In India, input tax credit (ITC) is eligible GST on business purchases that a registered person records in the electronic credit ledger and ordinarily uses to offset GST payable. A GST refund is a separate claim for money back under a qualifying legal provision. An unused ITC balance does not, by itself, entitle a business to a cash refund.
GST rules differ by country. This guide covers India’s central GST framework under the CGST Act, 2017; state and Union Territory rules, notifications, and the tax period involved can also affect an actual claim.
ITC and a refund are different claims
| Question | Input tax credit (ITC) | GST refund |
|---|---|---|
| What is it? | Eligible input tax credited to a registered person’s electronic credit ledger under the GST rules. | An amount returned to an eligible applicant under a specific refund ground. |
| What does it usually do? | Offsets GST payable, subject to the rules governing use of the credit ledger. | May result in a payment back after a qualifying claim is filed and processed. |
| What must the business establish? | That the purchase and tax meet the Act’s ITC conditions and are not barred by a restriction. | That the business qualifies under the claimed refund category, meets its documentation requirements, and applies within the applicable time limit. |
| How is it claimed? | Through the prescribed return and electronic credit-ledger mechanism. | Generally through electronic FORM GST RFD-01 with category-specific evidence; a cash-ledger balance has a return-based route under the rules. |
The distinction matters when a business has more eligible credit than it can currently use: that may leave credit in the ledger, but the business still needs a statutory basis to seek cash.
When can a business claim ITC?
Start with the purchase and business use
Section 16(1) of the CGST Act sets the baseline: a registered person may take credit of input tax on goods or services used or intended for use in the course or furtherance of business, subject to the Act’s conditions, restrictions, and prescribed manner. The credit is recorded in that person’s electronic credit ledger.

This is not a blanket credit for every purchase on which GST appears. A business should check the statutory requirements for the particular supply and whether a blocked-credit rule or other restriction applies. Section 16(1), as reproduced by CBIC, states that the entitlement is subject to conditions and restrictions and that the amount is credited to the electronic credit ledger.
Use the credit through the GST mechanism
ITC is ordinarily used against GST payable under the applicable payment rules; it is not automatically paid out to the business. To assess an invoice, reconcile the purchase records and eligible tax with the returns and electronic ledger, then confirm that the credit was claimed in the prescribed manner and within the relevant time limit.

When can unused ITC be refunded?
Section 54(3) of the CGST Act allows refund of unutilized ITC only in specified circumstances. The principal grounds described in the Act and CBIC materials are:
Recommended Free Tools
- Qualifying zero-rated supplies made without payment of tax. The supply route and applicable conditions matter. An export does not automatically produce a refund simply because it is an export.
- Qualifying accumulation under an inverted rate structure. This is where the applicable input tax rate exceeds the output tax rate, subject to the statutory conditions and exceptions.
CBIC identifies a restriction for exports of goods on which export duty is payable. The precise result depends on the transaction, supply type, tax-payment route, applicable rules, and current notifications. Do not treat a positive ledger balance—or the fact that input tax exceeds output tax—as sufficient grounds for cash repayment.

Other refund grounds are separate
Unused ITC is only one kind of refund claim. Section 54 and the refund rules cover other grounds, including certain cases of excess tax paid and statutory refunds. Each category has its own eligibility test, evidence, and relevant date. A business should identify the correct legal ground before preparing an application rather than filing an unused-credit claim merely because a balance remains in its ledger.
Deadlines: ITC has a different clock from a refund
ITC availment deadline
CBIC’s Sectoral FAQs describe the section 16(4) cut-off as the due date for furnishing the return for September following the relevant financial year, or the annual return, whichever is earlier. This is an ITC-availment rule, not the general refund-application limit. Amendments may affect the applicable period, so verify the version of the Act and rules that applies to the financial year and claim.

Refund application deadline
The general rule in section 54(1) is to apply before the expiry of two years from the legally defined “relevant date.” That date depends on the refund category; it is not a universal two-year period counted from the purchase invoice. Check the definition that applies to the specific ground and the relevant tax period before calculating the last filing date.
How to prepare a refund claim
- Identify the claim ground. Determine whether the claim concerns eligible unutilized ITC, another statutory refund category, or a cash-ledger balance. The category controls eligibility, evidence, and the relevant date.
- Reconcile the records. Match purchase invoices and eligible credits against returns, ledger balances, output liability, and the amount proposed for refund. Resolve discrepancies before filing.
- Check the time limit and current rules. Apply the relevant-date definition for the chosen ground and confirm current Act provisions, refund rules, and notifications for the period.
- File through the prescribed route. The Refund Rules generally provide for electronic FORM GST RFD-01 through the common portal, with supporting material required for the claim category. A refund of a cash-ledger balance may be claimed through the relevant return.
- Support an unutilized-ITC claim as required. The rules specify evidence for the relevant refund categories and provide for debit of the credit ledger for the amount claimed. Confirm the requirements for the category rather than assuming one document set fits every case.
CBIC’s official CGST Act, Refund Rules, and Sectoral FAQs are useful starting points for checking the governing provisions. Because amendments and notifications may postdate a consolidated reference, confirm the rules that apply to the particular claim before filing.

A practical decision check
- If the business has eligible GST on business purchases and GST payable, assess whether that credit can be taken and used under the ITC rules.
- If credit remains unused, check whether the circumstances fit a section 54(3) ground; do not infer a cash entitlement from the ledger balance alone.
- If seeking another kind of repayment, identify that refund category and apply its separate evidence and timing rules.
- Before filing, reconcile invoices, returns, the electronic ledgers, liabilities, refund amount, and claim documents for the relevant period.
