Co-op Legal Services is using an AI system to record, analyse and score some staff calls about probate, wills and estates, according to a report by The Guardian on 8 October 2026. The company says the system supports service quality and coaching; an anonymous employee told the newspaper it creates a sense of being watched and distrust. The report does not establish whether the scores affect employment decisions or whether the system complies with UK data-protection law.
What Co-op’s AI call monitoring reportedly does
The Guardian reports that Co-op Legal Services introduced the system in the preceding couple of months for dozens of legal-services staff handling inquiries about probate, wills and estates. The system uses an OpenAI model and assesses more than 50 aspects of a call, producing pass/fail scores for managers. The report does not name the monitoring product or explain its full technical setup, the scoring rubric or how the model’s assessments were validated.
The report’s main text says one employee felt monitoring could take several hours of a workday. A photo caption gives the figure as seven hours, but that is an individual account, not a measurement of staff workloads. Neither figure should be treated as representative of all colleagues.

The company’s stated purpose
Co-op said it did not recognise the employee’s criticism, described probate advisers as highly engaged and called AI a key part of its quality-assurance processes. The company said the system is a support tool, not a decision-maker, intended to help colleagues and improve the client experience.

The employee’s account
An anonymous Co-op worker told The Guardian that the system felt different from occasional compliance listening because it monitored every word, and said it created distrust. The newspaper quoted the employee describing the experience as “really dystopian.” This is one worker’s attributed account, not a survey of colleagues or evidence that everyone experiences the system in the same way.

What UK data-protection guidance says about worker monitoring
The Information Commissioner’s Office (ICO) says employers may monitor workers, but monitoring must be lawful and fair. Its guidance says staff should be informed, the purpose should be clear, and employers should use the least intrusive method that achieves that purpose. The ICO also warns that excessive monitoring can intrude on privacy and harm mental wellbeing. The guidance is under review following the Data (Use and Access) Act, so the ICO’s live material is the reference point for current requirements.
Where processing is likely to create a high risk to workers or other people, the ICO says an employer must complete a data protection impact assessment (DPIA) before it begins. The regulator gives monitoring that may lead to financial loss, such as performance management, as an example. Employers must also take reasonable steps to keep monitoring information accurate and consider challenges from workers, especially where the information could be used in adverse decisions.

For tools that support decisions, ICO guidance calls for meaningful human involvement: a decision-maker should actively assess the recommendation, have the authority and competence to disagree, and consider other relevant information. Co-op says its system is not a decision-maker, but The Guardian report does not describe how managers use the scores in practice. The reported facts are therefore not enough to determine whether any particular legal rule on automated decisions applies or whether the system is compliant.
What remains unknown about the Co-op system
The Guardian’s report does not establish the monitoring vendor, how long recordings or scores are kept, whether calls are transcribed or sent to external services, or how employees can challenge a score. It also does not say whether scores affect appraisals, pay, discipline or dismissal, or describe the human-review process in enough detail to assess it. These details matter when judging how intrusive monitoring is and what consequences it may have.

How to assess workplace AI monitoring
For workers, employers and anyone comparing monitoring practices, the relevant questions are broader than whether a tool is labelled “quality assurance.” ICO guidance points to several practical dimensions:
Outdated Drivers Are Slowing You Down
One free scan finds every outdated or missing driver and matches the right update for your exact hardware.Free scan · exact hardware matchWindows Errors? Fix Them Before They Spread
Repair common Windows errors and clear accumulated junk for a smoother, more stable PC - no reinstall needed.Free scan · no reinstall- Purpose: Is the system used for service quality, compliance, performance management, or more than one purpose?
- Scope and frequency: Are a sample of calls reviewed, or every call? How often are staff assessed?
- Intrusiveness: What information is collected, and is there a less intrusive way to achieve the same aim?
- Transparency and consultation: Have workers been told what is collected, how it is assessed and how results are used?
- Accuracy and challenge: Can workers see and contest inaccurate or misleading assessments?
- Human review: Does a qualified manager independently consider the score and have the authority to reject it?
These are assessment questions, not claims about Co-op’s undocumented procedures. The ICO’s worker-monitoring guidance is available at Monitoring workers; its guidance on impact assessments is at Data protection impact assessments, and its material on automated decision-making is at Automated decision-making and profiling.
