EU data-protection law applies to an AI service whenever the service processes personal data. The compliance answer is not determined by the model’s label or by whether data came from a public website. You must map each processing operation, identify its purpose and responsible parties, choose and document a lawful basis, provide understandable information, support data-subject rights, and add safeguards when automated outputs affect people.
The General Data Protection Regulation (GDPR) and the EU Artificial Intelligence Act are separate regimes. A single service can fall under both: the GDPR governs personal-data processing, while the AI Act adds duties for specified AI interactions, generated content and, on a later timetable, high-risk systems.
When the GDPR applies to an AI service
The trigger is processing of personal data. That can occur long before a user receives an answer from a chatbot. Examples include collecting text or images from public websites, importing customer or employee files, retaining prompts, validating a model, logging outputs, and making inferences about an identifiable person.

Once personal data is involved, the service must follow the GDPR’s core principles: processing must be fair and lawful, purposes must be specified, and the data must be limited to what is necessary for those purposes. The analysis follows the actual operations rather than treating “the AI model” as one indivisible activity.

An output can also be personal data when it relates to an identifiable person or is used to make a decision about that person. Whether a particular model has become anonymous, and whether information can still be extracted or linked back to individuals, requires a factual assessment; the European Data Protection Board (EDPB) identifies model anonymity as a case-by-case issue.
Map processing through the AI lifecycle
Start with a written data map. Separate development from deployment when their purposes differ, and record the categories of data, who receives them, retention, transfers and the controls used at each stage.
| Stage | Typical operations | Questions to answer |
|---|---|---|
| Collection | Public-internet material, third-party datasets or institutional files | What personal data are present? Who supplied them, and for what original purpose? |
| Training and validation | Cleaning, labeling, model training, testing and evaluation | What is the purpose and lawful basis? Is every field necessary? Can technical measures reduce exposure? |
| Deployment | User prompts, uploaded documents, retrieval and fine-tuning | Who controls the service and who acts as processor? How long are prompts kept, and where are they transferred? |
| Inference and outputs | Generated text, scores, recommendations and inferences | Could the output concern an identifiable person or influence a significant decision? |
| Support and monitoring | Abuse monitoring, security logs, human review and incident handling | Are logs necessary, access-controlled and covered by the notice and retention schedule? |
The EDPB’s AI-model opinion stresses that a service may need a different legal analysis for development and deployment. A company might have one purpose when building a general model and another when using it to screen applications, answer customer requests or produce institutional reports. Document those purposes separately instead of assuming that a lawful basis for one automatically covers the other.
Identify the parties and choose a lawful basis
Determine whether the provider, customer or deployer is the controller, a processor acting on documented instructions, or a joint controller for a particular operation. The answer can vary by stage. Contracts should match the actual allocation of decisions about purposes and means; a label in a supplier agreement does not settle the factual question.
For every purpose, record the GDPR lawful basis and the evidence supporting it. Consent, contract, legal obligation, public task and legitimate interests can have different conditions, and a basis for using a service in production does not automatically authorize collecting unrelated data to train a model.

Legitimate interest is a test, not a blanket permission
The EDPB says legitimate interest may support some AI-model development or use, but only where two demanding findings are demonstrated: the processing is strictly necessary for the stated interest, and the controller has balanced that interest against people’s rights and freedoms. The assessment should identify the expected benefit, examine less intrusive alternatives, consider people’s reasonable expectations and likely impact, and specify safeguards.
Useful safeguards can include technical measures that limit memorization or access, stronger transparency, restricted retention, and procedures that make it easier for people to exercise their rights. If the balancing fails, changing the wording of a privacy notice does not cure the problem; the purpose needs another lawful basis, a narrower design or a different data source.

The EDPB also addresses the effect of unlawful processing during model development. A model’s later deployment is not insulated simply because the production use appears useful. Investigate how training data were obtained, whether the original processing was lawful, and what remedial or technical measures are available before relying on the resulting model.
Give people meaningful information
GDPR information must be clear and plain, not buried in a generic statement that an algorithm may be used. Depending on the operation, a notice should explain:
- the controller’s identity and contact details;
- the purpose or purposes of processing;
- the lawful basis, including the legitimate interest being pursued where that basis is used;
- recipients or categories of recipients;
- the data-protection officer’s contact details where applicable;
- international transfers and the safeguards used for them, where relevant;
- how long data will be stored or the criteria used to set the period;
- available data-subject rights and how to exercise them;
- the right to withdraw consent when consent is the basis;
- whether providing data is required by law or contract and what happens if it is not provided; and
- for relevant automated decisions, the logic involved and the significance and envisaged consequences for the person.
“The model made this decision” is not a meaningful explanation. Describe the role the system played, the factors that materially affected the result at an understandable level, the likely consequences and the route to human review. Notices should also match reality: if prompts are used for service improvement, say so; if they are not retained, do not imply that they are.

Profiling and solely automated decisions
The European Commission describes profiling as evaluating personal aspects to make predictions about someone. Automated decision-making is a decision taken by technological means without human involvement. These concepts can overlap, but a recommendation is not automatically a legally significant decision.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Scan for outdated or missing drivers - takes under a minute3Repair Windows errors before they cause bigger problemsUnder the GDPR right described by the Commission, a person generally has the right not to be subject to a solely automated decision that produces legal effects or similarly significant effects. Examples of the type of consequence that can matter include a decision that determines a person’s legal position or has a comparably serious impact on access to an important service. Assess the actual effect, not merely the system’s job title.
Limited exceptions and required safeguards
The Commission identifies exceptions where the decision is necessary to enter into or perform a contract, where the person has given explicit consent, or where Union or Member State law authorizes it with suitable safeguards. An exception does not remove the need to protect the person.
People must be told about the right to obtain human intervention, express their point of view and contest the decision. Human involvement must be genuine: a reviewer needs authority, competence and enough information to reconsider the result rather than simply approve an automated score. Keep an auditable record of the input, output, review and final outcome.
How the AI Act adds obligations
The AI Act is distinct from the GDPR. A service can comply with one regime and still fail the other. The European Commission states that Article 50 transparency obligations apply from 2 August 2026. Check the precise role (provider or deployer), system category and any exception before applying a duty.

Provider duties for direct interaction and generated content
Providers must ensure that people are informed when they directly interact with an AI system, unless that is obvious from the circumstances. Providers must also facilitate detection of AI-generated or manipulated content through machine-readable marking. The technical implementation and the applicable exception depend on the system and content, so retain evidence showing how the requirement was met.
Deployer duties in specified situations
The Commission’s Article 50 guidance identifies notice duties for specified uses, including emotion-recognition systems, biometric categorisation, deepfakes, and certain text published to inform the public on matters of public interest without human review or editorial control. A deployer should map the use case to the exact provision rather than treating every generated response as a deepfake or every classifier as biometric categorisation.
High-risk timetable
The Commission’s broader AI Act overview lists 2 December 2027 as the scheduled start for the listed obligations for high-risk AI systems. Those obligations include risk assessment and mitigation, dataset quality, logging, documentation, information for deployers, human oversight, robustness, cybersecurity and accuracy. The timetable and implementation guidance are time-sensitive; verify the current text and transitional rules for the system’s classification.
A practical compliance workflow
- Inventory data flows. List every source, prompt field, file upload, log, output and inference. Mark which elements identify or relate to a person.
- Define each purpose. Separate model development, validation, service delivery, safety monitoring, analytics and any later reuse. Do not use a broad “AI improvement” label as a substitute for specific purposes.
- Assign roles. Document whether each party is controller, processor or joint controller for each operation, and align contracts, instructions and security responsibilities.
- Select and document a lawful basis. For legitimate interests, retain the necessity analysis and balancing assessment, including less intrusive alternatives and safeguards.
- Check development provenance. Record how datasets were obtained, what notices or permissions applied, and what controls address memorization, access and deletion.
- Design the notice and rights channel. Explain identity, purposes, basis, recipients, retention, transfers, rights and automated-decision logic in plain language. Provide a workable route for access, correction, objection or other applicable requests.
- Test decision impact. Identify whether an output is merely advisory or determines a legal or similarly significant outcome without meaningful human involvement. If the latter, apply the Article 22 safeguards and document review.
- Map AI Act duties. Check Article 50 transparency cases and whether the system is high-risk under the applicable classification and timetable.
- Monitor change. Reassess when the model, dataset, purpose, retention, provider, deployment geography or decision workflow changes.

| AI Act scope | Article 50 analysis, content-marking method and high-risk classification documentation |
Common failure modes and corrections
“The data were public, so GDPR does not apply”
Public availability does not remove the personal-data trigger or answer the questions of purpose, lawful basis, necessity, transparency and rights. Trace the source and assess the actual operation.

“A human can click approve, so the decision is not automated”
A nominal sign-off may not be meaningful human involvement. Give the reviewer authority, context and time to challenge the output, and let the person know how to request that intervention.
“The AI Act replaces GDPR”
It does not. Apply GDPR rules to personal-data processing and separately assess AI Act transparency or high-risk duties.
Special context for EU institutions
The European Data Protection Supervisor’s revised orientations discuss personal-data processing throughout generative-AI development and use, including public-internet collection, third-party or institutional files, training and validation, user inputs, inferences and generated information. They also advise EU institutions to obtain reliable, current information about suppliers’ datasets and processing.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
Those orientations concern EU institutions under Regulation (EU) 2018/1725. They are useful operational context, but they are not the governing GDPR text for every commercial provider or deployer. Commercial organizations should apply the GDPR and relevant national rules to their own roles and facts.
What cannot be decided from the model name alone
There is no universal “GDPR-compliant AI” conclusion based only on a model family or vendor description. The outcome depends on the data, purposes, roles, safeguards, retention, transfers and the actual decision process. The EDPB expressly treats these questions as case-by-case because AI models and uses vary rapidly.
Keep the analysis current as legal implementation dates approach. The Commission’s stated dates—2 August 2026 for the listed Article 50 transparency obligations and 2 December 2027 for the listed high-risk obligations—are implementation milestones, not substitutes for checking the operative provisions, role definitions, exceptions and any later guidance.
“AI technologies may bring many opportunities and benefits to different industries and areas of life,” EDPB Chair Anu Talus said in the Board’s 18 December 2024 statement.
