Flagstar Bank’s December 2021 data breach affected 1,547,169 people, according to a filing with the Maine Attorney General. The incident occurred December 3–4, 2021, but Flagstar said it discovered the breach on June 2, 2022; consumer notification was dated June 17, 2022. The compromised information included names or other personal identifiers combined with Social Security numbers.

What happened in Flagstar’s December 2021 breach?

Maine’s breach notice record reports that an unauthorized party accessed Flagstar’s network on December 3 and 4, 2021. Flagstar discovered the incident on June 2, 2022, and dated written consumer notifications June 17, 2022. The filing lists 1,547,169 affected people and says the information involved a name or other personal identifier in combination with a Social Security number.

Flagstar’s notice began: “Flagstar Bank respects the privacy of your personal information, which is why we are writing to let you know about a recent security incident.” The notice offered two years of Kroll credit monitoring and identity repair services. That was an offer made to affected consumers at the time; it should not be assumed to remain available now.

Why did the SEC later take action?

On December 16, 2024, the U.S. Securities and Exchange Commission announced settled charges over Flagstar’s statements about the late-2021 breach. The SEC’s order found that Flagstar negligently made materially misleading statements that understated the breach’s scope. The incident involved disruption, encryption of data, and exfiltration of personally identifiable information, while public statements described unauthorized access.

Flagstar agreed to pay a $3.55 million civil penalty to resolve the SEC action without admitting or denying the findings. This enforcement matter concerns the company’s disclosures about the December incident; it is separate from the private class action settlement discussed below.

How was this different from Flagstar’s January 2021 breach?

Flagstar had another, separate breach in January 2021 involving a file-sharing platform. Settlement materials describe that incident as affecting about 1.47 million people. The title’s 1.5 million figure refers to the later December 2021 network incident, not the January event.

What should someone do after receiving a Flagstar notice?

A notice can be relevant even if you do not remember opening an account at Flagstar. A person’s information may have been handled through a mortgage, servicing relationship, or another interaction, but the available records cannot determine an individual recipient’s connection. If the notice seems unfamiliar, use contact details independently verified through Flagstar’s official channels rather than sharing sensitive details in response to an unexpected call or message.

  • Read the notice for the incident date, information involved, and any enrollment deadline or access code.
  • Review bank and credit-card activity, and report unfamiliar transactions directly to the financial institution.
  • Check your credit reports for unfamiliar accounts or inquiries. Consider a credit freeze with each nationwide credit bureau if you want to restrict new credit applications; a freeze does not prevent monitoring existing accounts.
  • Use any monitoring or identity-restoration service only if the notice or current settlement terms confirm you are eligible and enrollment remains available.
  • Keep the letter and records of any resulting costs or identity-theft steps. The settlement’s claim period has passed, so verify current administrator instructions before attempting any claim-related action.

Does the settlement mean Flagstar was found liable?

No. The settlement notice said Flagstar denied the plaintiffs’ claims and that, when the notice was written, no court had determined the bank was liable or had done anything wrong in that private case. A settlement resolves claims under its terms; it is not itself a judicial finding of liability. The SEC’s separate settled enforcement action has its own findings and resolution.
