Under Indian GST, an amount deducted from an employee for workplace canteen food and a canteen operator’s service charge are not automatically the same kind of transaction. Identify who supplies what to whom, what the contract says, and who invoices and pays. An employee contribution or recovery alone does not settle whether the employer has made a taxable supply; an operator’s charge must be assessed separately.
Start with the supplier and recipient
“Canteen recovery” and “service charge” are labels, not GST classifications. Trace the arrangement from the underlying contract and service through to the invoice and payment:
- Employer and employee: Is the employer providing a canteen benefit under the employment contract, and is the employee contributing toward its cost?
- Operator and employer: Has an outside caterer contracted with or invoiced the employer for canteen services?
- Operator and employee: Does the operator instead supply or bill employees directly?
- Separate fee: What service does a line item called a “service charge” pay for, and who charges it?
The answers can lead to different GST analyses even where the amounts relate to the same workplace canteen.

Employee canteen recoveries and contractual perquisites
Schedule III to the CGST Act, 2017 excludes from “supply” “Services by an employee to the employer in the course of or in relation to his employment.” That provision concerns the employee’s services to the employer; it is not, by itself, a blanket exemption for every canteen transaction or every amount deducted from payroll.

CBIC Circular No. 172/04/2022-GST, dated 6 July 2022, addresses perquisites provided by an employer to employees under their employment contract. It states: “Any perquisites provided by the employer to its employees in terms of contractual agreement entered into between the employer and the employee are in lieu of the services provided by employee to the employer in relation to his employment.” CBIC’s clarification is that such contractual perquisites are not subject to GST. Read the circular.
Accordingly, a payroll deduction or employee contribution does not alone prove that the employer has made a taxable outward supply. Examine whether the canteen arrangement is a contractual employment perquisite and how it actually operates. Do not extend the circular’s clarification to a structure that does not fit those facts.

Operator charges to the employer are a separate transaction
If an outside caterer supplies canteen services to the employer, assess that supply independently of any later recovery from employees. Check the contract, the party identified as recipient, the invoice recipient, and the payment flow. The employer’s recovery from staff does not determine how the operator’s supply is classified.

CBIC’s rate table lists restaurant service other than at specified premises at 5% total—2.5% CGST and 2.5% SGST—subject to the condition that input tax credit on goods and services used in supplying the service has not been taken. See CBIC’s rate table. That entry does not establish that every workplace canteen contract is restaurant service or that this rate automatically applies. Establish the service classification and check the rate notification currently in force for the particular arrangement.

When a canteen service charge attracts GST
CBIC’s general FAQ says that service charge, like any other supply, is leviable to GST and is not a statutory government levy. Read CBIC’s FAQ. Apply that guidance to the actual fee: determine who charges it, who receives the related service, and what the charge is consideration for.
A line item called “canteen service charge” is not enough to reach a conclusion. A distinct charge imposed by an operator may form part of consideration for a supply, but the FAQ does not establish identical treatment for every operator invoice or employer payroll entry using that label.

Input tax credit on canteen services
GST on a canteen service and the employer’s eligibility to claim input tax credit (ITC) are separate questions. CBIC’s Sectoral FAQ says tax paid in respect of canteen service providers is not available as credit. See the Sectoral FAQ. Treat that as FAQ guidance, not a substitute for checking the current statutory restriction and any applicable exception against the employer’s facts before deciding an ITC claim.
Practical classification checklist
- Identify each supply. Separate the operator’s service from any employer-to-employee arrangement; do not treat the whole flow as one transaction.
- Read the relevant contracts. Check the operator agreement and employment terms, including whether the canteen benefit is provided as a contractual perquisite.
- Match invoices to recipients. Record who issued each invoice, who is named as recipient, and whether employees are billed directly or the employer is billed.
- Trace the money. Determine whether the employer pays the operator, employees pay the operator, or the employer recovers a contribution through payroll.
- Classify each fee and supply. For a distinct service charge, identify what it pays for and who charges it. For the operator’s service, verify the classification and current rate notification rather than assuming a workplace canteen uses the listed restaurant-service rate.
- Review ITC separately. Check the current CGST Act provisions and any applicable exception for the employer’s circumstances; do not infer credit eligibility from the GST charged on the operator’s invoice.
The principal official clarification discussed here is CBIC Circular No. 172/04/2022-GST, dated 6 July 2022. Because rate tables and FAQs may not reflect every later amendment, verify the current Act, rate notifications, and any later applicable guidance before finalizing treatment for a particular contract.
