There is no platform purchase that, by itself, makes an AI customer-service deployment GDPR-compliant. Compliance depends on what your organisation does with personal data: why it processes it, its lawful basis, the information it gives people, its configuration and its ability to demonstrate compliance. For a 2026 shortlist, treat vendor claims as evidence to examine—not as a certification or a verdict on your deployment.
This guide explains the checks to make and uses Intercom Fin and Salesforce Agentforce as examples of feature-specific vendor disclosures. These are examples, not a ranking or an exhaustive list of available platforms. The legal and vendor information discussed here is current to 4 October 2026.
What GDPR compliance means for an AI support platform
The GDPR’s principles apply to the organisation’s processing, not just to the software it buys. The European Commission says organisations must comply with the principles and be able to demonstrate that they do. Those principles include lawfulness, fairness and transparency; purpose limitation; data minimisation; accuracy; storage limitation; integrity and confidentiality; and accountability. The Commission’s GDPR principles guidance explains these duties.

In practice, assess the complete processing chain: the customer-service data you collect, the platform features that handle it, any model or other service that receives it, and the resulting records. A vendor’s security or compliance statement can inform that assessment, but it cannot establish that your purposes, legal basis, notices, settings and actual use meet your obligations.

Start with purpose and lawful basis
Write down what each AI feature is meant to do. Answering a customer’s question, summarising a conversation and suggesting a response to a human agent are different purposes and may involve different data flows. The European Data Protection Board identifies six possible legal bases: consent, contract, legal obligation, vital interests, public interest and legitimate interests. Which one is appropriate depends on the circumstances; special-category data has additional conditions. Record the basis for each purpose rather than treating “customer support” as a blanket justification.
Support conversations can contain unexpected or sensitive details. Decide what information the system actually needs, how staff should handle information it does not need, and whether particular categories require restrictions or a different workflow.
Apply minimisation, accuracy and retention to real data
For each feature, identify the fields, transcript content, knowledge sources and conversation history it can use. Limit processing to what is necessary for the stated purpose. Establish how inaccurate information can be corrected, and set retention periods for transcripts, prompts, outputs, logs, feedback and backups according to the purposes they serve. “The platform stores it” is not a retention rationale.

People need meaningful information about the processing
The European Commission’s guidance on controller obligations says information provided to individuals includes the controller’s identity, processing purposes, categories of personal data, legal basis and storage period. It also says people should be told when their data is processed for automated decision-making and about its envisaged consequences. Make sure your privacy information describes the actual AI-enabled service rather than relying on a generic statement that data is used to provide support.

As of 4 October 2026, the European Commission says the AI Act’s Article 50 transparency obligations apply from 2 August 2026. For systems that interact directly with natural persons—including chatbots and AI agents—providers must design and develop them so people are informed that they are interacting with AI. The Commission’s guidance concerns that direct-interaction context; do not assume that every internal tool assisting a human agent has the same notice obligation. Apply the rule to the specific system, its role and the way it is deployed.
Make the notice operational: determine where it appears in the customer journey, what it says, and how it remains accurate when AI is added to or removed from a channel. Also define how customers can reach a person when needed and how your team handles requests concerning their personal data. The AI Act and data-protection law apply alongside one another where personal data is processed. Recital 69 of Regulation (EU) 2024/1689 says the right to privacy and personal-data protection must be guaranteed throughout an AI system’s lifecycle, and connects data minimisation and data protection by design and by default with EU data-protection law.

Use the table to organise the evidence available for the two vendor examples below. It is not a compliance score: a public vendor statement does not verify your contract, tenant settings, data flows or use of the service.
| Platform example | Publicly documented evidence | Important boundary | What to confirm for your deployment |
|---|---|---|---|
| Intercom Fin | Intercom’s Trust Center lists GDPR among its compliance items. It says customer data hosting, storage and processing, including AI processing, take place in the USA or EU depending on the customer-selected region. | The statement does not establish which region your account uses or verify your contract, data flows, subprocessors, retention settings or purposes. | Confirm the selected region for your account and review the applicable contractual and technical documentation. |
| Salesforce Agentforce and Einstein Trust Layer | Salesforce documentation describes zero data retention with external model providers, permission-aware grounding based on the executing user’s access, and sensitive-data masking for supported features. Agentforce documentation says agents are integrated with the Trust Layer and respect standard Salesforce access controls. | Salesforce documents that LLM masking is disabled for agents; masking may be configured for embedded generative AI features such as Einstein Service Replies. Agentforce availability depends on edition and add-on licensing. | Check the selected feature, model route, region, masking behavior, permissions, logging, licensing and order-form terms. Do not infer that a Trust Layer statement applies identically to every feature. |
Intercom Fin
Intercom’s Trust Center is relevant if you are evaluating Fin because it describes regional handling for customer data, including AI processing, and lists GDPR among its compliance items. Its disclosure makes the account’s selected region a key procurement fact; the existence of an EU option does not show that a particular tenant is configured for it.
Before relying on the statement, match it to your account and the service terms that govern your use. Establish which processing the region statement covers, what subprocessors are involved, how long each data type is retained, and whether the platform’s handling supports your stated purpose and notices. The public Trust Center disclosure is vendor information, not an independent assessment of your deployment.

Salesforce Agentforce and Einstein Trust Layer
Salesforce documents several controls in the Einstein Trust Layer, including zero data retention with external model providers and grounding based on the executing user’s Salesforce access. Its Agentforce documentation says agents are integrated with the Trust Layer and respect standard Salesforce access controls. These details can help a buyer investigate how a proposed workflow uses permissions and external models.
Scope is critical. Salesforce’s documentation says sensitive-data masking for LLMs is disabled for agents, while masking may be configured for embedded generative AI features such as Einstein Service Replies. The Trust Layer should therefore not be treated as a single universal behavior across all AI features. Confirm which specific product path you are buying, whether masking applies to it, which models and services receive prompts, how data is logged elsewhere, and what edition or add-on is required. Check vendor documentation against your current order form and service terms.
A practical procurement review
Build a record for each feature you plan to deploy. Use these checks to turn vendor documentation into decisions about your own processing.
- Map the workflow. Name the feature and purpose—for example, customer-facing answers, conversation summaries or agent reply suggestions. Identify the data entering it, the outputs it creates, who can see those outputs, and whether a human reviews consequential actions.
- Assign roles and legal bases. Identify which party determines the purposes and means of each processing activity, what the controller and processor terms say, and the lawful basis for each purpose. Document any foreseeable special-category data and the additional conditions or handling rules that apply.
- Trace data destinations. Ask what leaves your environment, which vendor services and subprocessors receive it, and where storage, inference and support access occur. Distinguish a region the vendor offers from the region selected for your configured tenant.
- Pin down retention and model use. Ask how long prompts, transcripts, logs, feedback and backups persist; whether data is used to train or improve models; and exactly which model routes a zero-retention statement covers. Treat a claim limited to external model providers as limited to that scope.
- Test access and masking for the chosen feature. Determine whose permissions govern retrieved or grounded content, which data is masked, whether masking is enabled or optional, and whether behavior changes between agent-assist and customer-facing features.
- Plan notices and rights handling. Identify where customers are told about the processing and direct AI interaction, when relevant. Decide how the service supports your information, access and deletion workflows and how you will explain relevant automated decision-making and its envisaged consequences.
- Record configuration and proof. Note the edition and add-ons needed, administrator settings, relevant audit evidence, contractual documents and technical documentation. Keep the selected settings and supporting records aligned with your stated purposes and retention rules.
- Reassess changes. Revisit the record when you add a channel or AI feature, change a model or region, expand the data used for grounding, or alter retention and access settings. Those changes can change the processing being assessed.
How to choose between candidate platforms
Do not choose by a badge, a product-wide “trust” phrase or a simple compliant/not-compliant label. Compare the evidence for the exact feature and deployment you intend to use.
- Data flow and contract: Are the parties’ roles and instructions clear, and can you identify every service and subprocessor handling the relevant data?
- Location: Which locations cover storage, inference and support access, and which one is actually configured for your account?
- Retention and model use: Are periods and purposes clear for every data type? Does any zero-retention statement cover the whole route or only a particular provider relationship?
- Access and masking: Does grounding respect the right user’s permissions? Which feature paths mask data, and what is the default?
- Transparency and rights: Can your implementation give people the required processing information, disclose direct AI interaction where applicable, and support your organisation’s request-handling workflow?
- Evidence and availability: Are the documented controls available on the edition and add-ons you will buy, and do current technical documents and service terms match the proposed configuration?
For each shortlisted feature, record the vendor evidence, its scope, the relevant contract and configuration, and any unanswered question. That gives your organisation a defensible basis for its own assessment without mistaking a vendor disclosure for a compliance determination.

Frequently Asked Questions
Does GDPR compliance depend on the software vendor alone?
No. The organisation remains responsible for assessing its own purposes, lawful basis, configuration and processing, and for demonstrating compliance. A vendor’s documentation is evidence about its service, not a conclusion about your deployment.
Does a platform’s EU-region option show that my account processes data in the EU?
No. An available region and the region selected for a particular tenant are different facts. Confirm the configured account region and the scope of the vendor’s regional statement.
Is zero retention with external model providers the same as no data retention anywhere?
No. The scope matters: a statement about external model providers does not establish retention behavior for every platform feature, log, backup or other service.
Are the two platform examples a ranking of the best GDPR-compliant tools?
No. They illustrate feature-specific vendor disclosures and procurement questions; they are not an exhaustive market survey or a determination that either customer deployment complies.
