The reported server-porting dispute briefly put Fisker’s bankruptcy fleet sale at risk, but it did not establish that Ocean SUVs were permanently disabled. American Lease said Fisker had told it that vehicle data could not be moved to a server the buyer owned. Follow-up reporting said American Lease agreed to pay an additional $2.5 million for five years of technical support, allowing the transaction to proceed. The available reports do not explain the technical obstacle or confirm which connected features work today.
What was at stake in the server-porting dispute?
Fisker Group’s fleet sale to American Lease involved more than transferring physical vehicles. Connected functions such as remote access, diagnostics and software updates depended on services and data hosted beyond the SUVs themselves. If the buyer could not keep those services operating, it would have less ability to manage the fleet, even though it owned the vehicles.
In an emergency objection reported in October 2024, American Lease said Fisker had just informed it that porting the purchased vehicles’ data to another server would not be possible. The filing was quoted as saying: “Now, on the eve of the October 9 Hearing, Buyer has just been informed that Porting of the Purchased Vehicles will not be possible.” InsideEVs’ October 2024 report quoted the buyer’s statement from its court filing.
That is the buyer’s account of what Fisker told it. The available reporting does not identify whether the obstacle involved engineering, intellectual-property rights, third-party licenses, credentials, security, staffing or another issue. It therefore does not support a more specific explanation of why porting was said to be impossible.

What did the fleet-sale agreement cover?
The June 28, 2024 agreement covered up to 3,231 vehicles configured for the United States and Canada, with a maximum gross transaction price of $46.25 million. The vehicle exhibit provided for delivery “as is.” But the contract also addressed software and services separately: it granted American Lease a limited, royalty-free, non-exclusive, non-assignable and non-sublicensable license to relevant software and developer work needed to operate and improve the vehicles, and said Fisker would use commercially reasonable efforts to facilitate access to subscription-based services. The Fleet Sales Agreement makes clear that vehicle ownership did not itself transfer every software right or guarantee ongoing cloud-service access.

Those provisions distinguish four things that can otherwise be conflated: owning the cars, having licensed rights to software, hosting and running connected services, and receiving ongoing technical or parts support. The porting dispute concerned the latter service infrastructure, not a reported reversal of the physical sale.

How was the sale dispute resolved?
Follow-up coverage on October 14, 2024, reported that American Lease agreed to pay an additional $2.5 million for future technical support over five years, on top of the fleet purchase. InsideEVs/Yahoo News’ report described the negotiated support payment. The report indicates a resolution that allowed the transaction to proceed; it does not establish the present-day operating status of connected services or how the support was implemented.

Fisker’s connected services were not necessarily limited to systems it owned and operated itself. An August 2024 bankruptcy filing by TomTom describes licensed software and data services supporting Fisker vehicles in the United States and Canada. TomTom’s filing establishes third-party licensed elements in the service stack, but does not explain the porting problem or show that TomTom caused it.

At the time of the sale, reporting also described American Lease as planning to work with the newly formed Fisker Owners Association to make spare parts and software support available to more than 2,500 owners. TechCrunch’s July 2024 coverage describes that plan and quotes bankruptcy Judge Brendan L. Shannon calling American Lease “functionally a purple unicorn” in its role as buyer and potential support partner. This was a contemporaneous plan, not confirmation of current parts inventory, response times or continuing support coverage.

The dispute is evidence that continued connected functionality depended on more than possessing an Ocean SUV. It is not proof that every Ocean was bricked, that all cloud features stopped working, or that every feature remains available. The cited reports do not verify the present status of individual functions such as remote access, diagnostics or software updates, and they do not establish the duration or current implementation of the later support arrangement.
