A river can gain legal rights through a law or a court decision, but the legal route depends on the jurisdiction. The instrument must define what the rights mean and who may represent the river. Guardians or other representatives can speak for it, while public agencies and courts may have separate roles in preventing harm and securing remedies. Recognition alone does not guarantee protection.
How a river can be granted legal rights
There is no universal application or legal procedure. A legislature can pass a law recognizing a river or ecosystem, or a court can recognize rights while applying that jurisdiction’s constitution and laws. The law or judgment—not the label “legal person”—determines the rights, duties, representatives, and available remedies.

Recognition by statute: Whanganui River, Aotearoa New Zealand
New Zealand Parliament passed the Te Awa Tupua (Whanganui River Claims Settlement) Bill in March 2017. The resulting Act confers legal personality on the river, described as an indivisible living whole extending from the mountains to the sea and encompassing physical and metaphysical elements. The arrangement arose in the context of the Whanganui iwi’s distinctive relationship with the river and a settlement; it is not a plug-in template detached from that history. New Zealand Parliament’s explanation of the Act describes a legal person as “an entity that has the same rights and responsibilities as a person.”
The Act provides for Te Pou Tupua, a two-person representative body: one person represents the Crown and one the Whanganui iwi. They act on the river’s behalf and protect its interests.

Recognition by court: Atrato River, Colombia
In 2016, Colombia’s Constitutional Court recognized the Atrato as a subject of rights. The model includes a commission of guardians with state and community representation, as summarized in the UK House of Commons Library’s comparative briefing on river rights.
Recognition by statute: Mar Menor, Spain
Spain’s law recognizes the Mar Menor and its basin as a subject with rights and establishes three entities to act on its behalf, according to a United Nations overview of rights of nature. That overview does not establish the bodies’ current powers, composition, or later implementation record, so those details should not be inferred from the recognition alone.
Who can enforce a river’s rights?
Enforcement depends on the governing law or judgment. A representative body may speak for the river, monitor decisions, or pursue a remedy. Public agencies may be responsible for preventing damage or carrying out required measures. Courts can interpret the rights and, where empowered, order government action. Community representatives can contribute local knowledge and accountability. The precise authority to sue, compel compliance, or control resources must be checked in the relevant instrument.

- Monitoring: Who collects evidence about the river’s condition and potential harm?
- Compliance: Which agencies or other parties have duties, and what must they do?
- Remedy: Which court or authority can respond to a breach, for example by ordering action or stopping an activity?
The Atrato shows why these roles and practical conditions matter. In an October 2024 report, the Associated Press described guardians working amid threats and limited institutional support. It also reported that Colombia’s human-rights ombudsman said there was no evidence of progress in protecting the river after the ruling. These reported concerns illustrate the distance that can remain between a rights declaration and effective implementation. Associated Press report, 10 October 2024.

What to examine in a river-rights proposal
Legal recognition is a framework, not proof that ecological conditions will improve. When comparing proposals or existing models, examine how the instrument works in practice:
- Legal foundation and scope: Is recognition created by statute, a constitutional judgment, or another instrument, and exactly which river, basin, or ecosystem does it cover?
- Rights and duties: What rights are stated, and which agencies or regulated parties must act to protect them?
- Representation: Who appoints and can remove guardians? How are Indigenous and local communities represented, and what knowledge and interests inform decisions?
- Access to remedies: Who has standing to bring a case, which body hears it, and what orders can it make?
- Capacity and accountability: Is there funding, technical support, safe working conditions, transparency, and a way to track ecological outcomes?
As Malene Karensdatter Brandshaug, a postdoctoral fellow at OsloMet, puts it: “It turns out that how the management of the river is organised and who can participate in decision-making processes are just as important as granting rights to the rivers.” OsloMet’s interview and research context.

What legal recognition does—and does not—settle
These examples come from distinct legal, political, and cultural settings. A river-rights proposal elsewhere must fit local constitutional law, standing rules, agency responsibilities, and available remedies. For a specific campaign or dispute, the current governing law and later court decisions are decisive; the examples here explain possible models, not legal advice.
