Public-space CCTV uses cameras to capture images that may be viewed live, recorded, stored, retrieved, exported or shared. Privacy rules are meant to keep those operations tied to a defined purpose: they govern what is recorded, how long it is kept, who can see it and how the system is reviewed. The legal examples below are specific to the UK, with the Surveillance Camera Code scope described for England and Wales; rules elsewhere differ.
How does CCTV work in public places?
A camera captures images and sends them to a system that can support live viewing, recording, storage, retrieval, export and controlled disclosure. The exact setup varies: a system may be watched live, record footage, do both or neither. Under the England and Wales Surveillance Camera Code, its public-space provisions apply to covered overt systems whether or not anyone is actively viewing them or they are recording.
Recorded footage can later be searched and exported. For material intended to support a police investigation, practical usefulness depends on image quality and whether the recording can be stored, exported and played back reliably. UK police guidance calls for controlled access, records of who accessed recordings and when, preservation of relevant footage before it is overwritten, and export that retains date and time information and includes the software needed for playback.
What privacy protections should govern public CCTV?
Purpose, necessity and lawful basis
An operator should identify the problem the cameras are meant to address, define a legitimate purpose and document an appropriate Article 6 lawful basis under UK data-protection law. Consent is often impractical in a public space; depending on the operator and context, legitimate interests or public task may be relevant. The presence of available cameras does not itself justify surveillance. The system should be necessary and proportionate, with less intrusive measures—such as improved lighting or environmental changes—considered first. The Home Office Code says: “Surveillance camera systems operating in public places must always have a clearly defined purpose or purposes in pursuit of a legitimate aim and be necessary to address a pressing need (or needs).” Home Office, Amended Surveillance Camera Code of Practice.

Impact assessment and minimizing capture
A data protection impact assessment (DPIA) is required where processing is likely to create high risk. The ICO says this applies in most surveillance cases because of the inherent privacy risks. Camera placement and field of view should be limited to what the purpose requires; privacy zones can help exclude places that do not need to be monitored. Notice and transparency
People should be informed before they enter a camera’s field of view. Prominent signs should appear before the monitored area, identify the surveillance and its purpose, and direct people to fuller information, such as a privacy notice with a contact route. A notice placed only on a website does not alert people at the point they encounter the cameras. ICO transparency guidance.

Retention and deletion
There is no single UK-wide number of days that all public CCTV footage may be kept. The operator should set and document a retention period that is no longer than needed for the stated purpose, then securely delete footage when it is no longer necessary. Relevant footage may need to be preserved longer for a specific active investigation. The ICO states that “the UK GDPR and the DPA 2018 do not prescribe any specific minimum or maximum retention periods which apply to surveillance systems or the information you may process.” ICO retention guidance.
Access, sharing and security
Access to live and stored images should be limited to authorized people and defined purposes. Operators should keep records of footage handling and use technical and physical safeguards, then audit whether those controls work. Sharing relevant footage with police may be appropriate under applicable rules; wider disclosure can expose bystanders, so identifying details may need to be obscured. Ongoing review
Covered operators should periodically assess whether the system remains necessary, proportionate and effective. The Code says this review should take place at least annually. A review should examine the original purpose and evidence of need alongside the camera’s field of view, retention, access, disclosure, security and transparency arrangements. These questions help residents, organizations and decision-makers distinguish a justified, controlled system from one whose scope is unclear:

- What specific problem and legitimate purpose does it address, and what evidence supports the need?
- Were less intrusive alternatives considered?
- What does each camera see, and are privacy zones used where appropriate?
- Is footage viewed live, recorded, or both?
- How long is footage retained, how is it deleted, and how is relevant evidence preserved?
- Who may access or share footage, for what reasons, and how are those actions logged?
- What physical and technical security controls are in place, and how are they audited?
- Are signs visible before people enter the monitored area, with a route to fuller information and a contact point?
- Does the system use ANPR or facial recognition in addition to ordinary video recording?
How are ANPR and facial recognition different from ordinary CCTV?
Automatic number plate recognition (ANPR) and facial-recognition systems can make footage searchable or identify people, creating privacy impacts beyond basic image recording. Connected ANPR databases and facial-recognition systems may process personal data about large numbers of people. Facial recognition used to uniquely identify someone can involve biometric special-category data, which requires additional legal conditions and safeguards. The Surveillance Camera Code provisions discussed here concern covered overt public-space systems in England and Wales. Covert surveillance by public authorities is governed through a different statutory regime. The data-protection guidance is UK-specific, not a statement of worldwide law or individualized legal advice. The ICO marks its relevant surveillance guidance as under review following the Data (Use and Access) Act, so operators should check the current guidance and applicable law before relying on it.
