Lee County deputies arrested Christopher Ashley Nimmons Jr. on September 29, 2026, alleging that an Instagram account linked to him posted an AI-generated image depicting Sheriff Carmine Marceno wounded and running from armed figures. Reports say Nimmons was charged under Florida’s electronic written-threat law and separately with possessing a firearm while subject to a domestic violence injunction. The case was pending in the latest report reviewed; an arrest and charge are allegations, not findings of guilt.
What the AI-generated image reportedly showed
According to contemporaneous reporting, the image appeared as a comment beneath an Instagram post about the line-of-duty death of Lee County Sheriff’s Office K-9 Dundee, who died September 28. Reports described Marceno in full uniform, apparently suffering a head injury as two dark-clothed armed figures fired at him. The image’s reported placement and context are part of the allegation; the sources do not establish a court’s finding about what it meant.
How investigators reportedly linked the account to Nimmons
WINK News reported that investigators explored a possible account link through correspondence from a July 3 well-being check. In that earlier event, Nimmons was reportedly found at Gulf Coast Town Center, and a photograph of him appeared in correspondence associated with the Instagram account. Investigators reportedly later matched a phone number associated with the account. These are investigative claims reported by news outlets, not independently adjudicated findings.

The reported charges concern two distinct allegations, with different conduct and legal rules:

What Florida’s electronic-threat law says about images
Florida’s 2026 statute defines an “electronic record” to include digital text, graphics, video, audio, or pictorial material. It prohibits sending, posting, or transmitting such a record where another person may view it if the record makes a threat to kill or cause bodily harm. A violation is classified as a second-degree felony.

That scope means a digital image can fall within the law; it does not mean that AI generation alone is a crime. The reported charge still depends on whether the record makes a qualifying threat and whether the legal requirements are met in this case. Deputies reportedly said they had probable cause, but that does not establish how a court will assess the image, its posting context, or intent. A retired FBI agent quoted by WINK said context and intent may matter in judging online material as a criminal threat.

Why the firearm allegation is separate
Florida’s 2026 § 790.233 bars a person from possessing a firearm or ammunition while subject to a currently effective final injunction restraining that person from committing domestic violence, stalking, or cyberstalking. The statute classifies a violation as a first-degree misdemeanor. The news reports say an active domestic violence injunction applied to Nimmons, but the injunction itself was not independently reviewed in the reporting available here.

This allegation turns on the reported handgun possession and the existence and effect of an injunction. It is legally separate from whether the image constituted a threat under § 836.10.

A September 29 WINK report said Nimmons was scheduled to appear at the Lee County Justice Center on November 2, 2026, at 8:30 a.m.; an October 3 report repeated that date. No later court disposition is established in the sources reviewed. The incident account and case-specific evidence are based on local and secondary reporting, while the statutory descriptions come from the Florida Legislature’s 2026 statute text.

In a statement reported by Gulf Coast News and reproduced by AOL, Sheriff Carmine Marceno said: “Hiding behind a screen or using AI will not protect you from the consequences of your actions.” That is Marceno’s reported statement, not language from the statute.
