Criminal recruiters can reach a legitimate business through its labor suppliers—or lure job seekers into criminal operations with fake offers. For employers, the practical response is to trace every recruiter and subcontractor, check how workers are treated, and act on warning signs. For job seekers, verify the employer and get clear written terms before accepting or traveling.
These risks are related but distinct: labor trafficking involves coercion to compel labor; trafficking for forced criminality involves compelling people to commit crimes; and organised labour fraud involves tax or payroll evasion through labor supply chains. A warning sign alone does not prove trafficking or fraud.
How criminal recruiters can reach a legitimate business
A business may hire through a labor broker or subcontractor without dealing directly with the person who recruited or manages a worker. That makes it important to map the labor chain, not just review the direct vendor. Recruiters may exploit workers through coercive labor practices, while fake job offers can draw applicants into criminal operations. Separately, criminal intermediaries may supply labor through arrangements designed to evade tax and payroll obligations.

Workers may also face consequences for their employment rights and benefits. This is a tax and payroll fraud risk; it is not, by itself, a finding of labor trafficking. HMRC’s guidance on organised labour fraud was published on 10 June 2026.

What labor trafficking and forced criminality mean
Labor trafficking
The U.S. Department of Labor describes labor trafficking as using force, fraud, or coercion to compel labor and prevent a person from leaving. Possible indicators include wages withheld or controlled to repay recruitment debts, unusual living conditions, restricted movement, workplace injuries, and confiscated identity documents. These are reasons to inquire carefully, not proof of a crime on their own. The Department of Labor’s overview explains its approach and indicators.
Trafficking for forced criminality
A person can also be compelled to commit crimes, including participating in cyber-scam operations. The role may initially sound ordinary or skilled, and a person recruited this way may be a victim even if the offer appeared to be legitimate work. The OSCE’s 2026 report, Following the Money: Trafficking of Human Beings for Forced Criminality, identifies recruitment and workplace warning signs.

Keep the categories distinct
A deceptive offer, a labor-law violation, trafficking, and payroll fraud are not interchangeable labels. They can overlap, but the facts and applicable legal rules matter. Employers should treat indicators as prompts for a careful response and appropriate specialist or official referral, not as a basis for declaring guilt.
How employers can check their labor supply chains
Start with every route through which a worker reaches the business: direct recruiters, labor brokers, subcontractors, and any further tiers. Compare what the worker was promised with what actually happens at the workplace and in any employer-linked housing.

| What to check | Questions for the business |
|---|---|
| Recruiter identity | Who recruited the worker? Is the recruiter identifiable and, where applicable, properly licensed or registered? |
| Terms and understanding | Does the worker have clear written terms in a language they understand? Do the actual duties, location, pay, schedule, supervisor, and housing match what was promised? |
| Fees and costs | Who paid recruitment fees or related costs? Are deductions or debts tying workers to the job? |
| Wages and documents | Can workers access their wages and identity documents? Are wages withheld or controlled? |
| Grievances and freedom | Can workers raise concerns safely? Can they leave or change employers without threats or obstruction? |
| Movement and living conditions | Are workers free to come and go? Are living arrangements unusual, controlled, or linked to restricted movement? |
Investigate pressure from recruiters, debt, unexplained deductions, injuries, restricted movement, or discrepancies between promised and actual conditions. Give workers safe ways to raise concerns and seek appropriate expert or official help when indicators point to possible exploitation. A company’s legal duties depend on its jurisdiction, industry, and contracts.
Fair recruitment standards and the U.S. federal-contract rule
The International Labour Organization’s fair-recruitment principles say: “No recruitment fees or related costs should be charged to, or otherwise borne by, workers or jobseekers.” The ILO also emphasizes understandable and verifiable employment terms, access to rights information and grievance processes, retention of identity documents, and freedom to leave or change employer. These are international principles; the specific legal obligations that apply depend on local law. Read the ILO’s 2016 General Principles and Operational Guidelines for Fair Recruitment.

In a narrower U.S. context, the Federal Acquisition Regulation’s trafficking-in-persons clause applies to covered federal contractors. It prohibits covered contractors from charging recruitment fees, using specified misleading recruitment practices, or confiscating identity documents, and requires written job information in applicable circumstances. It is not a universal rule for every employer. The clause text is in the FAR overhaul’s Part 52.

How job seekers can assess an offer before accepting
The EEOC’s safety guidance is for job seekers in the United States. It advises people to verify the business, clarify the terms, avoid recruitment fees, protect personal and financial information, and tell someone trusted about in-person meetings. Read the EEOC’s guidance on protecting yourself from possible trafficking situations.
- Verify who is hiring. Obtain the names of both the recruiter and employer, then check the business independently rather than relying only on contact details supplied by the recruiter.
- Get the job terms. Ask what work you will do, where and when you will work, who supervises you, how much and when you will be paid, and what costs apply. Get a written contract you can understand before travel.
- Do not pay recruitment fees or surrender identity documents. Protect personal and financial information, and tell a trusted person about any in-person meeting.
- Pause if the offer relies on pressure or secrecy. Be cautious if the recruiter rushes a decision, duties are vague, salary promises seem excessive, the employer’s HR staff are inaccessible, or travel and employer-controlled housing are bundled into the offer.
For work abroad, the OSCE identifies further warning signs: recruitment through social media without an official listing, no contract before departure, and controlled dormitory living. Together with vague duties, pressure to decide quickly, or blocked access to company HR, these signs warrant extra caution. Verify the employer through an independent channel and do not travel until you have clear terms.
Where to seek help
If you suspect trafficking or coercion, do not confront a suspected recruiter in a way that could increase danger to a worker. Use appropriate local labor, trafficking, or law-enforcement authorities and specialist support organizations for the relevant jurisdiction. Job seekers facing an urgent threat should contact local emergency services. The EEOC guidance cited above is U.S.-specific; people elsewhere should consult their local labor and trafficking authorities.
