HIPAA does not categorically ban phone calls, faxes, email, texting, or mobile devices for communicating protected health information (PHI). Covered health care providers may share PHI for treatment without patient authorization, provided they use reasonable safeguards for the circumstances. For electronic PHI (ePHI), the Security Rule requires appropriate administrative, physical, and technical safeguards—not a particular brand of device or communication service.

This is U.S. federal HIPAA guidance. An organization’s policies, contracts, and applicable state law may add requirements.

Is it HIPAA compliant to email patient information?

Email can be used to communicate treatment-related PHI. HHS says providers may share PHI for treatment without patient authorization when they use reasonable safeguards. For ePHI, the organization must also assess risks and implement appropriate safeguards under the Security Rule. The cited guidance does not require one specific email product or establish that every message must use a particular encryption configuration.

Whether an email workflow is appropriate depends on how the organization protects the information and controls the process, including recipient accuracy and access to the account or system. A tool’s security features alone do not establish that the organization’s entire workflow meets its responsibilities.

Can a doctor leave a voicemail?

HIPAA does not categorically prohibit a provider from communicating by phone. HHS permits treatment-related disclosures with reasonable safeguards and advises, for example, lowering one’s voice when discussing PHI near other people. Applying that principle to voicemail means considering the recipient, the likelihood someone else will hear the message, and how much information the message needs to contain. The cited HHS guidance does not settle every voicemail scenario, so organizations should follow their policies and assess the specific workflow.

Can a provider fax medical records?

Yes. Fax may be used for permitted treatment communications, with safeguards to reduce the chance of disclosure to the wrong recipient. HHS says that when a number is not regularly used, a reasonable safeguard may be to confirm it first; frequently used numbers can be programmed to reduce misdirected faxes.

  • Confirm an unfamiliar fax number before sending.
  • Use established recipient records or programmed numbers for routine destinations.
  • Follow the organization’s workflow to limit access to documents and address misdirected faxes.

Can I text patient information?

The HHS sources cited here do not provide a blanket yes-or-no rule for every SMS or text-messaging workflow. The relevant question is whether the covered organization uses appropriate safeguards for ePHI and the particular communication. Consider the service provider’s role, safeguards for data on the device and in transit, access controls, incident handling, recipient accuracy, and the risk that a message may be seen by someone other than its intended recipient.

A consumer texting app should not be assumed suitable merely because it is convenient, and a “HIPAA compliant” label by itself does not show that a complete workflow is protected. Organizations should evaluate the service, their configuration, and the way staff use it.

Does HIPAA apply to my personal phone?

It depends on who handles the information and in what capacity. HIPAA generally does not protect information handled solely through personal-use apps, unless an app is provided by a covered entity or business associate. That distinction does not mean consumer health information is unprotected by every other law. Devices and carriers may also retain communications information, so a personal phone or app should not be treated as a private extension of a provider’s regulated system without checking how the service works.

For a covered provider or business associate using a mobile device to access cloud ePHI, HHS permits that approach when appropriate safeguards protect both the device and the cloud environment, and appropriate business associate agreements (BAAs) cover third parties that access the ePHI. The organization remains responsible for understanding and managing risks in its workflow.

What safeguards does HIPAA require for phones, email, and cloud services?

HHS describes the Security Rule as requiring “appropriate administrative, physical, and technical safeguards” to protect the confidentiality, integrity, and availability of ePHI. The rules are risk-based: they require safeguards suited to the organization and its circumstances rather than prescribing one communications technology.

  • Administrative: assess risks, establish appropriate processes, and manage access and incidents.
  • Physical: protect devices and the environments where ePHI can be accessed.
  • Technical: use appropriate protections for electronic information in the organization’s systems and workflows.
  • Communication-specific: reduce avoidable disclosure, such as confirming an unfamiliar fax number or speaking quietly when others are nearby.

When does a communications or cloud vendor need a BAA?

A company that handles PHI on behalf of a covered entity may be a business associate. A covered entity engaging a business associate generally needs a written contract or arrangement describing the work and requiring protection of PHI. A business associate generally must also obtain an appropriate agreement from a qualifying subcontractor before disclosing PHI for work performed on behalf of the covered entity.

For a cloud service provider that creates, receives, maintains, or transmits ePHI on behalf of a covered organization, HHS says a BAA is required. The customer must also understand the cloud environment, conduct its own risk analysis, and manage risks. A vendor’s willingness to sign a BAA is necessary in relevant cases, but it does not by itself establish that the customer’s configuration or complete workflow is compliant.

How to assess a phone, messaging, or cloud workflow

Before using a service for PHI, a regulated organization can work through these checks:

  1. Identify the service’s role. Determine whether the provider handles PHI on the organization’s behalf and whether a BAA is required.
  2. Review the full data path. Consider safeguards on devices, in transit, and in the hosted environment—not just the app or handset.
  3. Check organizational controls. Understand administrative access, incident handling, and the organization’s own risk-management responsibilities.
  4. Test the human workflow. Account for wrong recipients, overheard conversations, misdirected faxes, and unauthorized device access.

Is HIPAA’s proposed cybersecurity update already in force?

HHS’s Security Rule page lists a proposed cybersecurity update dated January 6, 2025. It is described as proposed, not as an already binding rule. Its status or effective dates should not be inferred from the proposal listing; consult HHS for current rulemaking information before relying on it.
