GST demand is the principal tax amount said to be unpaid, short paid, erroneously refunded, or connected with wrongly availed or utilised input tax credit (ITC). Interest is a time-based charge for keeping that tax unpaid (or for specified excess ITC or reductions). A penalty is a statutory sanction that depends on the conduct alleged and the section used in the notice or order. They are separate amounts and can appear together.
Before paying, identify the tax period, tax head, principal tax, cited section, interest calculation and deadline. The difference between a section 73 and section 74 proceeding can change the penalty from zero to an amount potentially equal to the tax.
What each amount means
A demand is not automatically a penalty. Read the notice or order as three possible components:
| Amount | Legal nature | What triggers it | What to verify |
|---|---|---|---|
| Tax demand | Principal GST assessed as unpaid, short paid, erroneously refunded, or linked to wrong ITC | An officer’s determination or your self-ascertainment | Tax period, CGST/SGST/IGST or cess head, grounds, and principal amount |
| Interest | Time-based charge (and, in specified cases, a charge on excess ITC or excess reduction of output liability) | Tax remains unpaid after its due date, or a specified excess credit/liability reduction applies | Original due date, start date, notified rate for the period, and day count |
| Penalty | Statutory sanction for a specified default or culpable conduct | The section and procedural stage cited in the notice or order | Whether the case is under section 73, 74, 76, or another penalty provision; available payment window |
The same order may therefore show principal tax, interest up to a stated date and a penalty. Paying only the principal does not necessarily discharge the other two.

How GST interest is calculated
When interest starts
Section 50(1) applies when a person liable to pay tax fails to pay it within the prescribed period. Interest runs from the day succeeding the due date for the period the tax remains unpaid. The Act sets a ceiling of 18% for delayed tax; the Government notifies the operative rate for the relevant period. Use that notified rate rather than assuming the ceiling is the rate charged.
For undue or excess ITC claims, or undue or excess reductions in output tax liability, the Act sets a ceiling of 24%. The applicable rule, notification and facts determine whether this category applies and what rate is used.
The statutory wording is: “Every person who is liable to pay tax in accordance with the provisions of this Act or the rules made thereunder, but fails to pay the tax or any part thereof to the Government within the period prescribed, shall for the period for which the tax or any part thereof remains unpaid, pay, on his own, interest at such rate, not exceeding eighteen per cent., as may be notified by the Government on the recommendations of the Council.”

A practical interest check
- Write down the original statutory due date for the return or payment.
- Identify the day after that due date as the potential start date, unless a specific rule or order changes the calculation.
- Determine the principal tax that was actually unpaid for each tax head and period.
- Apply the notified rate applicable to that period, not merely the 18% or 24% ceiling.
- Count the days through the date of payment or the date used in the order, and retain the working papers.
For an illustration only, if ₹100,000 remained unpaid for 60 days and the applicable notified annual rate were 18%, simple interest would be ₹2,959 (₹100,000 × 18% × 60/365). The example is not a statement of the rate for any particular period; your notice and the applicable notification control.

Section 73 or section 74: the decision that changes the penalty
Section 73 — reasons other than fraud
Section 73 covers tax not paid, short paid, erroneously refunded, or wrongly availed or utilised ITC for reasons other than fraud, wilful misstatement or suppression of facts to evade tax. A demand under this route can still include interest, but the Act provides payment opportunities that can eliminate the penalty.
Section 74 — fraud, wilful misstatement or suppression alleged
Section 74 is used where the notice alleges fraud, wilful misstatement or suppression of facts to evade tax. It carries a much heavier potential sanction and shorter, strategically important settlement windows. Do not treat a section 74 notice as an ordinary late-payment reminder; the allegation and evidence require a careful response.
| Stage | Section 73 consequence | Section 74 consequence |
|---|---|---|
| Before notice | Pay tax plus applicable interest. Payment before service of notice prevents a notice for the amount paid, subject to the statutory conditions. | Pay tax, interest and a penalty equal to 15% of the tax. The cited Act and CBIC FAQ describe this as the reduced pre-notice settlement. |
| Within 30 days after notice | Pay tax plus interest. No penalty is payable and proceedings for that notice are concluded when the statutory conditions are met. | Pay tax, interest and a penalty equal to 25% of the tax within 30 days of notice. |
| After adjudication, within 30 days of communication of order | The section 73 text provides a penalty of 10% of tax or ₹10,000, whichever is higher, subject to its conditions. | Pay tax, interest and a penalty equal to 50% of the tax within 30 days of communication of the order. |
The percentages in the table are statutory settlement formulas described in the cited Central Goods and Services Tax Act and CBIC material. The notice or order, the date of service or communication, and any later amendment determine whether a window is open.
What “pay quickly” really means
Quick payment can avoid or reduce a penalty only when it is made under the correct statutory window and includes every required component. A payment of principal tax alone, a payment after the deadline, or a payment posted against the wrong period may not secure the intended relief. Save proof of the debit, the form filed, and the resulting liability-register entry.

Section 76: GST collected from someone else but not remitted
Section 76 is a separate route for money collected from another person as GST but not paid to the Government. The collected amount must be paid to the Government, and the provision permits a penalty equivalent to that amount. This is different from an ordinary classification or return error under section 73: the key fact is collection from another person and non-remittance.
Reconcile invoices, receipts, bank records and the electronic liability register before responding. If the amount was collected, do not assume that reversing an invoice or paying only interest resolves the section 76 exposure.
Which DRC form is used at each stage?
| Form | Purpose | Who generally uses or issues it |
|---|---|---|
| DRC-01 | Electronic summary of a demand notice | Proper officer issues the summary with the notice |
| DRC-02 | Statement summary connected with a demand proceeding | Proper officer issues the statement summary where applicable |
| DRC-03 | Reporting a voluntary or pre-notice payment, and payment of amounts required within a post-notice statutory window | Taxpayer files it and records the payment allocation |
| DRC-04 | Acknowledgement of a qualifying DRC-03 payment | Proper officer issues the acknowledgement |
| DRC-05 | Order concluding proceedings after qualifying payment | Proper officer issues it when the statutory conditions are satisfied |
Rule 142 requires the electronic summaries. A DRC-03 is not a substitute for reading the notice: select the correct tax period, section and tax head, and allocate tax, interest and penalty as required. Retain the filed form, challan or debit reference, acknowledgement and any concluding order.
How to pay and preserve a defensible trail
- Inventory the demand. Copy the reference number, tax period, registration number, tax head, principal tax, interest and penalty from DRC-01 or the order into a reconciliation sheet.
- Check the legal route. Confirm whether the document cites section 73, 74, 76 or another provision. Read the allegation, not just the amount.
- Recalculate interest. Reperform the day count from the correct due date, use the notified rate for that period and separate each tax head and period.
- Check the deadline. Establish the date of service of a notice or communication of an order. A 30-day section 73 or section 74 window is measured from the legally relevant event, not from the date you happen to open the portal.
- Choose the payment route. For a qualifying voluntary or pre-notice payment, report it in DRC-03. For a notice-stage settlement, include all amounts required by the applicable section and file DRC-03 within the statutory window.
- Use the correct ledger. CBIC payment rules provide for payment of tax, interest, penalty, fee and other amounts by debiting the electronic cash ledger, with corresponding adjustment in the electronic tax-liability register.
- Verify posting. Confirm that the liability register reflects the intended allocation and that the portal shows the relevant acknowledgement or concluding order.
- Archive evidence. Keep the notice, order, workings, invoices, returns, challans, DRC forms, ledger extracts and correspondence together for the tax period.
If an appeal produces relief, the recorded demand is adjusted accordingly. Recheck the liability register after the appellate effect is posted rather than relying only on the paper order.

Worked examples of the three-way split
Example 1: section 73, payment within 30 days
A business receives a section 73 notice showing ₹200,000 principal tax and calculated interest. It verifies the tax, pays the principal and interest within 30 days of notice, and reports the payment through DRC-03. Where the statutory conditions are met, no penalty is payable and proceedings for that notice are concluded. The business should still retain the acknowledgement and confirming order.
Example 2: section 74, payment before notice
An officer has identified a potential section 74 issue, but no notice has yet been served. If the taxpayer accepts the liability and pays the tax, applicable interest and the 15% penalty within the pre-notice window described in section 74, the reduced settlement is materially lower than waiting for adjudication. The taxpayer must document the basis for the tax and the date and allocation of payment.
Example 3: collected tax under section 76
A supplier separately collects an amount described as GST from a customer but does not remit it. The principal obligation is the collected amount itself; section 76 also permits a penalty equal to that amount. The calculation is not the same as adding a routine late-filing penalty to an unpaid self-assessed tax.

Historical section 128A relief: why the date matters
CBIC Circular No. 238/32/2024-GST explains section 128A, effective 1 November 2024. It conditionally waived interest or penalty, or both, for specified section 73 demands relating to financial years 2017–18, 2018–19 and 2019–20. The circular states that 31 March 2025 was the notified date by which the demanded tax had to be paid for the cited benefit.

That was period-specific relief, not a standing waiver for current demands. As the notified payment date has passed, a business should not deduct interest or penalty today merely because its facts resemble those years. Check the current statutory text and any later notification before relying on a relief provision.
Common mistakes and how to correct them
- Calling the entire figure “the penalty.” Split principal tax, interest and penalty in your reconciliation.
- Using the 18% ceiling as an automatic rate. Locate the notified rate for the relevant period and category.
- Missing the 30-day clock. Record the legally relevant service or communication date and set an internal deadline earlier than the statutory one.
- Paying tax but not interest. Section 73 and section 74 settlement formulas generally require interest as well as tax.
- Choosing DRC-03 without matching the notice. Enter the correct section, period and tax head, then verify the liability-register posting.
- Assuming a section 74 allegation is just a larger section 73 demand. Fraud, wilful misstatement or suppression allegations affect both defence strategy and settlement percentages.
- Ignoring section 76 facts. If GST was collected from another person, reconcile collections and remittances separately.
- Failing to preserve the trail. Keep the DRC forms, debit references, ledgers, workings and orders together.
- Applying an old waiver to a new period. Relief such as section 128A is tied to specified years, dates and conditions.
A decision checklist before you pay
- Have you identified the exact tax period and tax head?
- Does the document cite section 73, 74, 76 or another provision?
- Have you separated principal tax from interest and penalty?
- Is the interest start date tied to the correct statutory due date?
- Are you using the notified rate for that period rather than a ceiling?
- Is a pre-notice or 30-day payment window still open?
- Does the amount include every component required for the chosen settlement?
- Will the payment be reported in DRC-03 with the correct allocation?
- Have you checked the electronic cash ledger and tax-liability register after payment?
- Could a period-specific relief or later amendment apply?
- Have you retained the notice, calculations, payment proof and any DRC-04 or DRC-05?
Bottom line for businesses
Treat a GST demand as a reconciliation exercise, not as one undifferentiated bill. The tax is the principal amount; interest compensates for the period a qualifying amount remained unpaid; penalty depends on the default, the section and the procedural stage. Section 73 can permit a no-penalty conclusion when tax and interest are paid within 30 days of notice, while section 74 offers graduated but substantial penalties tied to early payment. Section 76 addresses GST collected from another person and not remitted. Match the notice, deadline, DRC form and ledger entry before deciding what to pay.
Frequently Asked Questions
Does paying the GST demand immediately always remove the penalty?
No. Relief depends on the statutory route and timing. A qualifying section 73 payment of tax and interest before notice or within 30 days after notice can avoid a penalty; section 74 requires the applicable reduced penalty even when paid early, and section 76 can permit a penalty equal to tax collected but not remitted.
Is GST interest charged on the penalty amount?
Interest under section 50 is tied to unpaid tax or specified excess ITC/output-liability cases. The notice should show the calculation base and period; do not assume interest compounds on a separate penalty unless a specific provision says so.
Which document proves that a DRC-03 payment closed the proceeding?
Keep the filed DRC-03 and payment debit evidence, then look for the officer’s DRC-04 acknowledgement and, where the statutory conditions are met, DRC-05 order concluding the proceeding.
