A federal district judge in Oklahoma has ruled that a deputy’s warrantless query of historical automated license-plate reader (ALPR) data was an unconstitutional search under the Fourth Amendment. In United States v. Kyle, No. 4:26-cr-00189, Judge Sara E. Hill of the U.S. District Court for the Northern District of Oklahoma granted the defendant’s motion to suppress on October 1, 2026. The order is a trial-level decision in one criminal case. It is not a ruling from a federal appeals court, and it does not ban license-plate readers.
What the court decided
The headline calls the ruling a “Federal Circuit” decision, which is a different kind of court. A U.S. district court hears cases first; a U.S. court of appeals, such as the Tenth Circuit for Oklahoma, reviews them later. Judge Hill sits on the district court, so her order binds the parties in this case and is persuasive elsewhere, but it does not bind other district judges or any appeals court.
The holding is narrow in one respect and broad in another. Narrow, because it addresses a specific kind of police action: a retrospective query of stored plate-reader records. Broad, because the judge characterized that action as an unconstitutional warrantless search, rather than a minor procedural lapse. The opinion treats the query as a search that required either a warrant or probable cause, and found neither.

Tulsa County deputy Freddie Alaniz queried historical ALPR records for a vehicle bearing California plates. The systems searched included Flock and VehicleManager. The query returned more than 50 sightings of the car spread over roughly a month and across multiple states.

The defendant, Melisa Kyle, challenged the stop and the search that followed. The court also considered whether the stop was justified and whether the deputy unlawfully extended it. The ALPR finding is the central holding of the order, and it is the part that matters for readers following the surveillance question.
Why a historical query is treated differently from a single plate read
The distinction the court drew is between seeing a car on a public road and assembling a record of where that car has been over time. A camera that captures one plate at one moment records a single observation. A query that pulls weeks of sightings from many locations produces a compiled picture of a person’s movements, which the opinion treated as a search.

What the ruling does not do
- It does not ban ALPR systems. Agencies may still use plate readers in ways the order does not address, and the opinion does not declare the technology itself unconstitutional.
- It does not rule on every query. The holding concerns the facts before this court: a historical query, a specific duration, and a specific deputy’s conduct.
- It does not bind other courts. Judges in other districts and circuits may reach different conclusions on similar facts until a higher court rules.
- It does not single out one vendor. The order names the systems used in this case; it does not establish that any particular company’s product is unlawful.
What the judge wrote
The opinion states: “Alaniz’s use of the ALPR Systems was an Unconstitutional Warrantless Search.” (Sara E. Hill, United States District Judge, United States v. Kyle, Opinion and Order, Oct. 1, 2026.)

Checking the case status
Public reporting available at the time of writing does not establish whether the order has been appealed. Before relying on the outcome, readers and editors should confirm the current status:
- Open PACER and search the U.S. District Court for the Northern District of Oklahoma for case number 4:26-cr-00189.
- Look for a notice of appeal filed after the October 1, 2026 order, which would move review to the Tenth Circuit.
- If no appeal appears, note that the order remains a district court decision in one case, with no appellate review.
Any change in status would matter most for how far the reasoning travels, so the docket is the authoritative place to check.
