When an appellate authority, tribunal or court reduces the tax in a GST demand, the linked interest and penalty are reduced in proportion to the tax finally determined. Section 75(8) of the Central Goods and Services Tax (CGST) Act requires that adjustment. The electronic tax liability register must also be reduced by the relief granted. Interest still runs on tax that remains short-paid or unpaid, even if the final order does not restate the interest figure.

If the demand is dropped completely, that proceeding leaves no confirmed tax, interest or penalty. A dropped demand does not, however, create fresh input tax credit (ITC). ITC must be legally eligible under the ordinary rules, and a separate liability or a time-valid fresh proceeding can still exist under another provision.

What a reduced GST demand does to tax, interest and penalty

The final tax amount controls the connected amounts. Section 75(8) states: “Where the Appellate Authority or Appellate Tribunal or court modifies the amount of tax determined by the proper officer, the amount of interest and penalty shall stand modified accordingly, taking into account the amount of tax so modified.”

That rule applies when relief comes from an appellate authority, the Appellate Tribunal or a court. It means the department should not continue to collect interest or penalty calculated on the pre-appeal tax that was removed. The surviving tax, rather than the original demand, is the base for the consequential calculation.

Interest follows the tax that remains unpaid

Section 75(9) preserves interest on tax that is still short-paid or unpaid. Therefore, an order can reduce the principal tax and still leave an interest liability on the amount that survives. The absence of a separate interest figure in the order does not, by itself, cancel statutory interest.

Penalty is adjusted with the modified tax

Penalty is also modified to reflect the tax finally determined. The exact penalty treatment depends on whether the proceeding is under section 73 or section 74 and on the wording of the final order. A penalty imposed on the amount deleted by the appeal cannot remain part of the relieved demand.

How the portal balance should change

The payment rules provide that a demand debited in the electronic tax liability register is reduced to the extent of appellate relief and that the register is credited accordingly. A taxpayer should reconcile the order with the portal rather than assuming that a favorable order has automatically corrected every ledger entry.

What a completely dropped demand means

A full drop means there is no confirmed tax, interest or penalty for that particular proceeding. Any debit attributable solely to that proceeding should be removed or credited in accordance with the relief order and the payment rules.

A drop is not a blanket immunity from every GST issue. The department may pursue a separate liability under another lawful provision, or issue a fresh notice where the statutory limitation requirements are met. The scope of the relief is defined by the notice, the adjudication order and the appellate or rectification order—not by the word “dropped” viewed in isolation.

Check whether the order is final for the disputed issue

Read the operative portion of the order to identify which financial year, tax period, section, tax head, invoice set and amount were allowed or rejected. An order may drop one allegation while sustaining another. Only the relief actually granted should be used to recalculate the liability register and the books.

Section 73 and section 74: why the section on the notice matters

Provision Type of case Amounts normally covered ITC point
Section 73 Tax not paid or short paid, erroneous refund, or ITC wrongly availed or utilised for reasons other than fraud, wilful misstatement or suppression Tax, section 50 interest and applicable penalty Ordinary eligibility and documentation rules continue to apply
Section 74 Alleged fraud, wilful misstatement or suppression of facts to evade tax Tax, section 50 interest and a penalty equivalent to the tax specified A specific restriction applies to ITC connected with tax paid under an order based on fraud, wilful misstatement or suppression
Section 75 Adjudication, modification and limitation mechanics Interest and penalty track the tax as modified; interest on remaining unpaid tax remains payable Determines the effect of the final tax finding, but does not independently grant credit

When a section 74 allegation is treated as section 73

If the allegation of fraud, wilful misstatement or suppression is not established, section 75(2) permits the matter to be treated as a section 73 case. The tax then has to be re-determined using the section 73 framework, including its limitation rules.

CBIC Circular 185/17/2022-GST explains an important consequence: a section 73 re-determination can itself fail when the original notice was out of time. The taxpayer should therefore check the notice date, the relevant financial year and the statutory deadline before accepting a converted demand.

What happens to disputed input tax credit

A reduced or dropped demand does not automatically put ITC back into the electronic credit ledger or authorise a new claim. Wrongly availed or utilised ITC is itself recoverable under sections 73 or 74. The outcome depends on two separate questions: whether the credit was legally eligible and why the department objected to it.

Separate the four ITC questions

  1. What amount was alleged to be wrong? Match the notice to invoices, suppliers, tax periods and the returns in which the credit was claimed.
  2. What amount remains after the order? Use the final order, not the original notice, to identify the sustained disallowance.
  3. Was the credit merely availed or also utilised? Utilisation can affect the tax and interest computation; an availed-but-unused amount may have a different factual treatment.
  4. What was the department’s finding? Determine whether the final finding involves fraud, wilful misstatement or suppression, or only an ordinary eligibility dispute.

The fraud-specific ITC restriction

The input-tax-credit rules state: “No input tax credit shall be availed by a registered person in respect of any tax that has been paid in pursuance of any order where any demand has been raised on account of any fraud, willful misstatement or suppression of facts.”

This restriction is tied to tax paid pursuant to an order in which the demand was raised on that fraud-related basis. If a section 74 allegation is rejected and the final matter is treated as section 73, the fraud-specific restriction may no longer apply; ordinary ITC conditions still do. A taxpayer should not restore a ledger entry merely because the penalty was reduced or because part of the demand disappeared.

Evidence to retain before making any ITC adjustment

  • Tax invoices, debit notes and credit notes for the disputed credits.
  • Supplier registration and tax-payment evidence available for the relevant periods.
  • Purchase registers, goods-receipt records and payment records that support the underlying supply.
  • Reconciliations between books, returns and auto-populated statements for the affected tax periods.
  • The notice, reply, adjudication order, appeal or rectification order and proof of payment.

Outcome-by-outcome guide

Result Tax Interest Penalty ITC consequence
Demand confirmed unchanged Payable as determined Follows unpaid or short-paid tax As imposed under the applicable section Wrongly availed ITC remains recoverable
Demand partially reduced Reduced to the modified amount Modified with the tax under section 75(8); residual unpaid tax still bears interest Modified correspondingly Only the disallowed amount finally sustained remains relevant
Demand dropped Nil for that proceeding No interest on the dropped amount No penalty on the dropped amount No automatic new ITC; eligibility must be established independently
Section 74 allegation converted to section 73 Re-determined under section 73 if within limitation Recomputed on the resulting tax Section 73 treatment applies Fraud-specific restriction may no longer apply if the final finding is not fraud; ordinary ITC rules still apply

How to implement a relief order in practice

  1. Read the operative paragraphs first. Record the tax head, financial year, period, section and amount allowed, reduced or sustained. Do not rely on a discussion section that is not part of the operative direction.
  2. Recalculate the surviving tax. Separate central tax, state or union-territory tax, integrated tax and cess where the order distinguishes them. Keep the original demand and the relieved amount in separate working papers.
  3. Recompute statutory interest. Apply interest only to the tax that remains short-paid or unpaid, using the applicable section 50 computation and the payment history. If the order is silent on interest, check section 75(9) before assuming that no interest is due.
  4. Recompute penalty under the final section. A section 74 penalty equivalent to the specified tax cannot be carried forward unchanged when the section 74 finding is removed or the tax is modified. Use the penalty direction in the final order.
  5. Check the electronic tax liability register. Confirm that the demand debit has been reduced and the relief credit posted. Save the updated ledger and the order together.
  6. Pay or contest any balance by the applicable deadline. If tax, interest or penalty remains, use the payment route specified for the proceeding. If the portal does not reflect the relief, file the appropriate request with the order and reconciliation rather than paying an unreconciled duplicate amount.
  7. Review ITC separately. Do not debit or restore credit solely because the tax demand changed. Confirm eligibility, utilisation, the final factual finding and the records supporting the claim.
  8. Preserve an audit trail. Keep the notice, submissions, orders, payment challans, ledger extracts and calculation sheet so that the same issue is not reopened through inconsistent figures.

Worked illustration of a partial reduction

Assume an original order determines ₹1,00,000 of tax, with interest and penalty linked to that amount. An appellate authority removes ₹60,000 and sustains ₹40,000. Section 75(8) means the interest and penalty must be recalculated by reference to ₹40,000, not ₹1,00,000. Interest attributable to the surviving unpaid tax can still accrue under section 75(9). The electronic tax liability register should be credited for the ₹60,000 relief and any related reduction in the linked amounts.

This illustration shows the method, not a universal interest or penalty rate. The actual calculation depends on the tax period, payment dates, the section applied and the exact wording of the order.

Do not confuse ordinary relief with the section 128A waiver

Section 128A was a targeted, conditional scheme for certain section 73 demands relating to financial years 2017–18, 2018–19 and 2019–20. CBIC Circular 238/32/2024-GST records that the provision took effect on 1 November 2024 and that 31 March 2025 was the notified date by which the full tax demanded had to be paid to obtain the benefit.

The scheme concerned waiver of interest or penalty, or both, subject to its statutory conditions. It was not an automatic consequence of an appellate reduction or a dropped demand, and it should not be used to rewrite the treatment of other financial years or section 74 cases.

Common mistakes after a favorable order

  • Deleting the entire liability after a partial reduction. Relief applies only to the amount actually modified or set aside.
  • Assuming “no interest mentioned” means no interest. Interest on surviving unpaid tax can remain payable under section 75(9).
  • Restoring all disputed ITC immediately. A changed demand does not prove that every underlying invoice satisfies ITC conditions.
  • Ignoring the final classification. Conversion from section 74 to section 73 can change penalty and the fraud-specific ITC consequence, but limitation still has to be tested.
  • Leaving the portal unreconciled. The rules implement relief through the electronic tax liability register; obtain a corrected ledger or pursue the prescribed correction route.
  • Applying section 128A to any old demand. Its years, section 73 requirement, effective date and payment deadline are specific.

What to verify before closing the file

  • The exact notice and order sections, financial year and tax periods.
  • Whether the relief is partial or complete and whether any issue was remanded for fresh determination.
  • Whether the original notice was within the applicable limitation period, especially after a section 74-to-73 conversion.
  • The tax, interest and penalty figures after applying the order.
  • The electronic tax liability register credit and any remaining balance.
  • Whether disputed ITC was availed, utilised, reversed or paid, and whether the final finding involved fraud, wilful misstatement or suppression.
  • Whether invoices, supplier evidence and reconciliations support any credit that remains claimable under the ordinary ITC rules.

GST adjudication is document- and date-specific. A taxpayer facing a live notice or an unreconciled portal demand should have the file reviewed against the applicable CGST provisions, the final order and the limitation calculation before making a payment or changing an ITC entry.
