It is reasonable to object when a relative uploads or alters an identifiable family photo with AI without asking. A photo shared for one purpose is not blanket permission to upload it to a service, create a new depiction, or post the result. Families can set those permissions separately and make “ask first” the default. Not every harmless edit is harmful or unlawful, but realistic AI imagery can be misused, with particular risks for children.
Why AI edits of family photos deserve a conversation
Generative image systems can create realistic images and videos of identifiable people without their knowledge or consent. In a joint statement issued on 23 February 2026, 61 data protection authorities highlighted risks including non-consensual intimate imagery, defamatory depictions, cyber-bullying and exploitation, and expressed particular concern about children. They called for safeguards, transparency, accessible ways to request removal, and age-appropriate information for children, parents, guardians and educators. Read the joint statement.
That does not mean every family filter, playful edit or AI-generated image is harmful. The concern is that a person may lose control over how their likeness is used, and that an apparently ordinary photo can be repurposed in ways they did not agree to. The National Crime Agency (NCA) has described a UK case in which images of pupils taken from a school website were used to create more than 100 sexual images of children, followed by an attempt to blackmail the school. Set permission separately for each use
Consent to take a picture, send it to relatives, or share it privately does not automatically answer whether it may be uploaded to an AI service, altered, or posted publicly. A practical family rule is: Ask before uploading, altering, or sharing an identifiable photo of another family member. Anyone can say no, and permission can be revisited if preferences or circumstances change. The NCA advises parents and carers to consider whether they are still comfortable with how a child’s images may be used, whether preferences have changed, and whether to limit or withdraw consent. Make the agreement specific enough to guide everyday choices. For example, allowing a relative to take a birthday photo need not mean allowing them to upload it to an AI tool or post it publicly.
- Taking: May someone photograph the person or event?
- Editing and uploading: May the image be changed, and may it be sent to an AI service?
- Recipients: May it be sent privately to named relatives or a restricted group?
- Posting: May it appear on a public or broadly accessible account?
- Access and removal: Who can see it, how long should it remain available, and how can someone ask for it to be removed?
Include children as they grow
Talk with children about images of them in a way that fits their age. As they get older, involve them in decisions, make clear that they can say no, and check again when their preferences change. An earlier yes should not be treated as permanent permission.

Reduce who can access family images
Even without AI editing, the audience for a photo affects how far it can travel. Review the privacy settings on accounts used to share children’s images, consider who can access each post, and use restricted-audience sharing when that fits the family’s needs. The NCA advises parents and carers to think about who can access children’s images and offers restricted sharing as an option. NCA guidance.

For school or club photos, ask what the image will be used for, who can access it, and whether the permission covers AI tools or any new purpose. UK Department for Education guidance tells schools to check whether existing permission covers a new or different use and to account for new technologies, including AI, in permissions. What to do if an image is misused
- Support the child first. Stay calm and tell them they are not to blame for someone else’s actions.
- Keep relevant information. Preserve details that may help explain what happened, such as where the image appeared and when it was seen.
- Report it. Use the relevant platform’s reporting route and contact appropriate local authorities. For concerns in the UK, the NCA names the police or CEOP as reporting options; routes differ elsewhere. NCA guidance.
- Ask for removal. Contact the service hosting the image and request that it be removed. The joint statement by privacy authorities calls on organizations to provide accessible mechanisms for removal requests, though the available routes depend on the service and jurisdiction. What the law does—and does not—establish
Legal duties depend on location, who is using the image, and the context. The privacy authorities’ joint statement says organizations must comply with applicable privacy and data-protection frameworks and notes that non-consensual intimate imagery can be criminal in many jurisdictions. It does not establish that every family AI edit is illegal.
UK schools and private family sharing
UK Department for Education guidance applies to schools: it treats identifiable photos and videos as personal data and advises schools to check that permission covers a new or different purpose, including AI tools. The guidance distinguishes school use from personal use: family albums and private sharing with friends are not usually subject to data-protection law, while public sharing of images of other pupils may be different. These school-specific duties should not be assumed to apply in the same way to every private family use. UK Department for Education guidance.

US COPPA applies to covered online services, not every family upload
The US Federal Trade Commission’s COPPA guidance concerns covered online services collecting personal information from children under 13. It treats children’s images and voices in media as personal information and discusses parental notice and consent, removal, and metadata. The FTC also explains that COPPA concerns information collected online from children; an adult’s upload does not trigger COPPA merely because the information pertains to a child. FTC COPPA FAQ.
