The EU AI Act’s general application date was 2 August 2026, but that is not the start date for every requirement. Some provisions have applied since 2025; transparency and general-purpose AI rules are now enforceable; and important high-risk-system rules do not apply until 2027 or 2028. Which date matters depends on the provision, the system and the operator’s role.

What does “the AI Act is taking effect” mean?

Regulation (EU) 2024/1689 entered into force on 1 August 2024 and set out a phased schedule. Article 113 says, “It shall apply from 2 August 2026,” but the same schedule includes provisions that began earlier, later deadlines and transitions. The consolidated regulation on EUR-Lex is the legal text; the European Commission’s implementation timeline summarizes the milestones.

In practical terms, 2 August 2026 is a major operational milestone, not a switch that turned every duty on at once. Enforcement started for provisions that were applicable on that date, including rules for general-purpose AI (GPAI), transparency requirements and prohibitions that had already begun to apply. The Commission describes the enforcement start date in its enforcement FAQ and enforcement framework.

Which AI Act rules apply on which dates?

The main dates below distinguish rules already in force from requirements that remain scheduled for later. The 2026 amendment changed the high-risk-system timetable; the consolidated law and the Council’s AI Act timeline reflect the staged schedule.

2 August 2025 Governance provisions and obligations for providers of GPAI models began applying. Some GPAI models placed on the market before this date have a transition until 2 August 2027.
2 August 2026 The general application date; enforcement begins for applicable provisions, including GPAI obligations and transparency rules. Some requirements have later dates or transitional arrangements.
2 December 2026 New prohibitions concerning the generation or manipulation of non-consensual intimate material and child sexual abuse material apply. Certain providers of systems already on the market before 2 August 2026 have until this date for the Article 50(2) marking and detection obligation for synthetic content.
2 December 2027 Rules for Annex III high-risk AI systems apply. This date follows the 2026 amendment.
2 August 2028 Rules for Annex I high-risk AI systems embedded in regulated products apply. This is the delayed application date for this category.

For the precise legal scope of a provision or transition, check the relevant articles and amendment in the consolidated regulation and Regulation (EU) 2026/1744. Summary timelines are useful for orientation, but they do not replace the legal text.

What started on 2 August 2026?

Enforcement of provisions that are already applicable

From 2 August 2026, the Act’s enforcement framework applies to provisions whose application date has arrived. This includes obligations for GPAI models and transparency requirements, as well as prohibited-practice provisions already in effect. The date does not bring the later high-risk-system rules forward.

Transparency about AI interactions and synthetic content

The Commission identifies duties that include informing people when they interact with certain AI systems, labeling deepfakes, and machine-readable marking of certain AI-generated or manipulated content. These duties are not interchangeable: the relevant requirement depends on the system, content and provision. For certain systems already on the market before 2 August 2026, providers have until 2 December 2026 to meet the Article 50(2) marking and detection obligation. The Commission’s 31 July 2026 announcement describes the transparency requirements starting on 2 August.

When do the high-risk AI rules apply?

High-risk requirements do not share one date with the Act’s general application. Under the schedule following the 2026 amendment, the rules for Annex III high-risk systems apply from 2 December 2027. The rules for Annex I high-risk AI embedded in regulated products apply from 2 August 2028. These are distinct categories with distinct dates; whether a particular system falls into either one depends on the Act’s definitions and annexes.

Providers and deployers assessing a system should therefore avoid treating “high-risk AI” as a single category with a single deadline. Check the applicable annex, the system’s intended purpose and the relevant provisions in the consolidated legal text.

Who enforces the Act, and who should check their obligations?

The Act applies obligations according to the operator’s role and the system or model involved; it does not give every person using an AI tool the same compliance duties. The Commission identifies providers and deployers among the operators covered. The AI Office has exclusive enforcement powers for specified GPAI matters and certain systems related to designated very large online platforms or search engines. Member State authorities enforce relevant provisions in their remit. The Commission’s enforcement framework explains this division.

For an organization, the useful first step is to map its role, the AI system or model, its intended use and the relevant application date. Then check for a transition or exception in the legal text rather than assuming that the general date applies uniformly. A general timeline can orient that review, but it is not a substitute for advice tailored to a specific system and organization.

Will the AI Act be fully applicable on one later date?

No single date in the published schedule makes every requirement applicable at once. The general application date is 2 August 2026, while later dates and transitions remain relevant for particular prohibitions, transparency obligations, GPAI models and high-risk systems. The Commission’s Navigating the AI Act FAQ provides an explanatory overview; the consolidated regulation controls the exact scope.
