Before you sign a gym membership, check the full contract for its total cost, minimum term, renewal date, cancellation deadline and method, and any separately billed services. There is no universal U.S. three-day cancellation period for gym memberships: rights depend on your state, the agreement and how the membership was sold. Keep a copy of the signed contract and any written promises.
What to check in a gym membership contract
Read the complete agreement rather than relying on a salesperson’s summary. Work out what you will owe over the initial term, not just the advertised monthly rate. Look for:
- Payment frequency, enrollment fees, annual fees and other mandatory charges.
- The minimum term, the date it ends and any early-termination charge.
- Which facilities, locations, classes and other services are included.
- The renewal date, any notice deadline and the price after a promotional rate ends.
- The exact cancellation process and accepted cancellation methods.
Ask whether personal training, towel service or other amenities require separate agreements. Those may have their own recurring charges and cancellation terms. Get promises about promotions, freezes, transfers or cancellation in writing, and keep the exact contract you sign. North Carolina DOJ also advises consumers to understand the cancellation policy, included services and total cost, obtain a copy immediately, and consider whether a shorter-term contract would suit them better: North Carolina DOJ’s health-club guidance.
How to compare gyms before committing
Compare more than the monthly price. New York’s Attorney General recommends contacting or visiting at least two other clubs and considering price and payment timing, hours, classes and access to multiple locations. Those factors can help you judge whether the contract matches how you will actually use the gym: New York Attorney General’s health-club guidance.

Does every gym member get three days to cancel?
No. The reviewed state rules show why it is unsafe to assume a uniform cooling-off period. The examples below are state-specific summaries, not a determination of what applies to an individual contract.
| State | What the state guidance says |
|---|---|
| New York | The Attorney General’s summary says qualifying health-club contracts cannot exceed 36 months or $3,600 per year, with an exception for tennis and racquetball facilities. It describes a three-day cancellation right after signing, as well as cancellation grounds for certain events, including service cessation, moving 25 or more miles from any seller-operated club, and a significant qualifying disability. It also describes renewal cancellation windows and cancellation methods including website, email, telephone, mail or in person. These provisions apply to covered contracts. New York Attorney General. |
| Georgia | The Attorney General says covered contracts have a seven-business-day cancellation right. For a presale membership, the period runs after the gym is fully operational and available for use. Under the described statutory clause, a consumer may owe fair market value for services received, capped at $50. Georgia Attorney General Consumer Protection Division. |
| Connecticut | DCP says health-club contracts may last up to two years, and contracts longer than one year must also offer a one-year option. Its guidance describes limits on automatic renewal, a maximum one-month renewal period where an automatic-renewal clause is used, and written-acceptance and payment conditions for renewal options. Connecticut DCP. |
| North Carolina | The three-day right described by DOJ applies when a consumer pays before receiving all or part of the contracted services and the agreement is subject to the state’s prepaid entertainment contract law. It is not described as an unconditional right for every membership. North Carolina DOJ. |
Your state, contract language, payment and enrollment circumstances, whether the gym is open, and whether services have begun can all matter. Check your agreement and your state attorney general or consumer-protection agency for the rules that apply to your situation.

How to handle renewals and recurring charges
An automatic-renewal clause can mean billing continues unless you cancel in the way required by the agreement and applicable law. The FTC recommends reading renewal notices and checking the amount charged, particularly when an introductory price ends. Its consumer guidance also advises following the business’s cancellation instructions, keeping copies and conversation notes, checking statements afterward, disputing continued charges and saving related records: FTC guidance on auto-renewals and recurring subscriptions.
- Before signing: Note the initial term’s end date, renewal date, cancellation-notice deadline and post-promotion price. Check the core membership and each add-on separately.
- Keep your records: Save the full signed agreement and the terms of any promotion.
- When cancelling: Follow the contract and applicable state procedure. Send a dated request using a method that leaves a record, and keep a copy plus proof that it was submitted or delivered.
- After cancelling: Check your bank or card statements. If charges continue, contact the issuer to dispute them, follow up with the gym in writing and save the correspondence. The FTC and your state attorney general are possible reporting routes.
Replacing or blocking a payment card by itself does not necessarily end contractual obligations. Give cancellation notice under the applicable agreement and law, and separately dispute charges through your card issuer when appropriate.

What a recent FTC lawsuit does—and does not—show
On August 20, 2025, the FTC announced that it sued Fitness International, LLC and Fitness & Sports Clubs, LLC, operators of LA Fitness and other gym brands. The FTC alleged that the companies made it excessively difficult to cancel memberships and related recurring services, including through in-person or mail requirements, obstacles to obtaining forms, limited access to a particular employee and unclear written instructions. The agency also alleged that add-on services were not clearly disclosed as separately cancellable. The FTC sought injunctive relief and money back for harmed consumers. The complaint is an allegation; the FTC release says the case will be decided by the court, so it is not a finding of liability: FTC announcement of the lawsuit.
The case illustrates why it is worth checking cancellation terms and add-ons before joining. It does not establish the practices or contract terms of every gym.
