An employee punch clock records when workers start and stop work, using paper time cards or electronic punches. For U.S. federal Fair Labor Standards Act (FLSA) recordkeeping, employers generally do not have to use a physical clock: they may choose any method that produces complete and accurate records. The right setup depends on the worksite, how employees clock in, and how the business calculates and exports time.

What is an employee punch clock?

A punch clock is a timekeeping device employees use to record work times. Traditional models stamp entries on paper time cards; electronic models record punches digitally and may offer calculations or data transfer. A physical clock is one way to collect time, not a complete payroll or compliance system by itself.

Do employees have to punch a time clock?

Under the U.S. federal FLSA guidance cited here, employees entitled to overtime pay are not required to punch a time clock. The Department of Labor says, “Employers may use any timekeeping method they choose,” provided the method keeps complete and accurate records. Employers may use a time clock, a timekeeper, or employee-maintained records. See the U.S. Department of Labor’s Small Entity Compliance Guide and Fact Sheet #21.

Fixed schedules and flexible hours

For employees on a stable fixed schedule, the DOL guide says an employer may keep the schedule and note exceptions when actual hours differ. For flexible schedules, it describes recording daily totals instead of requiring a punch for every start and stop, as long as the hours are accurately recorded. A schedule is not a substitute for recording actual hours when employees work different hours.

Work time is not the same as a punch

A clock entry does not automatically determine what time is compensable. The employer must count hours actually worked: an early or late punch without work does not itself establish work time, but work performed must be counted. Rounding is acceptable only when, over time, it does not result in failing to count all hours worked. The DOL explains this in its FLSA Hours Worked Advisor.

Automated timekeeping does not shift that responsibility. A 2024 Wage and Hour Division bulletin says employers remain responsible for accurate records and paying for all hours worked even when software uses AI to predict or prepopulate time entries. See Field Assistance Bulletin No. 2024-1.

What records should an employer keep?

For covered nonexempt workers, the DOL’s Fact Sheet #21 lists identifying information and work and pay details such as hours worked each day and workweek; pay basis and regular rate; straight-time and overtime earnings; additions or deductions; total wages; and payment date and pay period. It gives general federal retention periods of at least three years for payroll records and two years for records used to calculate wages, including time cards and work schedules. These are federal FLSA guidelines, not a summary of every state or local rule. Other requirements may apply, including rules concerning biometric data, labor agreements, or particular industries. Employers should check the requirements that apply where their employees work.

Which kind of time clock fits your workplace?

Choose based on the workflow the clock must support—not simply whether it is described as “electronic.” These categories are comparison points, not product endorsements.

How to choose and roll out a clock

  1. Map the work pattern. Decide whether employees report to one site, move between locations, work remotely, or follow flexible schedules.
  2. Choose the punch method. Compare paper cards, PINs, badges, biometrics, and software entry against how employees will actually record time. If considering biometrics, check applicable privacy rules before rollout.
  3. Check the full workflow. Confirm employee capacity, offline behavior, calculations, reports, payroll export or integration, and any network or subscription requirements for the specific model.
  4. Confirm supplies and documentation. For a paper clock, verify the exact card and ribbon compatibility and continuing availability. For a digital system, review current product documentation and how corrections are made.
  5. Set procedures for exceptions. Explain how workers report missed punches, schedule changes, and time worked outside scheduled hours. Make sure edits preserve an accurate record rather than erasing work time.
  6. Check records and retention. Ensure the overall process captures required work and pay information and retains records for applicable federal, state, and local periods.
