To compare a data center tax incentive fairly, put its annual public cost beside benefits that are measurable and plausibly caused by the incentive. Separate temporary construction work from permanent jobs, count state and local revenues separately, examine electricity and water pressures, and check whether investment and hiring promises are independently verified and enforceable. A project’s investment total or modeled economic activity is not, by itself, proof that the tax break produced those benefits.

Start with the public cost

Identify what the incentive exempts or credits, which purchases or activities qualify, which government gives up revenue, and how long the benefit lasts. Compare estimated savings with final claims when both are available; do not present a projection as money already claimed. Record the tax rates used in the estimate and whether local taxes remain due.

  • Tax and eligible activity: Specify whether the benefit concerns sales or use tax, property tax, or another tax, and which equipment, construction, or operations qualify.
  • Government share: Separate state revenue forgone from county, city, and other local revenue forgone.
  • Time period: Show annual costs and the full term, including any expiration date or eligibility change.
  • Evidence status: Label each amount as estimated, reported by a beneficiary, or verified by an agency.

These distinctions matter because a nominal exemption may cover only part of a tax bill, and a multi-year total can conceal when costs occur or which government bears them.

Test whether benefits are attributable to the incentive

The central comparison is not simply “tax savings versus activity at the site.” It is the incentive’s cost versus the additional activity that plausibly would not have happened without it. Investment made after a company qualifies is not automatically investment caused by the incentive. Equipment may be replaced or facilities built for business reasons that would exist with or without a tax break.

  • An ultra quiet fan system designed for cooling cabinets that requires minimal noise.
  • Features a multi speed controller to set the fans speed to optimal noise and airflow levels.
  • Contains a CNC machined aluminum frame with a modern brushed black finish.

  • Dimensions: 4.6 x 4.6 x 1.3 in. | Airflow: 26 CFM | Noise: 17 dBA | Bearings: Dual Ball

Washington’s Joint Legislative Audit and Review Committee (JLARC) illustrates this distinction. In its 2026 review of the urban-county sales/use-tax exemption for servers and power infrastructure, JLARC inferred eligible equipment purchases of $40.6 million in FY2023 and $141.7 million in FY2026 from estimated tax savings and a combined state and local tax rate just over 10%. It said it could not determine how much of that spending occurred because of the preference; some server purchases likely would have happened anyway as equipment was replaced. Washington JLARC’s 2026 review therefore cautions against treating eligible spending as a measure of incentive-caused investment.

Separate construction work from lasting jobs

Report construction employment and ongoing operations employment in distinct categories. For each, ask how many positions are full-time, how long they last, what wages and benefits they provide, whether workers are hired locally, and whether the figures have been independently verified. Construction can generate meaningful short-term work, but it is not interchangeable with permanent employment.

In the Washington review, beneficiaries reported nearly 300 temporary construction jobs and 53 permanent family-wage jobs. JLARC noted that the Department of Revenue had not verified the job counts. Treat these as beneficiary-reported figures, not audited outcomes. A sound evaluation should identify both the source and verification status for every job count.

Count fiscal returns and community costs separately

A useful accounting compares incremental state and local tax receipts with the incentive cost, while stating which government receives each revenue stream. Include property taxes where relevant, but do not assume that a rise in assessed value or receipts proves the incentive caused the development. Also request evidence about public costs and pressures associated with serving the project.

  • Local fiscal effects: Track assessed property value and property-tax receipts by jurisdiction, alongside any sales-tax revenue and the tax benefit granted.
  • Electricity and grid: Ask who pays for new generation, transmission, distribution upgrades, and other utility work, and whether those costs are borne by the operator, ratepayers, or public agencies.
  • Water and sewer: Seek project-specific estimates of demand, capacity upgrades, and the party responsible for their cost.
  • Other public services: Include material infrastructure or service costs documented by local authorities rather than assuming they are negligible or assigning unsupported dollar values.

Washington JLARC reported at least $111 million in assessed value and $1.2 million in property taxes added in two counties. Those figures describe reported additions, not a complete net-benefit calculation. Georgia’s Department of Audits and Accounts (DOAA) flags potential short-term strain on electric-grid and local water/sewer infrastructure, but its 2025 summary does not provide a universal project-level dollar estimate. Georgia DOAA’s 2025 summary makes those issues a reason to obtain local utility and infrastructure evidence, not a basis for assuming a standard cost.

Check conditions, oversight, and recovery terms

A promised investment or job total is meaningful only if the program defines it, requires reporting, verifies performance, and specifies what happens when a recipient falls short. Review eligibility thresholds, certification, audits, retention rules, expiration, and clawbacks together. Terms are jurisdiction-specific and can change; a benefit’s stated duration is not enough to establish how well it is enforced.

Texas: performance review and recapture

Under the Texas Comptroller’s standard qualifying-data-center guidance, the state sales-tax exemption applies to the 6.25% state portion; applicable local sales and use taxes are still collected. The standard program lasts 10 or 15 years depending on whether the facility meets a capital-investment threshold of at least $200 million or $250 million, respectively, within five years. At the five-year anniversary, the Comptroller audits capital investment and qualifying jobs, reviews job retention, and may revoke certification and recover tax, penalty, and interest if commitments are not met. Texas separately provides rules for qualifying large data-center projects, including different thresholds and a 20-year period; those rules should not be conflated with the standard facility program. See the Texas Comptroller’s data-center guidance.

Illinois: confirm whether applications are open

Program terms and availability can change. The Illinois Department of Commerce and Economic Opportunity (DCEO) says it stopped processing applications for its data-center incentive program beginning July 1, 2026, following a June 5, 2026 gubernatorial directive. Published eligibility terms included at least $250 million in investment over 60 months, 20 qualifying full-time jobs paid at least 120% of the county median, and carbon-neutral or green-building requirements. The incentive included tax exemptions and, for projects in underserved areas, a construction-worker wage credit. These are published program terms, not evidence that new applications are currently accepted. Check Illinois DCEO’s program page for status.

Use comparable reporting categories

When a state publishes an evaluation, check whether it reports costs and benefits in categories that can be reconciled. Virginia’s 2026 report, covering FY2024 and FY2025, is required to include qualifying expenses claimed, total tax benefit, a return-on-investment analysis covering direct and indirect jobs, and state and local tax revenues. Those categories provide a practical checklist, though a report organized this way does not automatically settle whether activity was caused by an incentive or capture every community cost. See Virginia’s 2026 report.

JLARC’s 2026 review counted at least 38 states offering preferential tax treatment specifically targeting data centers. That is the auditor’s count at the time of its review, not a permanent or current inventory of state programs. State examples should be compared only after confirming their effective dates and rules.

A practical checklist for a local proposal

  1. Request an annual cost schedule. Ask for projected and actual tax savings by tax type, eligible purchase, year, and state or local government, with the tax rates and assumptions disclosed.
  2. Ask for a counterfactual. Require the applicant or evaluator to explain what investment, jobs, and operating activity would likely occur without the incentive, and what evidence supports that estimate.
  3. Separate jobs by type and quality. Request construction and operations counts, wage ranges, full-time status, duration, local hiring, retention, and independent verification.
  4. Reconcile public revenues. Obtain state and local receipts, including property-tax changes, and identify who collects each amount and whether it is incremental.
  5. Assign infrastructure costs. Request project-specific power, water, sewer, and grid-upgrade estimates, plus the allocation among the company, utilities, ratepayers, and public budgets.
  6. Read the enforcement provisions. Confirm thresholds, reporting deadlines, audit authority, expiration, job-retention requirements, and the specific recapture or clawback available if conditions are missed.
  7. Set a review date. Compare actual annual costs and verified outcomes with the original projections while the incentive is active, rather than relying solely on a final retrospective summary.
