For a seafarer who is genuinely an employee, salary for work performed in the course of or in relation to that employment is outside GST in India: the CGST Act treats it as neither a supply of goods nor a supply of services. Working overseas does not, by itself, turn wages into an export of services. Contractor arrangements and Seamen’s Provident Fund coverage are separate questions that depend on the agreement and the applicable scheme.

Is GST applicable to a seafarer’s salary?

Generally, no—if the seafarer is an employee and the payment is for services in the course of or in relation to that employment. Schedule III of the Central Goods and Services Tax Act states: “Services by an employee to the employer in the course of or in relation to his employment” are neither a supply of goods nor a supply of services. Read Schedule III of the CGST Act.

The Central Board of Indirect Taxes and Customs (CBIC) gives the practical answer that “Salary will not be leviable of GST.” See the CBIC GST FAQ. The Ministry of Finance has also explained that employee services in relation to employment are outside GST, including discussion of contractual perquisites. Read the Ministry of Finance clarification.

This is an employment rule, not a blanket exclusion for all income earned by people who work at sea. The relationship and the nature of the payment matter.

Does overseas employment make seafarer wages an export?

No—not where the payment is salary for an employment relationship. The employment exclusion applies before asking whether a service is an export. The ship’s location, the seafarer’s work location, or the fact that an employer is abroad does not automatically convert wages into an exported service.

CBIC describes exports as zero-rated and notes that registration is required to claim refunds under the export framework. That framework concerns supplies; it does not make employee salary a supply. CBIC GST FAQ.

If the seafarer instead provides services independently, export and place-of-supply rules may become relevant. The answer then depends on facts such as supplier and recipient locations and the contract. The IGST Act addresses place of supply and distinguishes intra-State transactions using supplier location and place of supply; those rules do not displace the employee exclusion. Read the IGST Act.

Employee or independent contractor: why the distinction matters

A contract’s label—“salary,” “consultant,” or “contractor”—does not settle the GST question on its own. The key issue is whether the seafarer is genuinely employed or provides services independently. The general employee rule does not establish a universal GST result for every contractor arrangement involving a seafarer.

Arrangement GST starting point What still needs review
Employee providing services in the course of or in relation to employment Not a supply under CGST Act Schedule III; salary is not leviable to GST under CBIC’s FAQ. Confirm the actual employment relationship and that the payment is employment remuneration.
Independent service provider The employee exclusion may not apply. Classify the service and assess applicable supply, place-of-supply, export, and registration rules on the facts.

For an individual assessment, examine who employs the seafarer, who receives the work, how remuneration is determined, and what the agreement actually requires. An intermediary’s involvement may also be relevant, but it does not by itself establish whether the seafarer is an employee or contractor.

Seamen’s Provident Fund is a separate issue from GST

The Seamen’s Provident Fund (SPF) is a statutory social-security scheme, not a GST rule about salary. The Directorate General of Maritime Administration lists the Seamen’s Provident Fund Act, 1966 and the Seamen’s Provident Fund Scheme, 1966. See the DGMA acts and rules listing.

The Seamen’s Provident Fund Organisation describes the scheme as contributory, with employer contributions and matching contributions, and explains trustee administration. See the SPFO information. The Directorate General of Shipping describes SPFO’s role in collecting seafarer contributions from shipping companies and managing and distributing fund benefits under applicable rules. See DGS maritime labour information.

Those general descriptions do not establish that every seafarer working overseas is covered, or what contribution terms apply to a particular person. Do not assume a universal current contribution percentage from an overview page. Confirm the worker’s category, actual employer and employment circumstances, and the current scheme provisions. Maritime materials also identify ship flag, employer identity, and recruiting or placement arrangements as relevant context; proposals or meeting discussions are not binding universal coverage rules. DGS maritime labour information.

What to check before deciding an individual case

Gather the documents and facts that establish both the work relationship and any provident-fund coverage:

  • The seafarer employment agreement and any amendments.
  • The legal identity and location of the employer, shipowner, payroll payer, and any recruiting or placement intermediary.
  • Whether the agreement and actual working relationship create employment or independent service provision.
  • The vessel’s flag and relevant engagement details.
  • The specific provident-fund scheme or fund covering the seafarer, and the current provisions governing contributions.
  • Whether the question concerns GST, income tax, withholding, or provident-fund eligibility; these are distinct issues.

For an employee, the general GST answer is clear: salary is outside GST. A contractor’s GST treatment and an individual’s fund eligibility require review of the facts and current applicable rules.
