Former Ubiquiti employee Nickolas Sharp pleaded guilty to three federal offenses in February 2023 and was sentenced to six years in prison in May. The U.S. Attorney’s Office for the Southern District of New York (SDNY) said Sharp misused his access to company systems, posed as an outside attacker, and demanded nearly $2 million.
What did Nickolas Sharp plead guilty to?
On February 2, 2023, Sharp pleaded guilty in Manhattan federal court to intentionally damaging a protected computer, wire fraud, and making false statements to the FBI, according to the SDNY announcement. The DOJ said the three offenses carried a combined statutory maximum of 35 years, but that was not the sentence imposed; the judge determined the actual punishment.
What did the DOJ say happened?
Sharp’s access to company systems
The DOJ said Sharp worked for Company-1 from approximately August 2018 through April 1, 2021, as a senior developer. In that role, he had credentials for the company’s Amazon Web Services and GitHub servers. The SDNY said he repeatedly misused administrative access to download gigabytes of confidential company data.
The ransom demand and false persona
According to the DOJ, Sharp presented himself as a person helping the company respond to an external breach while seeking nearly $2 million for the return of the files and information about a purported remaining vulnerability. The department also said he later caused misleading articles about the company’s handling of the incident to be published while presenting himself as an anonymous whistleblower.

The initial 2021 charging announcement described allegations and noted that a defendant is presumed innocent unless proven guilty. Sharp’s later guilty plea admitted the three offenses listed above; the allegations and the admitted offenses should not be treated as interchangeable.
How the DOJ described concealment
The SDNY said Sharp used a VPN service for much of the incident to mask his IP address, and that a temporary outage of his home internet connection exposed his home IP at one point. This is a detail in the DOJ’s account of this case, not evidence that VPN services prevent or cause insider incidents.

What sentence and restitution did Sharp receive?
On May 10, 2023, Judge Katherine Polk Failla sentenced Sharp to six years in prison and three years of supervised release. The court also ordered him to pay $1,590,487 in restitution, according to the SDNY sentencing announcement.

The DOJ’s sentencing announcement attributed more than $4 billion in lost market capitalization to the period after misleading articles were published. It also said the company’s share price fell approximately 20% between March 30 and March 31, 2021. These are figures from the DOJ’s account of market impact; they are not the restitution order. Restitution was the separate court-ordered payment of $1,590,487.

Why was Ubiquiti named in the case?
The DOJ releases refer to the employer as “Company-1.” The company was identified as Ubiquiti in official case context, and the case is commonly described as involving a former Ubiquiti employee. U.S. Attorney Damian Williams, then the United States Attorney for the Southern District of New York, said: “Nickolas Sharp’s company entrusted him with confidential information that he exploited and held for ransom.”
