Keeping AI inference in an EU-controlled environment is a way to retain more control over data, operations, infrastructure and service continuity—not a claim that EU law automatically forbids using a US cloud. The distinction matters: a transfer can be lawful while an organization still chooses to reduce its dependence on providers it does not control.
What does “sovereign AI” mean for inference?
Inference is the stage at which a trained model processes a prompt or other input to produce an output. For an organization using AI, deciding where inference runs is therefore also a decision about the infrastructure and service relationships that handle its workload.
The European Commission defines tech sovereignty as “Europe’s ability to act independently in the digital world by developing and controlling key technologies, data, and infrastructure, while reducing reliance on non-EU providers.” That definition, on the Commission’s “Strengthening Europe’s Tech Sovereignty” page, is broader than the country where a server sits. It includes the ability to control essential systems and avoid dependence that could limit choices later.
For inference, that broader view turns a location question into a control question: who operates the service, who can access it, which organizations and technologies it depends on, and how readily the workload could move if the service or relationship changes?

Does EU data residency make a US cloud unlawful?
No general conclusion like that follows from the Commission’s guidance. The Commission says personal data can be transferred to US companies participating in the EU-US Data Privacy Framework under its adequacy decision. Its explanation describes safeguards and a redress mechanism. That addresses a legal route for covered transfers; it does not establish that every concern about control, operational dependence or continuity has been resolved.
Data residency answers where particular data is stored or processed. It does not, by itself, answer who controls the provider, its infrastructure, its support operations, or the technologies and suppliers on which the service relies. Nor does the fact that a provider offers an EU region settle how a particular inference service handles prompts, outputs, logs, backups or administrative access. Those details depend on the service and its configuration.
So the case for keeping inference in an EU-controlled environment is strategic and operational, not a claim that GDPR categorically prohibits US-cloud inference. Organizations still need to assess whether a proposed data flow is lawful for their circumstances, separately from deciding whether the arrangement meets their sovereignty and resilience goals.

What should an organization assess besides server location?
The Commission’s Cloud Sovereignty Framework offers a useful structure for comparing cloud choices. It has 48 criteria across eight categories, and uses both a Sovereignty Effectiveness Assurance Level, which assesses defined sovereignty and resilience thresholds, and an overall sovereignty score.
| Assessment area | Questions to ask about an inference service |
|---|---|
| Strategic | Does using the service increase dependence on a provider or technology that would be difficult to replace? |
| Legal and jurisdictional | Which entities control the provider and service, and which jurisdictions may be relevant to them? |
| Data and AI | Where are prompts, outputs, logs and backups processed or stored? Which model and data-handling terms apply? |
| Operational | Who can administer or support the service, and what access controls govern that work? |
| Supply chain | Which suppliers and technologies are dependencies, and how concentrated are those dependencies? |
| Technological | Can the organization move its workload or change models without being locked into proprietary interfaces or formats? |
| Security and compliance | What evidence supports the service’s security and compliance claims, and does it cover the configuration being procured? |
| Environmental sustainability | What environmental information is available for the service and the infrastructure supporting it? |
Availability, latency and workload performance also belong in a procurement decision, even though they are practical service considerations rather than categories listed in the Commission’s framework. A highly controlled deployment that cannot meet operational requirements is not a workable choice; a fast service with weak portability or unacceptable dependencies may not meet the organization’s resilience goals.
The questions in the table are an applied checklist, not a claim that the Commission mandates each question verbatim. Answers should be specific to the actual service, contract and configuration—not inferred from a provider’s headquarters or the advertised location of a cloud region.

What does the Commission’s sovereign-cloud policy show?
In April 2026, the Commission announced four contracts for EU institutions to procure sovereign cloud services, with a combined value of up to €180 million over six years. The provider groupings named were Post Telecom with CleverCloud and OVHcloud; STACKIT; Scaleway; and Proximus with S3NS, Clarence and Mistral. The Commission said the parallel awards were intended to encourage diversification and resilience.

The Commission stated: “It also shows that non-European technologies, when operated within a strict and appropriate framework, can meet the minimum level of sovereignty required.” The procurement therefore does not amount to a rule that every component must be European-made. It shows that sovereignty can be assessed through a framework that considers how technology is operated and governed.
The tender establishes the Commission’s procurement outcome; it does not, by itself, establish that every named provider offers a particular commercial AI inference service or that a specific workload would meet an organization’s requirements. Those are separate product and deployment questions.

Is EU cloud capacity becoming a legal requirement?
Not on the basis of the Cloud and AI Development Act (CADA) material described by the Commission. CADA is a proposal, not an enacted law in the cited Commission material. Announced as part of the European technological sovereignty package on 3 June 2026, it is intended to support research and innovation, accelerate conditions for data-centre deployment, and create a common EU-wide sovereignty assessment framework. Those are proposed policy objectives, not current binding requirements.
The package covers semiconductors, cloud and AI capacity, open-source alternatives, and energy-system digitalisation. Its direction reinforces the policy interest in European capacity and more consistent assessment, but it should not be mistaken for a present rule that organizations must run inference only on EU technology.

Why make control a design choice?
Choosing an EU-controlled inference environment can reduce reliance on a non-EU provider and give an organization a clearer basis for governing its data, operations and infrastructure. It can also make it easier to align deployment choices with resilience and portability objectives. These are reasons to examine the full service arrangement, not guarantees that any deployment will be sovereign simply because it is located in Europe.
The scale of the issue is broader than cloud: the Commission’s sovereignty page cites CERRE for the estimate that more than 80% of key digital products, services, infrastructure and intellectual property are supplied from outside the EU. The page does not specify the year for that estimate, and it is not a statistic about cloud market share or AI inference specifically.
For organizations that prioritize control, keeping inference out of the US cloud is a way to limit one class of external dependency. The sound decision is not “EU location at any cost” or “US cloud is unlawful,” but to choose a deployment whose legal basis, control model, technical portability and service resilience fit the workload.
