Effective September 29, 2026, the U.S. Department of Education repealed its 2024 Title IX final rule and restored earlier regulatory text, subject to specified exceptions. The change removes the 2024 rule’s explicit regulatory approach to sex discrimination, including its treatment of gender identity. It does not establish that LGBTQ students have lost every possible protection under other laws, school policies, or legal claims.

What the Department changed

The final rule, titled “Recodification of Title IX Rules,” took effect on September 29, 2026. It repeals the Department’s 2024 final rule and returns the Code of Federal Regulations to its pre-2024-rule appearance, with exceptions. The Department describes the action as reinstating the 2020 regulation.

The Department said the 2024 rule’s text remained in the Code of Federal Regulations after courts had vacated it, leaving the published text out of step with the rules the agency considered operative. The recodification is intended to make the applicable regulatory text easier for schools, students, and parents to identify.

How the 2024 rule’s legal status developed

In its 2026 rule, the Department reports that eight courts preliminarily enjoined enforcement of the 2024 rule between June 13 and August 22, 2024. It also reports that courts in two cases later vacated the rule in full, in final orders dated January 9 and February 19, 2025. These are the Department’s counts of court actions, not measures of student outcomes.

The Department says it had not enforced the 2024 rule for more than a year and a half before issuing the 2026 final rule. That is the agency’s account of its enforcement practice.

What the rescission means for LGBTQ students

The Department characterized the 2024 rule as expanding Title IX’s treatment of sex discrimination to include gender identity. With that regulatory text repealed, its explicit protections are no longer part of the operative federal Title IX regulation. The 2026 action concerns that federal regulation; the reviewed official materials do not determine what protections may apply to a particular student under state law, school or district policy, other federal statutes, or separate legal claims.

For a specific situation, the applicable protections and options depend on the facts and the relevant laws and policies. The rescission alone does not answer those questions.

Why the restored text is not an exact rollback

The Department says it restored the pre-2024 regulatory text with specified exceptions. It did not bring back a sentence previously vacated in litigation, obsolete adjustment-period and review provisions, or an appendix that had since been removed. The agency describes these as minor changes and says it avoided reinstating language that was obsolete or had been vacated.

The Department’s stated rationale

In the September 29, 2026 final rule, the Department said: “The Department takes this action because the 2024 final rule has been vacated and is not enforceable nationwide.” It also stated: “This final action does not reopen debate on the 2020 Rule or the 2024 Rule.”
