The 57th GST Council meeting is scheduled for October 8, 2026, at Bharat Mandapam in New Delhi, after being moved from October 7, according to reports published October 6. The public formal agenda had not been released by then. Coverage points to possible changes to input tax credit refunds, e-commerce seller registration, criminal provisions and return filing—not confirmed decisions. A broad rate overhaul was not expected.
Why this meeting is being called the GST 2.0 “process” phase
India’s September 2025 GST rate-rationalisation exercise changed rates on goods and services from September 22, 2025, subject to exceptions for specified tobacco products and beedi. The Ministry of Finance’s September 18, 2025 FAQ describes that effective date and the exceptions. October 2026 reporting frames the next stage as work on how GST operates—credit, registration, compliance and enforcement—rather than another sweeping round of rate changes.
Finance Minister Nirmala Sitharaman reportedly flagged e-invoicing and input tax credit at a recent ITRAF event. That is reported context, not evidence that either subject appears on the formal agenda. The two October 6 reports available ahead of the meeting describe possible topics; the Council’s recommendations, any later government notifications and any required legislation are separate steps.
What changes might the Council consider?
| Issue | What was reported before the meeting | What is not yet established |
|---|---|---|
| Inverted-duty refunds | Broader refunds of accumulated input tax credit could include input services and capital goods. One reported possibility is input-services refunds during the current financial year and capital-goods refunds from April 2027. | These are speculative proposals, not available refund entitlements or operative deadlines. |
| Small e-commerce sellers | GST registration could be simplified for small businesses selling through e-commerce platforms, with more use of technology. | No confirmed process or eligibility criteria had been published in the reports. |
| Arrests and prosecution | The Council could consider changes to GST arrest powers while retaining prosecution for deliberate fraud and serious offences. | The reported account says changes would require legislative amendments and Parliament’s approval. No new rule was in force on the basis of these reports. |
| Export services | A clarification may address services supplied through overseas branches of Indian companies, an area associated with ambiguity and litigation. | No settled interpretation or clarification was reported. |
| Returns and tax payments | An optional annual return with quarterly tax payments was reportedly being considered for businesses with turnover up to Rs 5 crore that supply unregistered persons. | The threshold and design are proposed details, not current filing rules or a general GST registration threshold. |
| Rates and payment costs | No broad rate overhaul was expected. Taxation of the merchant discount rate (MDR) on UPI payments might be raised. | The report said UPI MDR was not on the formal agenda; neither a tax change nor a rate decision was confirmed. |
The proposal details above were reported by Business Today and India Today on October 6, 2026. Neither report establishes that these items were adopted by the Council.

What broader input tax credit refunds could mean
Under an inverted duty structure, a business can accumulate input tax credit when the GST rate on its inputs is higher than the rate on its outward supplies. That unused credit can tie up working capital. The reported proposal would broaden the types of accumulated credit that might qualify for refunds, potentially including credit on input services and capital goods alongside existing treatment.
For businesses, the practical questions are whether each category would qualify, what documentation and formula would apply, and when any rule would start. The October 6 reporting offered possible staged timing—input services in the current financial year and capital goods from April 2027—but did not establish a final schedule. Businesses should not treat those dates as a basis to claim a refund before an official change takes effect.
What small businesses and exporters should watch
E-commerce registration
Simpler registration could reduce administrative friction for small sellers using online marketplaces. But until eligibility, verification steps and platform responsibilities are set out officially, sellers should follow the registration rules currently applicable to them rather than assume a new exemption or process.

Export services through overseas branches
A clarification could address uncertainty over how services provided through an Indian company’s overseas branch are treated for GST purposes. The reports describe a possible response to ambiguity and disputes, not a settled interpretation. Exporters should wait for the exact wording of any recommendation and subsequent notification before changing their tax treatment.
What enforcement and return-filing proposals could involve
Arrest powers and criminal provisions
Reported discussions may seek to narrow or change the use of arrest powers while preserving prosecution for deliberate fraud and serious offences. Jitendra Motwani, Partner – Tax Practice at Trilegal, told India Today: “The proposed decriminalisation, with judicial oversight of arrests and routine ITC and classification disputes kept outside criminal reach, would be a forward-looking step that treats honest taxpayers as partners rather than suspects.” This is Motwani’s conditional assessment of a proposal, not a description of law or a Council decision.
Any change to statutory arrest or prosecution provisions would need the legislative process described in the reporting; a Council recommendation by itself would not complete that process.
Optional annual return and quarterly payments
The reported option is for businesses with turnover up to Rs 5 crore that supply unregistered persons. That figure is a proposed eligibility threshold for this possible filing arrangement—not a general registration threshold and not a current entitlement. The reports did not provide a final design or say how businesses would elect into the option.

CA Mandar Telang, Vice President of the Bombay Chartered Accountants Society, told India Today: “These reforms would reduce avoidable litigation, ease working-capital pressures and make GST more aligned with its foundational objective of seamless flow of credit.” That is an expert view about the potential benefits, not a measured outcome.

Pre-meeting reporting did not expect a broad new rate overhaul. Some states could raise revenue effects from the previous rationalisation, and UPI merchant discount rate taxation might be discussed, but the reports did not place MDR on the formal agenda. These possibilities should not be read as a planned rate change.
Rank #4
The October 2025 rate changes provide context, not proof of what the Council will discuss in October 2026. The Ministry of Finance’s September 18, 2025 FAQ on the 56th meeting recommendations identifies Notification No. 9/2025-Central Tax (Rate), dated September 17, 2025, and says the relevant changes took effect September 22, 2025. Specified tobacco products and beedi were excluded from that effective-date change pending later notification.
When could any changes take effect?
News reports attributed expectations of a phased rollout through 2027 to officials, and suggested rate reviews might favor an annual timetable. Neither is a confirmed implementation calendar. The effective date will depend on the specific recommendation and the legal step needed to implement it—such as a notification or, for statutory changes, legislation.
Before the October 8 meeting takes place, there are no outcome figures to cite for its effects on revenue, business savings or refunds. For each proposal, the key signal will be the Council’s actual recommendation followed by the relevant official notification or legislative change.
