GST refunds in India depend on why the amount is refundable. Export claims may concern IGST paid or eligible unutilised input tax credit (ITC); an inverted-duty claim concerns eligible ITC accumulated because input tax rates exceed the rate on relevant output supplies; and excess cash in the electronic cash ledger is different from tax paid in excess. Identifying the correct ground determines the calculation, evidence, filing route and deadline.
Which GST refund applies to your situation?
| Refund ground | What is being refunded | Why it arises | How the amount is determined |
|---|---|---|---|
| Export | Eligible unutilised ITC or IGST paid, depending on the route chosen | Export of goods or services under the applicable zero-rated supply provisions | Eligible credit under the no-IGST route, or IGST paid under the payment route, subject to legal conditions |
| Inverted duty structure | Eligible unutilised ITC | Input tax rates exceed the rate on relevant output supplies, subject to statutory exclusions | Rule 89(5) formula, using turnover, Net ITC and tax payable |
| Excess balance in electronic cash ledger | Unused cash-ledger balance | Cash remains after tax and other dues are discharged; it may include unutilised TDS/TCS credits | Qualifying balance in the ledger |
| Excess payment of tax | Tax paid in excess | A tax payment exceeded the amount due; this is a separate refund ground from unused ledger cash | Applicable payment and refund provisions, based on the taxpayer’s facts |
These categories are not interchangeable. In particular, a cash-ledger balance is money still recorded as unused, while an excess-tax claim concerns tax already paid. CBIC lists the two as separate grounds in Circular 135/05/2020-GST.
How export GST refunds work
CBIC guidance describes two alternative routes for eligible exports. An exporter may export without payment of IGST under a bond or Letter of Undertaking (LUT) and claim eligible unutilised ITC, or pay IGST and claim a refund of the IGST paid. The routes are subject to applicable declarations, statutory conditions and restrictions; they do not allow the same supply to obtain both refunds. See the CGST Act and CGST Rules.

When an inverted-duty refund may apply
An inverted-duty refund addresses eligible ITC accumulated when the tax rate on inputs is higher than the rate on the relevant output supply. It is not a general refund of all input costs. Statutory exclusions apply, so confirm that the output supply qualifies before treating accumulated credit as refundable. The relevant provisions appear in Rule 89(5) of the CGST Rules.
Rule 89(5) calculation
The rule states: “Maximum Refund Amount = { (Turnover of inverted rated supply of goodsand services) x Net ITC ÷ Adjusted Total Turnover } – tax payable on such inverted rated supply of goods and services.” Net ITC has a specific rule-defined meaning for this calculation. The formula therefore uses qualifying turnover, qualifying credit and tax payable; it is not simply the total input tax credit accumulated during a period.

This refund ground concerns money left in the electronic cash ledger after applicable tax and other dues have been discharged. CBIC Circular 166/22/2021-GST clarifies that unutilised TDS/TCS credits in that ledger may be refunded as excess balance; a registered person is not required to use those amounts only to pay tax liability. The circular states: “Any amount, which remains unutilized in electronic cash ledger, after discharge of tax dues and other dues payable under CGST Act and rules made thereunder, can be refunded to the registered person as excess balance in electronic cash ledger in accordance with the proviso to sub-section (1) of section 54, read with sub-section (6) of section 49 of CGST Act.” See CBIC Circular 166/22/2021-GST.

How an excess-tax-payment claim differs
An excess-tax-payment claim is about tax paid in excess, not cash remaining unused in the electronic cash ledger. CBIC Circular 135/05/2020-GST treats it as a distinct refund category and discusses the procedure for tax paid other than on zero-rated supplies. The treatment may depend on whether payment was made using cash or credit and on the facts of the case. Check the current amended rules and the taxpayer’s payment records before determining the accounting treatment or amount claimed.

How to file and what evidence to prepare
Refund claims are generally filed electronically in FORM GST RFD-01. A qualifying excess cash-ledger claim may instead use the return-based route described in the Refund Rules. The governing provisions and procedures are in the CGST Rules.
Match supporting records to the refund ground. GST record-keeping requirements are set out in the CGST Act. Depending on the claim, relevant records may include export and shipping evidence, invoices, tax-payment details, cash-ledger entries, or ITC and turnover records. Check the live portal checklist and current requirements for the selected ground before filing; documentary requirements and procedures can depend on the claim circumstances.

Understand the deadline before calculating it
Section 54 provides a general two-year period for applying for a refund, counted from the relevant date. The relevant date is category-specific, so there is no single trigger date that applies to every export, inverted-duty, ledger-balance or excess-tax claim. Confirm the definition that applies to the particular refund ground in section 54 of the CGST Act before relying on a deadline.
Quick Recap
A practical check before you claim
- Identify whether the claim concerns export IGST, eligible unutilised ITC, unused cash-ledger balance or tax paid in excess.
- Check the statutory eligibility conditions and exclusions for that ground.
- Reconcile the amount to the relevant export, tax-payment, ledger or ITC records.
- Confirm the applicable filing route, current document checklist and category-specific relevant date.
