Yes. DJI remained on the U.S. Department of Defense’s Section 1260H list in the latest court record reviewed: the D.C. Circuit’s August 14, 2026 opinion says DJI appeared on the June 2026 list. That does not mean every DJI drone is banned from sale or flight in the United States. Different federal actions affect government contracting, equipment authorization and exports, and they have different scopes.
What does “DJI is blacklisted” mean?
There is no single federal list that creates one all-purpose DJI ban. The phrase can refer to separate actions by the Department of Defense (DoD), the Federal Communications Commission (FCC), the Department of Commerce, or the Treasury Department. Each applies to different activities and people.

Is DJI still blacklisted?
Yes, in the specific sense that DJI remained on the DoD Section 1260H list in the June 2026 list described by the D.C. Circuit. The court’s August 14, 2026 opinion in SZ DJI Technology Co., Ltd. v. DOD affirmed part of the district court’s judgment, reversed part, and sent the case back for further proceedings. It did not remove DJI from the list.

The appellate court accepted evidence concerning DJI’s National Enterprise Technology Center status for one statutory element. But it held that the public record did not reveal the government’s rationale for the separate contribution finding, so the district court could not uphold that finding on the public record alone. The court ordered review of classified material on remand; its opinion did not invalidate the designation in full.

A Section 1260H designation has specific government-program consequences. The court described restrictions on contracting with DoD or DHS and on receiving certain Department of Energy grants, contracts, or loans. Those consequences are not the same as a prohibition on ordinary consumer ownership or flying.
Can I still fly my DJI drone in the U.S.?
The federal actions described here do not establish a general nationwide prohibition on flying DJI drones that people already own. The DoD listing concerns government contracting and specified funding. The FCC’s rules concern equipment authorization; the agency’s materials distinguish that question from the status of equipment that already received authorization.

In an August 2026 proposal concerning some already-authorized military-grade equipment, the FCC said operation of devices already in users’ hands would remain authorized if the proposal were adopted. That statement was part of a proposal, not a final rule. The materials reviewed do not establish the proceeding’s final disposition by October 8, 2026.
This answer is limited to the federal actions covered here. It does not resolve any restrictions that may apply to a particular flight, location, operator, or device under other rules.

Can you still buy DJI drones in the U.S.?
The DoD listing does not itself create a general consumer-sales ban. The FCC action is more specific: the agency added foreign-produced UAS and critical components as a category to its Covered List, which affects FCC authorization of covered equipment. It is not a DJI-only entry, and the available information does not support treating it as a blanket ban on every existing DJI model or every consumer transaction.
The FCC’s January 2026 list states exceptions through January 1, 2027, including certain equipment on the Blue UAS Cleared List and qualifying domestic end products. The existence of these exceptions does not establish whether a particular DJI product qualifies, whether a retailer has stock, or whether a new model can obtain authorization. Check the FCC’s current records and the specific model’s authorization status before relying on availability claims.

What do the FCC restrictions mean for new and existing equipment?
Adding a category to the Covered List affects authorization of covered equipment; it should not be conflated with a rule that automatically grounds devices already in use. FCC materials distinguish new authorization from previously granted authorizations. In August 2026, the FCC also proposed additional restrictions concerning some military-grade equipment that already had authorization. Because the notice was a proposal, it should not be described as a final prohibition. The final status of that proceeding, and the status of DJI’s reconsideration petition after a June 2026 notice, are not established by the records reviewed here.
How are Commerce export controls different?
BIS lists DJI in the Commerce Department’s Entity List under the EAR. The entry applies a presumption of denial to items subject to the EAR, with an exception for certain EAR99 technology for UAV operation, maintenance, or repair released to DJI by the UAV operator.

This is an export-control and transaction rule. It is not evidence, by itself, of a general ban on domestic consumer purchases or flights.
What does the Treasury NS-CMIC listing mean?
Treasury’s December 16, 2021 update lists SZ DJI Technology Co., Ltd. on the NS-CMIC List and gives February 14, 2022, as the effective date and December 16, 2022, as the purchase-and-sales divestment date. This is a historical notice. It does not independently confirm DJI’s status on that list as of October 8, 2026, and it should not be presented as proof of a current broad asset freeze.
