On October 3, 2026, the Food Safety and Standards Authority of India (FSSAI) said Food Analyst reports had classified a sample of Nestlé “Low Fat Dairy Whitener” collected at The Lalit in New Delhi as “unsafe” and “substandard.” The regulator said it directed the food business operator to immediately prohibit sale of the identified product. Nestlé disputed the finding, saying the product was safe and compliant.
What did FSSAI say about the dairy whitener?
FSSAI’s statement, reported by Moneycontrol on October 3, 2026, said the sample was declared unsafe and substandard under the Food Safety and Standards Act, 2006, and that directives had been issued to immediately prohibit sale of the product. Hindustan Times also reported the regulator’s action.

The sample was collected from Bharat Hotels Ltd. (The Lalit), New Delhi. NDTV specifies the hotel location as Connaught Place.
What does the reported order cover?
The reports describe a sample and a direction to stop sale of the identified product. They do not establish a nationwide recall or say that all Nestlé dairy whitener is affected. They also do not identify a batch, quantity, or wider geographic scope, so the available reporting cannot establish how much product or which other stock, if any, is covered.

Why does Nestlé dispute the finding?
Nestlé India said the product was safe and complied with applicable requirements. Its spokesperson argued that the laboratory reports assessed total phosphorus against an additive limit without accounting for phosphorus naturally present in milk-based ingredients. The company said its product complied with prescribed limits for added phosphorus, including on an “as consumed” basis, according to Hindustan Times.
This is Nestlé’s explanation of the disagreement, not an independently established account of the test. The reviewed reporting does not provide the exact laboratory result, the defect identified by the analysts, or the threshold used to classify the sample. It therefore does not resolve the technical dispute between the regulator’s reported finding and the company’s response.

Was there an appeal, and what happens next?
Reports say FSSAI issued a notice, provided the laboratory analysis report, and gave the company an opportunity to appeal within the prescribed period. They do not establish whether Nestlé filed an appeal, whether further testing took place, or whether the stop-sale direction was later changed. The order’s subsequent status is not established in the coverage available as of October 3, 2026.
