A Delhi district consumer commission reportedly ordered Swiggy and Themis Barbeque House to jointly pay ₹1 lakh after a customer said a Dineout “cost for two” listing understated the buffet prices he was charged. The restaurant was separately ordered to refund ₹3,988 for excess buffet charges and ₹254 for a service charge, according to news reports of the decision. The commission’s signed order was not available in the cited reporting, and the parties’ payment or appeal status has not been verified.
What price did the Swiggy Dineout listing show?
Praveen Kumar Singh said he booked a table for 14 people at Themis Barbeque House in Keshav Puram through the Dineout section of the Swiggy app for April 7, 2024. News reports say the listing showed “cost for two” as ₹1,500. Read as a per-person indication, that works out to ₹750 each.

The restaurant’s buffet prices were reportedly ₹1,050 per person for a vegetarian buffet and ₹1,100 for a non-vegetarian buffet. That was about 40% to 47% above the implied ₹750 per-person amount. Why did the commission reportedly hold Swiggy responsible?
Swiggy reportedly argued that the “cost for two” figure was an average or estimate and that customers could check menu prices before booking. The commission’s reported response centered on what the listing actually communicated: it did not show a clear estimate disclaimer, and Swiggy reportedly had access to accurate, itemised weekend buffet prices while the lower figure remained displayed.

Hindustan Times quoted the District Consumer Disputes Redressal Commission (North District) as saying, “Swiggy had a responsibility to ensure that prices displayed on its platform were accurate and matched the services actually offered by restaurants.” The commission reportedly characterized continued display of the incorrect price as deficiency in service and an unfair trade practice. As PTI reported, the commission said Swiggy had to show due diligence under the relevant laws and rules. Hindustan Times also reported that the commission referred to the Consumer Protection (E-commerce) Rules, 2020, in considering the accuracy of seller information and whether it matched the service offered. These are accounts of the commission’s reasoning in this case, not a general ruling that every platform is liable for every inaccurate listing. What was the separate service-charge issue?
Singh also objected to a 10% service charge on a beverage bill. Hindustan Times reported that the menu did not disclose the charge and that the Delhi High Court’s interim directions of September 5, 2023 called for participating establishments to use “Staff Contribution” instead of “Service Charge,” subject to conditions. PTI reported that the commission ordered the restaurant to refund ₹254 for the service charge, with 9% annual interest. The cited news coverage reports that the commission issued its order on September 21, but the underlying signed order was not available in that coverage. The reports do not confirm whether Swiggy or the restaurant paid the awards or filed an appeal. The ruling should therefore be understood as a reported district commission decision, not as a verified account of its later enforcement or appeal history.
