First identify whether the communication is a show-cause notice, an order, an appeal-related message, or a recovery intimation. Then note its legal section, tax period, service date and stated deadline; reconcile the allegations against your records; and respond through the route specified in the communication. A notice is not automatically a final demand, and a deadline for appealing an order is not the deadline for replying to a notice.
What should you do first after receiving a GST notice?
Preserve the complete communication before responding. Save the notice and attachments, the portal download, any email or SMS notification, and the electronic service record or envelope where available. Record when and how it was communicated; service date may matter to a deadline.
- Identify the document and stage. Check whether it is a show-cause notice, a summary accompanying a notice, an adjudication order, an appeal communication, or a recovery intimation. Do not treat a portal summary as a substitute for the full notice, order, or attachments.
- Record the key particulars. Note the taxpayer name and GSTIN, issuing authority, notice or order number, tax period, statutory section, allegations, requested action, response or hearing date, and any stated amount split among tax, interest, and penalty.
- Check the official portal. Sign in to the GST Portal and review the relevant notices, orders, and application records. Check the communication itself against portal records and current portal instructions.
- Reconcile each allegation. Compare the period and issue raised with filed returns, invoices, purchase and sales ledgers, payment challans, credit notes, contracts, and relevant e-way bill or e-invoice records. Prepare a period-wise calculation, distinguishing facts you accept from those you dispute.
- Prepare a point-by-point reply. Address allegations in order, explain the factual and legal basis for each position, identify supporting documents, show calculations where relevant, and state what relief you seek. Do not alter source records or rely on unsupported assertions.
- Submit and retain proof. Use the form and route specified for that communication. Save a copy of the submitted reply and attachments, and verify the acknowledgment or reference number.
- Calendar the next event. Track any hearing, further-information request, order, payment step, or appeal deadline. Confirm the applicable provision and current portal instructions rather than applying a generic deadline to every GST communication.
This is a practical checklist, not a statutory sequence that applies identically to every notice. The actual document and applicable law control.
How can you tell a notice from a demand order or recovery intimation?
The form number can help identify a communication’s function, but it does not replace reading the complete document. The GST Portal’s published forms list distinguishes these common demand-proceeding forms:

| Form | Published function | What it means for the taxpayer |
|---|---|---|
| DRC-01 | Summary of a show-cause notice; the listed form is prepared for tax officials. | Read the underlying notice and attachments to understand the allegations and response required. |
| DRC-03 | Taxpayer intimation of a payment made voluntarily or against a show-cause notice or statement. | It records a payment intimation; it is not itself a reply to a show-cause notice. |
| DRC-04 | Official acknowledgment of voluntary payment. | It is an acknowledgment, not the taxpayer’s notice reply. |
| DRC-05 | Intimation concluding proceedings. | Check the communication to determine which proceedings it concludes. |
| DRC-06 | Taxpayer reply to a show-cause notice. | This is the reply form identified in the published list; follow the current route and instructions applicable to your case. |
| DRC-07 | Summary of an order. | Distinguish it from the show-cause stage and review the order and any appeal information. |
These descriptions come from the GST Portal’s forms list, published in 2019. Form functionality or portal procedures may change, so verify the current instructions and rely on the operative notice or order. GST Portal forms list
What is different about DRC-01D?
A DRC-01D recovery intimation is not an ordinary show-cause notice. A GST Portal functionality publication for April–June 2024 says its described functionality does not allow the taxpayer to submit a reply through that route because the communication is an intimation for initiating recovery. It says the specified amount is to be paid within seven days from issue, failing which recovery may be initiated. If you receive one, inspect the underlying order and demand promptly; if you dispute the liability, seek case-specific professional guidance rather than assuming that a show-cause reply route is available. How do sections 73 and 74 affect a GST notice?
The cited CBIC-hosted CGST Act text describes section 73 as addressing specified unpaid or short-paid tax, erroneous refunds, or input tax credit wrongly availed or used for reasons other than fraud, wilful misstatement, or suppression to evade tax. It describes section 74 as addressing corresponding issues where the stated reason involves fraud, wilful misstatement, or suppression to evade tax. The allegation matters: read the provision and the facts asserted in the actual notice rather than inferring the case from the amount alone. CBIC-hosted CGST Act text
Do not use that older text by itself to calculate a current penalty or deadline. Section 74A has been introduced, and the GST Portal appeal FAQ lists section 74A assessment demand orders. The applicable provision, transitional scope, timelines, penalty rules, and payment options depend on the law and notifications applicable to the financial year and case. The cited materials do not establish the current section 74A notice timelines, payment concessions, or penalty amounts; verify those details against current legislation, commencement notifications, and portal guidance before acting. Do you have to pay a penalty before replying?
Do not assume that a disputed amount must always be paid before you can reply to a show-cause notice. A notice reply and a later appeal against an order are different procedural stages; the cited appeal pre-deposit requirement applies to an appeal, not automatically to a notice response. Equally, do not assume that replying removes an amount shown as due or resolves a payment question. Read the demand, identify whether any amount is admitted or disputed, and verify the payment route and legal consequences for the relevant provision and financial year before deciding whether to pay.
The GST Portal’s published form list identifies DRC-03 as a taxpayer intimation of payment made voluntarily or against a show-cause notice or statement, with DRC-04 as an official acknowledgment and DRC-05 as an intimation concluding proceedings. These labels help distinguish payment-related records from a reply; they do not establish which payment choice is best in an individual case.

What is the difference between replying to a notice and appealing an order?
A reply addresses allegations before the adjudicating authority determines the demand. An appeal is a later challenge to an order; the GST Portal FAQ says an order must have been passed before an appeal is filed. Do not use the appeal period as the reply period: the deadline for answering a notice is governed by that communication and the applicable legal provision.

For an appeal from an adjudicating authority’s decision, the GST Portal FAQ states the usual filing period is three months from communication of the decision. It says the appellate authority may condone up to one further month where sufficient cause prevented timely filing. The FAQ also describes a minimum pre-deposit of 10% of the disputed tax before filing an appeal. These are procedural thresholds stated by the Portal; confirm the current requirements and case-specific calculation before relying on them. GST Portal appeal FAQ

The same FAQ describes electronic filing in APL-01, submission by DSC or EVC, and DSC as mandatory for companies and LLPs under the instructions on that page. It says a self-certified copy may need to be submitted within seven days where the order is not uploaded, and describes final acknowledgment APL-02 with an appeal number as the point at which the appeal is considered filed in that circumstance. These portal procedures can change; check the current instructions and the requirements for your case.
Filing an appeal does not erase the demand. The FAQ says that when an appeal is admitted, the GST Portal flags the balance disputed amount as non-recoverable. That statement should not be read as a general waiver of liability; confirm the status of your case and any undisputed amount with the applicable order and current procedure.
When should you seek professional help?
Consult an experienced GST practitioner, chartered accountant, or tax lawyer promptly when the consequences or legal issues are substantial. Useful escalation triggers include:
- The notice alleges fraud, wilful misstatement, or suppression.
- The amount could materially affect the business, or the notice spans multiple periods, GSTINs, or entities.
- The dispute involves input tax credit eligibility, supplier compliance, classification, place of supply, valuation, or difficult reconciliations.
- Records conflict, there are prior notices, an investigation or summons is involved, or possible personal or officer liability arises.
- A recovery communication has arrived, a hearing is imminent, or an adverse order has been passed.
- You need to assess an appeal deadline, pre-deposit, limitation issue, or section 74A transition question.
These are prudent triage signs, not an official exhaustive list or a guarantee that retaining a professional will change the legal result. For a straightforward factual discrepancy, organized records and a careful response may be manageable; uncertainty about the statutory basis, a high-stakes allegation, or a short procedural deadline makes early advice more important.
