Plan an H-1B hire as a set of conditional decisions, not a guaranteed start date. First verify that the job is a specialty occupation, the worker qualifies, and the case is cap-subject or exempt. Then attach dates and budgets to registration or selection, the Labor Condition Application (LCA), the petition, visa issuance or change of status, and U.S. work authorization. Keep a legally reviewed fallback—such as a qualifying cap-exempt role, an eligible L-1 transfer, or a delayed start—ready before making a firm offer.
The September 2025 presidential proclamation adds a separate checkpoint for some petitions filed after September 21, 2025. Its published terms concern visa issuance or entry and describe a $100,000 payment condition, with exceptions determined by the Department of Homeland Security. Earlier-filed petitions, already approved petitions, and people holding validly issued H-1B visas are identified in USCIS guidance as outside the restriction. Confirm the exact facts with current agency instructions and immigration counsel.
Why an H-1B start date is never a single-date promise
An H-1B hire passes through several gates that can fail or move independently. The position and the person must qualify, the petition may be subject to an annual cap, the employer must complete labor attestations, U.S. Citizenship and Immigration Services (USCIS) must adjudicate the petition, and the worker may still need a visa or an authorized change of status before beginning work. Treating “we will sponsor” as “the employee will start on this date” hides those dependencies.

The Department of Labor (DOL) describes a specialty occupation as work requiring “the theoretical and practical application of a body of specialized knowledge and a bachelor’s degree or the equivalent in the specific specialty.” A title such as “engineer” or “analyst” is not enough. Document the actual duties, the degree field normally required, the employee’s education or equivalent experience, and any licensing requirement. Use the DOL H-1B overview as the starting point, then have counsel test the facts against current USCIS standards.

Cap exposure
DOL’s overview lists an annual 65,000 regular H-1B cap and a 20,000 exemption for people with a qualifying U.S. advanced degree. Those are statutory program figures, not a prediction of selection odds or the number of places in a future registration season. Determine whether the case is cap-subject, cap-exempt, or based on a worker’s prior H-1B cap allocation before setting expectations.
Entry and status are separate questions
A person already in the United States may seek a change of status, while someone abroad may need consular visa processing and admission. An approved petition does not by itself guarantee visa issuance, admission, or a particular start date. Put each immigration event on the hiring plan instead of using petition approval as the finish line.
The September 2025 proclamation: make it a distinct checkpoint
The Department of State says a proclamation affects visa issuance or entry for certain H-1B workers based on petitions filed after 12:01 a.m. Eastern Daylight Time on September 21, 2025, unless the petition is accompanied or supplemented by a $100,000 payment. The State notice says DHS determines exceptions. It does not establish that every later-filed petition requires the payment or that an exception is automatic.

USCIS’s September 20, 2025 memorandum describes the restriction as prospective and identifies exclusions for beneficiaries of petitions filed before the effective time, beneficiaries of currently approved petitions, and holders of validly issued H-1B visas. Those categories do not answer every case—for example, the worker’s location, status, filing history, and travel plans still matter. Record the petition filing date and the worker’s current status in the case file, then check the Department of State notice and USCIS memorandum immediately before filing, travel, or budgeting the payment.
A step-by-step planning workflow
1. Create a position-and-worker fact sheet
Before recruiting around sponsorship, capture the facts that control eligibility:

- Detailed duties, tools, deliverables, worksite locations, and reporting structure.
- The degree field normally required for the role and the candidate’s degrees, transcripts, evaluations, and relevant experience.
- Current U.S. immigration status, location, travel plans, and any expiration dates.
- Prior H-1B petitions, approvals, periods of stay, and whether the person has already been counted against the cap.
- The legal employer, related entities, worksites, and any third-party placement arrangement.
Do not infer eligibility from a job title, a candidate’s résumé alone, or the employer’s nonprofit label. USCIS materials describe specific cap exemptions for qualifying education and research organizations; the organization and the actual work must meet those requirements.
2. Classify the case before discussing dates
Ask counsel to classify the role as regular cap-subject, eligible for the U.S. advanced-degree exemption, cap-exempt, or not presently supportable. A cap-exempt conclusion requires qualifying facts, not a strategic preference. A worker’s prior H-1B history can also change the analysis. Keep the classification and the evidence supporting it in the recruiting record so a new hiring manager does not restart the assumption months later.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Clear out junk files and repair common Windows errors3Scan for outdated or missing drivers - takes under a minute3. Build a conditional timeline
Use separate milestones and a responsible owner for each one:
- Registration or selection, where applicable: record the registration window, confirmation, and selection result. A registration is not an approval or a work authorization.
- Role and wage analysis: confirm the occupation, worksite, required wage, and supporting evidence before the LCA is submitted.
- LCA preparation and filing: the employer files through DOL’s FLAG system and makes required attestations. DOL says an LCA cannot be submitted more than six months before the employment start date; align the filing date with the intended start rather than filing merely to create reassurance.
- Petition filing and adjudication: identify the petitioner, requested classification, requested validity period, and evidence package. Keep an internal “no approval yet” date that triggers the contingency plan.
- Visa, change of status, or admission step: determine whether the worker needs consular processing, a change of status, or another authorization event. Add time for travel and document issuance when the person is abroad.
- Work-authorized start: set the employee’s first day only after counsel confirms the person may work for this employer in this role at this location.
Use ranges and decision gates rather than a single promised date. The official materials do not establish a universal processing time, and selection or filing never guarantees approval.
4. Budget the wage and the employer’s continuing obligations
The LCA is an operational and pay commitment, not a formality. The employer generally must pay the higher of the actual wage paid to comparable employees or the prevailing wage for the occupation and area. Confirm the worksite and occupational classification before budgeting compensation; a later change can require a new analysis or filing.

Budget for legal and filing costs, required notices, public-access and other records, payroll controls, and administration after approval. DOL’s FLAG LCA guidance and H-1B participation fact sheet explain wage, working-condition, notice, recordkeeping, and fee-allocation duties. Certain employer fees and expenses cannot be shifted to the H-1B worker. Make the cost owner explicit in the offer approval.
5. Check recruitment and employer-status duties
Determine whether the company is H-1B-dependent or has been found a willful violator. DOL says covered recruitment occurs before the LCA or petition is filed and that additional attestations can apply. The agency’s recruitment fact sheet states, “Recruitment must take place before the LCA or petition is filed.” The participation fact sheet describes the broader employer duties. Build the recruitment record before filing, not after a question from an auditor.
6. Run the proclamation checkpoint before committing funds or travel
Add a mandatory review of the petition filing date, the worker’s location and status, whether a valid H-1B visa already exists, and whether the planned action is visa issuance, entry, or a domestic change of status. If the published payment condition might apply, obtain written legal analysis and verify the current DHS process before treating $100,000 as either unavoidable or avoidable. Escalate any planned travel while the rule’s scope is uncertain.
7. Define a contingency trigger and owner
Choose objective triggers, such as non-selection, an evidence request that threatens the start date, an approval not received by a fixed internal date, or a visa or entry issue. Assign one executive owner, one immigration owner, and one recruiting contact. A contingency that exists only in a recruiter’s notes will not protect a project when the original date slips.
Compare only contingencies that are legally eligible
Do not present every immigration category as an interchangeable substitute. Compare routes only after counsel confirms that the employer, role, and worker satisfy the specific requirements.

| Cap-exempt H-1B employment | The employer or qualifying arrangement meets an education or research exemption. | Qualifying organization, actual job, petitioning entity, and any relationship among entities. USCIS’s small-entity compliance guide describes relevant exemptions. | Eligibility is fact-specific; exemption does not remove ordinary wage, LCA, petition, and status requirements. |
| L-1 intracompany transfer | The worker has qualifying prior foreign employment and will work for a qualifying related U.S. entity. | Corporate relationship, required period and nature of foreign employment, executive/managerial or specialized-knowledge role, and evidence of the relationship. See the USCIS L-1 policy manual. | It is not available to an unrelated employer or a worker who lacks the required qualifying history. |
| Later H-1B start | The business can hold the role open until selection, approval, visa issuance, or admission is complete. | Written offer language, project coverage, payroll start controls, and a lawful start date. | Revenue, delivery, and candidate-retention risk remain; the company must not let the person perform restricted work early. |
| Different staffing or work arrangement | The business can redesign duties, location, timing, or interim coverage without unauthorized employment. | Employment relationship, work authorization, wage and hour rules, data access, confidentiality, and any third-party placement facts. | It may solve a business gap without solving the worker’s U.S. immigration eligibility; obtain immigration and employment-law advice. |
A cap-exempt role or L-1 transfer is therefore a conditional alternative, not a promise to every candidate. If none is available, the honest plan may be to delay the start, hire another authorized worker for the interim, or reopen the role.

Pay and worksite controls
Make payroll systems match the LCA and petition. Track the required wage, hours, worksite addresses, remote-work changes, and material duty changes. Route transfers, promotions, and new worksites through immigration review before they take effect.
Notice and records
Maintain the required public-access and supporting records, document notice to affected workers where required, and preserve evidence of recruitment and wage calculations. Give HR, payroll, finance, and the manager a shared expiration calendar; a petition approval does not eliminate ongoing recordkeeping.
Fee and termination rules
Separate employer-paid costs from any permitted employee expenses. Consult counsel before a termination, reduction in hours, unpaid leave, or recovery of costs. DOL’s participation guidance explains that employer obligations continue beyond the filing event.

- Evidence: Can HR produce the duties, degree relationship, wage analysis, recruitment record, and status history supporting each decision?
How to communicate uncertainty without losing the candidate
Use offer language that distinguishes sponsorship intent from an immigration result. Explain which event is pending, what the company will pay or prepare, the latest date for a lawful start, and what contingency the company will evaluate. Do not quote the 65,000 or 20,000 figures as selection probabilities, promise that a registration will be selected, or describe the $100,000 condition as a universal H-1B fee.
Give the candidate a single contact for status updates and a schedule for reassessment. Ask the candidate to report changes in address, travel, status, or prior filings promptly. Transparent conditional language is more credible than an optimistic date that payroll and immigration teams cannot honor.
When to obtain case-specific advice
Use qualified immigration counsel before classifying a cap exemption, relying on a prior H-1B approval, changing the worksite or duties, filing an LCA, planning travel under the proclamation, or moving to an L-1 strategy. Agency pages describe the governing framework, but they do not resolve every future interpretation, exception, litigation outcome, or fact pattern. Recheck the DOL overview, FLAG guidance, State notice, and USCIS memorandum at the decision point rather than relying on a saved checklist.
