An NBFC’s customer being a bank does not by itself decide whether GST registration is required, what rate applies, or whether tax is payable under reverse charge. For a taxable service supplied by a covered financial institution, including an NBFC, the general invoice deadline is 45 days from the date of supply. CBIC also permits a compliant consolidated monthly statement, invoice or advice. The actual tax treatment depends on the service and transaction facts. This guide covers India’s rules as of 7 October 2026.
Does an NBFC have to charge GST when it invoices a bank?
Not automatically in every case. First identify what the NBFC supplied and what the amount invoiced represents. Under the CBIC GST Sectoral FAQs, consideration represented by interest or discount for extending loans, advances or deposits is distinguished from additional charges: amounts collected over and above that interest or discount, such as service, administrative or entry charges, are taxable consideration according to the FAQ.
That distinction does not establish a universal rate or decide every fee’s treatment. A processing, documentation or similar charge should not be treated as exempt merely because it relates to lending. Check the contract and the current exemption and rate notifications against the actual service.
| Amount being charged | What the available rule or guidance establishes | What to check for the transaction |
|---|---|---|
| Interest or discount for extending loans, advances or deposits | The CBIC Sectoral FAQs distinguish this consideration from separate additional charges. | Confirm that the amount is genuinely interest or discount for the stated financial supply and that the relevant exemption applies. |
| Separate service, administrative, entry, processing or documentation fee | The CBIC Sectoral FAQs treat charges over and above interest or discount as taxable consideration. | Classify the service and verify the applicable exemption, rate, place-of-supply and reverse-charge provisions. |
For a registered supplier, section 31 of the Central Goods and Services Tax Act, 2017 (CGST Act) provides for a tax invoice for a taxable supply and a bill of supply for an exempt supply. The document should match the supply’s tax character; a monthly billing arrangement does not turn a taxable fee into exempt interest.

Does an NBFC need GST registration just because its customer is a bank?
No registration conclusion follows from the customer’s identity alone. The invoice rules for a registered financial institution do not, by themselves, establish whether a particular NBFC must register.
Before issuing a GST document, establish which GST registration, if any, is the supplier for the transaction. The registration analysis requires the applicable current provisions and facts such as the NBFC’s aggregate turnover, legal entity and places of business, the locations from which it supplies the service, and whether inter-State supplies or another compulsory-registration rule applies. Do not assume that being an NBFC either automatically requires registration or removes the need to check it.
How long does an NBFC have to issue an invoice?
Under CGST Rule 47, an insurer, banking company or financial institution, including an NBFC within the covered class, generally has 45 days from the date of supply of the service to issue the invoice or a document in lieu of it. This is the special period for the covered class, rather than the ordinary 30-day period for service invoices.
There is a separate timing provision for certain taxable supplies between distinct persons under section 25 of the CGST Act or Schedule I. In the circumstances covered by Rule 47, the document may be issued before or when the supply is recorded in the supplier’s books, or before the end of the quarter in which the supply was made. Confirm that the transaction falls within that provision before using it; it is not a general extension for all invoices.
Can an NBFC issue one consolidated monthly GST invoice?
Yes. CBIC’s GST Sectoral FAQs say a covered financial institution may issue a consolidated statement, invoice or advice at month-end covering the month’s charges and GST. This can be used instead of issuing a separate document for each charge, provided the monthly document meets the applicable requirements.
Under Rule 54(2), as explained in those FAQs, the covered institution’s invoice or document in lieu need not be serially numbered and need not state the recipient’s address. It must still have an identification number and the other applicable particulars. The identification number need not form part of a serial sequence. Report the document details with the recipient’s GSTIN, as applicable, so the recipient can match the supply for input tax credit purposes. Consolidation is not permission to omit required tax details or reporting.
When could reverse charge or self-invoicing apply?
There is no general reverse-charge rule for every service an NBFC provides to a bank. The treatment depends on the exact service, who supplies and receives it, their locations, and whether a current notification specifies reverse charge for that category.

For example, the CBIC materials refer to reverse charge on a recovery agent’s service to an NBFC. That example does not establish that an NBFC’s service to a bank is subject to reverse charge. In specified reverse-charge cases, section 31 also places self-invoicing and payment-voucher duties on the registered recipient. Identify the applicable notification entry and the supplier-recipient roles before deciding who accounts for GST or issues the relevant document.

Can an NBFC use the 50% input tax credit method?
CGST Rule 38 provides an optional section 17(4) method for an eligible banking company or financial institution, including an NBFC engaged in accepting deposits or extending loans or advances. Under this method, the institution excludes input tax attributable to non-business use and blocked credits under section 17(5), allows the specified credits, and takes 50% of the remaining input tax.
This is a conditional option, not an automatic credit rule for every entity described as an NBFC. Eligibility depends on the entity’s activities and the rule’s requirements; the financial effect also depends on its input-tax profile. Compare the option with the otherwise applicable credit treatment before electing it.
What does the 2025 CBIC circular say about penal charges?
CBIC Circular No. 245/02/2025-GST, dated 28 January 2025, addresses GST applicability to penal charges levied by regulated entities, including NBFCs, in connection with RBI instructions to discontinue penal interest for non-compliance with loan terms. The circular states that those instructions took effect on 1 January 2024. Its stated scope does not cover credit cards, external commercial borrowings, trade credits or structured obligations covered by product-specific directions.

Do not apply that clarification to every fee or penalty an NBFC may levy. Check the full circular and the relevant RBI direction for the product and charge in question before deciding its GST treatment.
Transaction checklist before issuing the document
- Confirm the supplier and registration. Identify the NBFC legal entity and GST registration making the supply; assess registration under the applicable provisions rather than relying on the fact that the recipient is a bank.
- Describe the supply and amount. Separate interest or discount from additional service charges, and classify each charge under the contract and applicable notifications.
- Check who pays GST. Verify the supplier, recipient, locations and any specific reverse-charge entry; do not assume forward charge or reverse charge from the parties’ labels alone.
- Choose the correct document. For a taxable supply, use the required tax invoice; for an exempt supply, use a bill of supply. If using a consolidated monthly document, retain the required particulars and identification number.
- Meet the applicable deadline and reporting rules. Apply Rule 47’s general 45-day period for the covered financial institution, check the distinct-person timing provision only where it applies, and report the recipient GSTIN and document details as applicable.
- Assess input tax credit separately. Determine whether the NBFC meets Rule 38’s conditions before considering the section 17(4) method.
The principal authorities for these checks are the CBIC CGST Rules (Rules 38, 47 and 54), the CGST Act (sections 17, 25 and 31), CBIC’s GST Sectoral FAQs, the relevant Central Tax (Rate) notifications, and Circular No. 245/02/2025-GST.
