The GST and provident-fund issues are separate policy threads, not a verified combined GST Council package. The Council’s 52nd-meeting agenda discussed proposed changes to reverse-charge treatment for some imported ocean freight, while its 43rd meeting recommended a lower GST rate and a different place-of-supply rule for ship repair services. Separately, a 2023 draft proposed extending seafarers’ provident-fund coverage to Indian crew on foreign-flagged ships. The available records do not establish that the draft became law or confirm all current implementation details.
What GST changes were discussed for foreign shipping lines?
The 52nd GST Council meeting agenda addressed reverse-charge liability on specified ocean freight paid to foreign shipping lines. Under reverse charge, the recipient—in this case, an Indian importer—accounts for tax rather than the overseas service provider.
The agenda said this liability had become redundant in light of the Supreme Court’s Mohit Minerals judgment and changes made through the Finance Act, 2023. It discussed proposed amendments to notifications. An agenda discussion is not itself an operative notification, so it does not establish the effective date or the current treatment of every freight transaction.

What did the Council recommend for ship repairs?
At its 43rd meeting in 2021, the GST Council recommended reducing the rate on ship and vessel maintenance, repair and overhaul (MRO) services from 18% to 5%. It also recommended changing the place of supply for business-to-business ship MRO so that it would be the recipient’s location.
These were Council recommendations. The recommendation alone does not verify the notification that would put a change into effect, its effective date, or whether later rules altered its application.

The third row concerns a vessel’s temporary change of operating status, not a general exemption for freight services or a rule about seafarer benefits.

A 2023 draft amendment proposed applying the Seamen’s Provident Fund Act to foreign-flagged ships employing Indian seafarers. It also proposed annuity and gratuity schemes. The draft was circulated for stakeholder comments; that circulation does not establish enactment, and the available records do not show that the proposed obligations are now in force.

National Shipping Board meeting minutes from 2025 recorded the issue as still under discussion. A stakeholder in that discussion said that nearly 80% of Indian seafarers work on foreign-flagged vessels. That is an estimate attributed to the recorded stakeholder discussion, not a verified government census or independently validated workforce statistic.

The Seamen’s Provident Fund Office says its scheme was introduced retrospectively from 1 July 1964 to provide old-age retirement benefits for seamen and their families. That background explains the scheme’s stated purpose and history; it does not, by itself, show that the 2023 draft’s proposed extension to foreign-flagged ships has taken effect.

What to check before relying on a tax or PF change
- For a GST rate, reverse-charge obligation, or place-of-supply rule, check the operative notification and effective date, rather than relying only on a Council recommendation or agenda.
- For the proposed foreign-flag coverage, check whether an enacted amendment or other operative legal instrument has been published; the 2023 draft and 2025 minutes do not settle its later status.
- Keep the relevant situation clear: imported freight, ship MRO, temporary coastal operation of a foreign vessel, and employment benefits for Indian seafarers involve different rules.
