Basics Digital Shipping Postal Scale with Tare Function, Heavy Duty Weighing Platform, 660 lb Capacity, 1 Ounce Readability, Portable, Black

  • Measuring units in kg, ounces, and pounds

  1. The supplier of the service is located in India.
  2. The recipient is located outside India.
  3. The place of supply is outside India.
  4. Payment for the service is received in convertible foreign exchange.
  5. The supplier and recipient are not merely establishments of a distinct person.

Assess each condition against the actual parties, supply, place-of-supply rule and payment. If even one condition is not met, the service does not satisfy this statutory definition of export of services. The definition is in the IGST Act text published by CBIC.

How to review a shipping invoice

  1. Separate the supplies. Identify carriage, mail or courier, forwarding or agency, cargo handling, and any other separately contracted service.
  2. Identify the contracting parties. Record the supplier and recipient, where each is located, whether the recipient is registered when relevant, and who contracted for the service.
  3. Record the route and destination. Distinguish an import, an export and a domestic movement, and identify the goods’ destination—not only the ports or countries named on the invoice.
  4. Choose the place-of-supply rule. If both parties are in India, check section 12(8) and its export-destination proviso for goods transportation. If a party is outside India and the supply is transportation other than mail or courier, check section 13(9). For other services, identify their applicable rule instead of borrowing the carriage rule.
  5. Check the export-of-services conditions, if claimed. Verify all five statutory conditions; an overseas route alone does not establish export status.
  6. Then examine the tax treatment. Check the current rate or exemption notification, any applicable reverse-charge rule, and input tax credit separately. Keep the contract, invoice and route facts with the analysis.

Can you use an old freight exemption to determine today’s rate?

Not safely. CBIC rate materials surfaced historical entries and end dates, but those dates do not establish the current treatment of every international freight service. In particular, the CBIC GST goods and services rates page lists an export-bound vessel treatment entry whose stated period ended on 30 September 2022; the CBIC Integrated Tax (Rate) index describes an earlier extension for export transportation by air or sea through 30 September 2021. Treat these as historical markers, not as proof of a current rate or exemption. Check the applicable current consolidated notification and amendments for the specific supply. CBIC GST rates · CBIC Integrated Tax (Rate) notifications.

The place-of-supply section answers where a service is treated as supplied for the relevant GST analysis. It is not a substitute for checking rate, exemption, reverse charge or credit. Nor does the available general rule establish the answer for an unspecified invoice, service or route.

How should port and cargo-handling charges be treated?

Classify each port charge by the activity actually supplied. CBIC Circular 103/22/2019-GST addresses specified cargo-handling activities supplied by port authorities and clarifies that the activities discussed are ancillary to or related to cargo handling, rather than related to immovable property for that place-of-supply analysis. That clarification should not be extended automatically to every port fee, carrier charge or service listed on a shipping invoice. Read Circular 103/22/2019-GST.

When the invoice facts are not enough

A single tax result cannot be determined from the phrase “international shipping.” Where the invoice combines services, the parties’ locations or roles are unclear, or the rate or credit treatment is disputed, review the contract and current notifications alongside the relevant IGST Act rule and CBIC clarification. Transaction-specific advice may require a GST practitioner or another qualified adviser familiar with the shipment and its documentation.
