Envirodigm Inc. is appealing Apple Inc.’s summary-judgment victory in a California lawsuit over an alleged anodization formula for a colored aluminum iPhone body. The California Court of Appeal heard argument in case H052479 on October 15, 2026. No appellate decision had been reported by October 16, 2026, so the court has not yet ruled on whether the case can proceed.

What the appeal is about

The dispute combines two different legal theories. Envirodigm alleges that Apple received its proprietary anodization chemistry during an August 2013 meeting covered by a nondisclosure agreement, then used that information to produce an aluminum iPhone body. Its complaint includes a trade-secret misappropriation claim and a breach-of-contract claim based on the NDA.

The underlying action is Envirodigm Inc. v. Apple Inc., California Court of Appeal case H052479, arising from Santa Clara County Superior Court case 20CV373138. The superior court granted Apple’s motion for summary judgment. A September 10, 2026 superior-court record lists the granted motion, while noting that the tentative ruling supplied to the parties remained under seal.

Who is appealing, and what happened at the hearing?

Envirodigm—not Apple—is the appellant. Apple is defending the lower-court result and asks the appellate court to leave the summary judgment in place. Envirodigm argues that at least its NDA-based contract claim should continue even if the trade-secret claim fails.

The October 15 hearing was before Justices Daniel H. Bromberg, Cynthia C. Lie and Charles E. Wilson. Apple’s lawyer, Michael von Loewenfeldt, argued that Envirodigm’s required trade-secret disclosure did not identify the alleged formula with enough detail. California law, he said, does not allow a claim built on a secret that was never disclosed with sufficient specificity.

Envirodigm lawyer Benjamin Siminou argued that the contract promise in the NDA is a separate obligation. Justice Bromberg questioned why a failure to identify the information as a trade secret would necessarily defeat the contract claim. Questions from a panel are not a ruling, and the court’s eventual opinion could accept, reject or partially separate the parties’ arguments.

What formula does Envirodigm say Apple used?

At oral argument, Siminou said Apple had conceded that it used “that two-to-one ratio of organic to inorganic acid in order to anodize” the aluminum iPhone body. He also said Apple began experimenting within two months of the August 2013 meeting and used the process to manufacture iPhones from 2015 onward.

Those statements describe Envirodigm’s advocacy at the hearing, not findings that have been finally established by the appellate court. The reported record does not provide a published damages amount, settlement figure or final determination that Apple misappropriated a trade secret.

Why the chemical disclosure matters

Trade-secret identification

A trade-secret plaintiff generally must identify the information it claims was secret with enough precision for the court and opposing party to understand the alleged secret’s boundaries. Apple’s central position is that a broad or vague description of anodizing chemistry does not satisfy that requirement. The specificity question can affect what evidence is relevant, whether the defendant had fair notice of the claim and whether the alleged information can be distinguished from generally known process knowledge.

The NDA theory

Envirodigm’s response is that an NDA can impose confidentiality and use restrictions even when the information does not qualify as a trade secret under the statutory standard. Its appeal therefore asks whether the contract claim should be evaluated independently rather than dismissed automatically with the trade-secret claim. The appellate court must decide how the NDA’s language and California procedural rules apply to the evidence presented on summary judgment.

Timeline of the dispute

Date Event
Early 2011 Separate California appellate history records that Apple had decided to replace a stainless-steel iPhone body with a thinner, lighter extruded anodized-aluminum alloy and sought aluminum manufacturing information from Constellium.
August 2013 Envirodigm says it met with Apple and disclosed information under a nondisclosure agreement.
Within two months, according to Envirodigm’s counsel Apple allegedly began experimenting with the process.
2015 onward, according to Envirodigm’s counsel The alleged process was used in iPhone manufacturing. Reporting associated the colored aluminum body with the iPhone 6s and iPhone 6s Plus.
September 10, 2026 A superior-court record lists the granted summary-judgment motion; the related tentative ruling remained under seal.
October 15, 2026 The Court of Appeal heard oral argument in H052479.
October 16, 2026 No appellate disposition had been reported.

How the parties’ positions differ

Issue Apple’s position Envirodigm’s position
Disclosure specificity The alleged formula was not identified precisely enough to support a trade-secret claim. The NDA protects confidential information separately from the trade-secret standard.
Type of claim The trade-secret theory cannot proceed without a sufficiently specific secret disclosure. The breach-of-contract theory should proceed even if the trade-secret theory does not.
Requested appellate result Affirm the summary judgment entered for Apple. Reverse or otherwise allow the contract theory to continue.
Current evidentiary status Relies on the lower-court judgment and the legal sufficiency challenge. Relies on counsel’s account of Apple’s alleged use and the NDA relationship.

Has the appeals court ruled?

Not as of October 16, 2026. The October 15 proceeding was oral argument, not an announced decision. Until the court issues an opinion or order, the superior court’s summary judgment remains the operative ruling, subject to the appeal. The appellate disposition could affirm the judgment, reverse it, or send some or all of the claims back for further proceedings.

What this means for the iPhone history

The lawsuit concerns an alleged chemistry used to color an aluminum body, not a finding that every anodized iPhone relied on Envirodigm’s formula. The product context matters because Apple’s move toward thinner extruded anodized aluminum began years before the alleged 2013 meeting, while the disputed process is tied in the litigation’s reported account to a 2015-era model. That background does not resolve whether the particular formula was confidential, disclosed under the NDA or independently developed.
