On the facts described in a 1 October 2026 report, the Bengaluru bench of the Goods and Services Tax Appellate Tribunal (GSTAT) denied Flora Kingdom Farm Resort input tax credit (ITC) on construction of its resort building. The reported reason: the building was constructed on the resort operator’s own account, even though it was used to provide taxable accommodation, restaurant and event services. The case is a warning that using a building to run a taxable business does not, by itself, take construction costs outside the blocked-credit rule in section 17(5)(d) of the CGST Act.
What the Bengaluru bench reportedly decided
JurisHour reported on 1 October 2026 that the appellant, Flora Kingdom Farm Resort, was a partnership firm operating at Mallar, Kaup, in Udupi district, Karnataka. Its reported activities included room accommodation, restaurant and catering services, and events such as weddings and photoshoots. The report identifies the case as APL/05/BUR/2026.
According to that account, the resort argued that parts of its premises were used for weddings, events and photoshoots. The tribunal reportedly found that the taxpayer remained in control and management of the premises while supplying hospitality and event services. The report says the resort did not produce a lease deed, licence agreement or invoice showing a separate arrangement to rent out the immovable property. On that account, the tribunal treated the building as constructed for the resort’s own business, not for another person’s use.

Why taxable business use did not settle the ITC question
Section 17(5)(d) of the CGST Act blocks credit for goods or services received for constructing immovable property, other than plant and machinery, on the taxable person’s own account. The clause expressly includes inputs used “in the course or furtherance of business.” In practical terms, operating a taxable hotel, restaurant or event business from a building does not alone make the building’s construction creditable.
The Act’s construction explanation includes reconstruction, renovation, additions, alterations and repairs to the extent the cost is capitalised. The statutory definition of plant and machinery also matters when classifying an asset. The CBIC-hosted Act text consulted for this wording is amended to 1 January 2022; the operative current statute and later amendments should be checked for a live claim.

The GST Council’s press release following its 55th meeting says the Council recommended replacing “plant or machinery” with “plant and machinery” retrospectively from 1 July 2017, so the phrase would be interpreted by reference to the Act’s existing explanation. The press release records a recommendation; it is not itself the amending legislation. The enacted text governs.

The reported distinction turns on what the customer receives and who controls the premises. A guest who stays at a resort generally receives accommodation supplied by the operator; that is not necessarily the same transaction as giving a tenant possession of property to use for its own purposes. Likewise, hosting a wedding or photoshoot at a venue may be part of an event or hospitality service rather than a letting of the immovable property. The label used in an invoice or marketing material is not enough on its own to determine the arrangement.

JurisHour reported that no lease deed, licence agreement or invoice for renting immovable property was produced in Flora Kingdom’s case. That reported absence was relevant to the tribunal’s analysis; it does not mean that producing a document alone would establish a different result. The contracts, conduct and actual allocation of control all matter. A different factual arrangement may require a different legal analysis.
The building and movable equipment need separate analysis
The reported ruling concerns ITC on construction of the resort building and civil structures. It should not be read as automatically blocking credit on every item bought for a resort. Section 17(5)(d) addresses specified inputs used for construction of immovable property, subject to the statutory plant-and-machinery wording and the other ITC conditions.

Furniture or equipment that is independently usable and remains movable may need to be analysed separately from a building or civil structure. Relevant questions include whether the item is actually part of the immovable property, how it is used, whether its cost is capitalised, and whether the other statutory requirements for credit are met. The report does not provide verified item-level findings for all such assets.

How a resort should assess a construction ITC claim
- Identify the claimed cost. Separate the building and civil works from furniture, equipment and other assets instead of treating all project expenditure as one category.
- Apply the statutory construction test. Check whether the goods or services were used to construct immovable property, whether the relevant cost was capitalised, and whether the plant-and-machinery wording applies.
- Map the customer transaction to actual conduct. Establish whether guests receive the resort’s accommodation or event service, or whether another party receives and exercises a right to use or possess the property.
- Review the evidence together. Compare contracts, licences, invoices, booking terms, operational control and actual use. A contract should reflect what happens in practice.
- Verify the law and order applicable to the claim. Use the current enacted CGST Act and the complete tribunal order, not a press release or secondary summary alone, before taking or defending a position.
For a particular resort, the result depends on the current statutory text, the character and use of each asset, capitalisation, contracts and actual control. The reported Flora Kingdom outcome is not a substitute for reviewing those facts.
