On October 19, 2020, the Financial Crimes Enforcement Network (FinCEN) announced a $60 million civil money penalty against Larry Dean Harmon over Bank Secrecy Act violations tied to Helix and Coin Ninja. That was a civil regulatory action—not a criminal sentence. The Department of Justice (DOJ) later prosecuted Harmon separately: he pleaded guilty in 2021 and was sentenced to three years in prison in 2024.

What FinCEN penalized Harmon for

FinCEN said Harmon operated Helix as an unregistered money services business (MSB) from 2014 to 2017 and Coin Ninja from 2017 to 2020. The agency assessed the $60 million civil penalty for what it described as willful Bank Secrecy Act violations: failure to register as an MSB, failure to establish and maintain an effective anti-money-laundering program, and failure to report suspicious activity. FinCEN’s October 19, 2020 announcement describes the assessment and its findings.

FinCEN also said Harmon failed to collect and verify names, addresses, and other identifying details for customers involved in more than 1.2 million transactions, and actively deleted some of the limited customer information that had been collected. These are the agency’s findings as stated in its enforcement announcement.

How FinCEN described the rules

In the release, FinCEN stated that exchangers and administrators of convertible virtual currency are money transmitters under the Bank Secrecy Act and must register, maintain an anti-money-laundering program, and meet applicable reporting and recordkeeping duties. That is the regulatory framework FinCEN invoked in this case; the release alone should not be treated as a complete legal analysis of how the rules apply to every cryptocurrency service.

How large was Helix’s activity?

The official figures describe different measures, so they should not be treated as interchangeable. FinCEN reported transaction counts and value associated with wallet addresses; DOJ later described bitcoin moved by Helix and its value at the time of those transactions.

Agency and release Reported measure What it describes
FinCEN, October 2020 More than 1,225,000 customer transactions; at least 356,000 bitcoin transactions Helix activity from June 2014 through December 2017, as described in the agency’s release.
FinCEN, October 2020 More than $311 million associated with virtual-currency wallet addresses Value associated with addresses that sent or received funds in the Helix activity. This is a wallet-flow association, not a finding that every dollar was illicit proceeds.
DOJ, August 2021 More than 350,000 bitcoin, worth more than $300 million at the time of the transactions Bitcoin Helix moved on behalf of customers, according to DOJ’s guilty-plea announcement. DOJ said the largest volume came from darknet markets.

Neither agency’s cited figures establish an independent percentage of Helix’s total flows that was illicit. They also use distinct accounting measures, so the figures should not be added together.

Why Helix and Coin Ninja are called “mixers”

A cryptocurrency mixer, also called a tumbler, is a service intended to make it harder to trace how cryptocurrency moves between addresses. The enforcement record ties FinCEN’s action to both Helix and Coin Ninja, but DOJ’s detailed account of darknet-market activity centers on Helix.

In announcing Harmon’s August 18, 2021 guilty plea, DOJ said he admitted that Helix partnered with darknet markets including AlphaBay, Evolution, and Cloud 9. DOJ described Helix as moving bitcoin for customers, with its largest volume coming from darknet markets. The plea was to conspiracy to commit money laundering. DOJ’s announcement included statements from officials about the case; those remarks accompanied the 2021 guilty-plea announcement, not the later sentencing.

FinCEN’s civil penalty and DOJ’s criminal case are separate

The $60 million figure belongs to FinCEN’s 2020 civil enforcement action. It is not Harmon’s criminal sentence, and it is distinct from the forfeiture orders announced by DOJ in 2024.

Action Agency and date Outcome described in the official release
Civil enforcement FinCEN, October 19, 2020 $60 million civil money penalty for BSA-related violations associated with Helix and Coin Ninja.
Criminal prosecution DOJ, August 18, 2021 Harmon pleaded guilty to conspiracy to commit money laundering.
Criminal sentencing and forfeiture DOJ, November 15, 2024 Three years in prison, three years of supervised release, a $311,145,854 forfeiture money judgment, and forfeiture of seized assets valued at more than $400 million.

The sentencing and forfeiture figures come from DOJ’s November 15, 2024 sentencing announcement. The money judgment and value of seized assets are separate descriptions in that release; they should not be added together or conflated with FinCEN’s civil penalty. FinCEN’s announcement does not establish whether the $60 million penalty has since been paid or collected.
