If you received a healthcare data breach notice, first verify who sent it and identify exactly what information the notice says was involved. Then follow the notice’s instructions and note its dates. Under HIPAA, affected people generally must be notified of a breach of unsecured protected health information (PHI) without unreasonable delay and no later than 60 days after the organization discovers it. That deadline is not the same as the deadline for an organization to report a breach to the government or for you to complain to the government.
What should I do after a healthcare data breach?
Use the notice as the starting point: it is supposed to explain the incident, the kinds of information involved, steps you can take to protect yourself, what the organization is doing, and how to contact it. If the letter is unclear, ask the named organization whether your information was involved and what specific records or data categories may have been affected.
Take these steps in order. They help you distinguish a genuine notice from an unrelated message, understand what is at stake, and decide whether you need to contact the organization or a regulator.

Clear out junk files and repair common Windows errorsFree Scan →Scan for outdated or missing drivers - takes under a minuteDriver Scan →Repair Windows errors before they cause bigger problemsFix Now →- Confirm the organization. Check that the notice identifies a provider, health plan, business associate, or other organization you recognize. Before sharing personal information or using contact details in a message you are unsure about, verify the organization’s contact information through a channel you can locate independently.
- Find out whether you were affected. If the notice is addressed to you, read it for a statement about your involvement. If it is general or unclear, contact the organization using verified contact information and ask whether your records were involved.
- Identify the data categories. Look for a description of the types of information involved, rather than assuming every breach exposed the same things. A notice may also say which records, systems, or time period were involved. The next steps depend on the information identified in your particular notice.
- Write down the dates. Separate the date the incident happened from the date the organization discovered it. HIPAA’s 60-day limit for notifying affected people is measured from discovery, not necessarily from the day the incident began. Keep the notice and note when you received it.
- Read the organization’s response and instructions. Check what it says about investigating the incident, mitigating harm, preventing another breach, and steps you should take. If a service is offered, review its eligibility, duration, enrollment deadline, included features, and any cost after a free period before deciding whether to enroll.
- Ask focused follow-up questions. If the notice leaves a material point unanswered, contact the organization and ask whether your information was involved, which data categories were affected, what dates or records were involved, and what protective steps apply to your situation.
Do not assume a credit freeze, password change, or paid monitoring service is appropriate for every healthcare breach. The information involved and the notice’s specific instructions matter. HHS requires covered entities’ notices to explain protective steps, but the federal guidance described here does not prescribe one universal patient checklist for every incident.

What should I check in a healthcare breach letter?
HHS’s Breach Notification Rule calls for individual notices to include, to the extent possible, several practical details. Use this list to assess whether you understand what happened and what the organization says you can do.
- Description of the breach: What incident does the organization describe? Does it say when the incident occurred or when it was discovered?
- Types of information involved: Which categories of information does the notice name? Do not infer that Social Security numbers, payment-card details, or any other particular category were exposed unless the notice says so.
- Steps for affected people: What does the organization say you should do to protect yourself from potential harm? If it offers monitoring or another service, what are its terms and deadlines?
- Investigation and mitigation: What does the organization say it is doing to investigate the breach and reduce harm?
- Prevention: Does the notice describe steps the organization is taking to prevent further breaches?
- Contact information: Is there a usable way to reach the organization with questions? Verify the contact channel independently if you are uncertain about the message.
A notice may not resolve every question about the incident. If it does not say whether your own information was involved, or leaves the relevant data categories unclear, ask the organization directly. Keep a copy of the notice and any response you receive so you can refer to the same details if you need to follow up.
Which deadline applies—and to whom?
There is no single “healthcare breach deadline.” The notification deadline for affected people, the organization’s reporting deadline to HHS, and your deadline to file a complaint are different clocks. The organization’s reporting schedule does not give a patient more time to complain.

| Notify affected individuals about a breach of unsecured PHI | Without unreasonable delay and no later than 60 days after discovery | The covered entity or, as applicable, its business associate |
| Report a breach affecting 500 or more individuals to the HHS Secretary | Without unreasonable delay and no later than 60 calendar days after discovery | The organization responsible for reporting |
| Report a breach affecting fewer than 500 individuals to the HHS Secretary | Within 60 days after the end of the calendar year in which the breach was discovered | The organization responsible for reporting |
| File a HIPAA complaint with HHS OCR | Generally within 180 days of when you knew of the alleged violation; OCR may extend the period for good cause | The person filing the complaint |
The first row concerns notice to people affected by a breach of unsecured PHI. The two HHS reporting rows concern the organization’s separate obligation to report to the Secretary. In particular, the annual reporting schedule for breaches affecting fewer than 500 people is not an extension of a patient’s complaint deadline.
How do I know if my medical information was exposed?
Start with the notice, not with assumptions about what a healthcare breach usually contains. The notice should describe the types of information involved to the extent possible, and it may provide further detail about affected records, systems, or dates. Those details determine what the organization says you should do and which questions remain unanswered.
If you received a message that does not clearly say whether you were affected, contact the organization named in it through a channel you can verify independently. Ask whether your information was involved and which data categories were affected. If the organization confirms your involvement, ask what protective steps apply and whether a service mentioned in the notice has an enrollment deadline or other conditions.

Be careful not to treat a large breach headline as proof that your own data was exposed. A reported incident may affect many people, but your status and the information involved depend on the organization’s notice or its response to your inquiry.

Not every business that holds health information is regulated by HIPAA. HHS OCR describes HIPAA-regulated organizations as including many healthcare providers, health plans, and clearinghouses, along with their business associates. By contrast, certain consumer health record vendors, related entities, and third-party service providers may be subject to the FTC’s Health Breach Notification Rule rather than HIPAA.
That distinction matters if the organization involved is a health app or another consumer service. Do not assume that a health app is covered by HIPAA simply because it stores sensitive health information, and do not assume that every breach involving health information follows the same regulator’s process. Identify which organization holds the data and determine which rules apply before choosing a complaint route. The HHS and FTC rules described here do not establish that every health app falls under one regulator; coverage depends on the organization and service.

How do I report a suspected HIPAA violation?
If you believe an organization regulated by HIPAA violated the rules, you may submit a complaint to the U.S. Department of Health and Human Services Office for Civil Rights (OCR). OCR also accepts complaints about suspected violations of Part 2. A complaint should describe what happened and name the organization involved. Review OCR’s current complaint instructions and filing window before submitting it.
A HIPAA complaint generally must be filed in writing within 180 days of when you knew of the alleged violation. OCR may extend that period for good cause. The limit is tied to when you knew of the alleged violation; it is not the organization’s breach-notification deadline and does not automatically begin on the date a breach occurred. Whether OCR’s rules apply depends on whether the organization is regulated by the relevant rules.
If the organization is a consumer health app or another business that may not be covered by HIPAA, first check which rules govern it. Certain consumer health record vendors and related entities may instead fall under the FTC Health Breach Notification Rule. A complaint to OCR is not a universal route for every business that holds health data.

Why do breach counts vary—and what do they mean?
Government figures can provide context, but they are not a prediction of what happened to any one patient. HHS OCR reported that approximately 190 million individuals were impacted by the Change Healthcare cybersecurity incident, based on information Change Healthcare provided to OCR on January 24, 2025. That is a dated figure tied to that incident, not a current total or a typical breach size.
HHS OCR’s annual report, published in 2026, says the HIPAA Breach Web Portal received 742 breach reports in calendar year 2024. This is a count of reports received, not a count of affected individuals. It should not be treated as a count of separate events without checking how the report defines its figures.
What if the notice offers credit or identity monitoring?
Evaluate the specific offer rather than treating monitoring as an automatic requirement. The notice may describe who is eligible, how long the service lasts, the deadline to enroll, what monitoring or recovery help is included, and whether it costs anything after a free period. Those are the details you need to judge the offer; a service’s presence in a notice does not by itself establish that every recipient needs a paid service.
Compare the offer with the information the notice says was involved and the protective steps it recommends. If an enrollment deadline is listed, take it into account while you review the terms. If the notice does not explain a feature or cost clearly, ask the organization before enrolling. Do not infer that a particular monitoring feature or remedy is included unless the offer says so.
Keep the next step tied to your notice
The useful questions are concrete: Was I affected? Which information was involved? When did the organization discover the incident? What does it say I should do, and how can I contact it through a verified channel? If you suspect a violation, is the organization covered by HIPAA or Part 2, and are you within OCR’s complaint window? Answering those questions from the notice and the organization’s response helps you choose a relevant next step without assuming that every breach calls for the same action.
