Dyed diesel is regular diesel marked with red dye to identify fuel intended for off-road or another nontaxable use. It is often cheaper because highway excise taxes are generally not included, but sales taxes, fees, and state rules may still apply. Under the ordinary rules, dyed diesel is not for a truck driven on public roads. A federal action announced October 5, 2026 temporarily changes federal tax treatment for highway use through the end of 2026; it does not establish that every state has changed its taxes or rules.

What is the difference between dyed and regular diesel?

The key difference is how the fuel is identified, taxed, and permitted to be used—not a different engine-performance grade. The U.S. Energy Information Administration (EIA) says off-road diesel is dyed red to distinguish it from on-highway diesel; North Carolina describes dyed diesel as regular diesel with red dye added. In ordinary sales, highway diesel is sold undyed, with excise tax collected at the sale. The IRS puts it this way: “Diesel is undyed when sold for highway use vehicles and excise tax is collected at the time of sale.”

Factor Dyed diesel Regular (undyed) diesel
Identification Red dye indicates fuel intended for off-road or other nontaxable use. Undyed fuel is generally sold for highway use.
Typical excise-tax treatment Generally sold without the federal and state highway excise taxes, subject to current law and jurisdiction. Highway excise tax is generally collected at sale.
Typical use Eligible off-road equipment or other uses allowed by the applicable tax rules. Vehicles operated on public roads.
Price comparison No national off-road price series is published by EIA; local price depends on the quote and applicable charges. Retail prices vary by location and date; the cited sources do not establish a like-for-like national price difference.

EIA’s description is specifically about state and federal excise taxes applied to retail diesel used in vehicles on public roadways. It does not mean dyed diesel is free of every tax or charge.

Is dyed diesel cheaper than regular diesel?

Often, but not invariably. Its usual price advantage comes from not including highway excise taxes. Other charges can remain: IRS Publication 510 (December 2025) describes a $0.001-per-gallon LUST tax on dyed diesel and dyed kerosene in the circumstances covered by that publication. North Carolina, as a state-specific example, says retail dyed diesel is subject to sales tax and an inspection tax. Those examples are not a nationwide tax schedule.

EIA does not publish a price series specifically for off-road diesel, so there is no supported national savings figure to quote. To compare what you would actually pay, request local dyed and undyed quotes for the same date, location, volume, and delivery method. Ask for fuel price, excise taxes, sales or use taxes, delivery, and other fees to be itemized separately.

Where can dyed diesel be used?

Permitted use depends on the applicable federal and state rules. EIA describes off-road diesel as intended for equipment and vehicles not usually operated on public roadways, including farm equipment, railways, construction sites, and electric power generation. North Carolina’s guide also lists generators, aviation and marine vehicles, and carnival rides; those are examples in that state’s guidance, not blanket permission for every jurisdiction or situation.

Under the ordinary federal rule, fuel bought for a nontaxable use must be used only for that use. The IRS specifically says not to put dyed diesel in a truck used both on a farm and on the highway—even when the road trip is related to the farm business. Use undyed fuel in that truck under the ordinary rule. The IRS defines off-highway business use as business or income-producing use that is not in a highway vehicle registered, or required to be registered, for public highways.

Can you use dyed diesel in a truck on the road?

As of October 7, 2026, the answer depends on the temporary federal action and the rules in the state where the fuel is used. The White House announced on October 5, 2026, that an order directs Treasury to defer federal excise tax on highway use of dyed diesel for the remainder of 2026, without interest or penalties. The accompanying fact sheet describes temporary highway use and says agencies will coordinate with states while encouraging corresponding state action.

That federal announcement does not establish a nationwide waiver of state taxes or rules. For example, North Carolina’s notice says vendors selling dyed diesel for highway use and bulk end users using it on highways must file the state’s Motor Fuel Backup Tax Return. Before using dyed fuel on a public road, check current guidance from your state tax or motor-fuel agency, including any required return or tax payment. Do not treat the federal announcement as a general, permanent change to the ordinary rules.

Can you claim a refund if you buy regular diesel for off-road use?

Potentially. The IRS says qualifying users of undyed fuel may be eligible for a credit or refund when it is used for a qualifying nontaxable purpose. Eligibility and documentation depend on the use and the applicable IRS rules; buying undyed fuel for equipment does not automatically guarantee a refund. Consult the IRS instructions for the relevant tax year and keep records that identify fuel purchases and qualifying use.

What are the penalties for misuse?

IRS Publication 225 (2025) states a penalty of the greater of $1,000 or $10 per gallon for knowingly using, selling, or altering dyed fuel for a purpose other than nontaxable use; the publication says the $1,000 portion increases after the first violation. Because the October 2026 federal action temporarily addresses federal tax treatment of highway use, check current IRS instructions before applying that general penalty description to a particular use during the temporary period. State requirements and consequences may differ.
