As of October 3, 2026, New York Attorney General Letitia James is leading a renewed criminal investigation into a woman’s allegation that she was sexually assaulted at Cornell’s Chi Phi fraternity house in October 2024. The civil allegations are contested, and no criminal charge or finding of guilt is established in the reporting reviewed. Cornell conducted a separate student-conduct process, and the dispute over what evidence prosecutors initially received remains unresolved.

What is alleged in the Cornell Chi Phi case?

The civil complaint and the woman’s account

A woman identified in court papers as Jane Doe alleges that she was given ketamine and repeatedly sexually assaulted at the Chi Phi house in October 2024. In an interview with campus police, she said she was uncomfortable as additional men arrived and described coercion and incapacitation. The Associated Press, which reviewed the interview transcript, reported her statements: “Yes. It was coercion, yes,” and “I can say with 100% confidence I was raped.” These are her allegations and words, not a court’s findings.

Accounts of the encounter differ sharply. The AP reported that Doe said she initially consented to some sexual activity but became uncomfortable with what followed. Some of the accused men denied nonconsensual sex or said they did not touch her. The civil complaint has not adjudicated those competing accounts.

What the public record does—and does not—establish

The case involves several kinds of proceedings that answer different questions. A civil lawsuit presents claims for resolution in court; a university conduct inquiry applies campus rules; a criminal investigation gathers evidence for prosecutors to assess. None should be treated as a substitute for another. The reviewed reporting establishes allegations and procedural steps, not a criminal conviction.

How the criminal case differs from Cornell’s conduct process

Public descriptions of Cornell’s inquiry include both areas of agreement and major disagreement about consent. At least one student separately challenged Cornell’s disciplinary process and sanction in a lawsuit. AP also cautioned that it is misleading to characterize the university’s response as only requiring essays: some essay or class sanctions concerned other behavior, and Cornell says some students were expelled.

Why was the criminal investigation reopened?

The dispute centers in part on what the district attorney received before declining charges. Tompkins County District Attorney Matthew Van Houten said he relied on a police summary, rather than the full interview transcript, and that the summary did not include key statements Doe later described. He said, “Seeking justice sometimes requires us to reconsider or reopen cases when we are provided with additional evidence.”

Cornell said it sent Doe’s sworn statement and Snapchat screenshots to prosecutors under its protocol. The Washington Post reported that Cornell did not answer whether all interview evidence had been turned over. Those accounts do not resolve whether the original submission was complete or what effect any omitted material had on the initial decision.

In September 2026, the county district attorney reopened the criminal investigation. On October 1, Governor Kathy Hochul appointed New York Attorney General Letitia James special prosecutor to lead the renewed inquiry. AP described the attorney general’s review as a monthslong process with no predetermined result. The reviewed reports do not establish a subsequent charging decision.

What Cornell’s campus survey says—and its limits

Cornell’s Presidential Task Force on Campus Sexual Assault reported findings from a 2025 survey in its 2026 report. The response rate among undergraduates was 13%, down from 34% in 2023; the task force says the low response rate limits estimates and interpretation. The figures below are students’ survey reports, not verified crime counts, and should not be read as estimates applying without uncertainty to all Cornell students.

  • Thirty-five percent of undergraduate women and 8% of undergraduate men reported experiencing sexual assault during their time at Cornell.
  • Among undergraduate women, 52% of those affiliated with Greek life and 29% of those not affiliated reported experiencing sexual assault.
  • Students most often identified residence halls as the location (29%), followed by off-campus residences (23%) and fraternity chapter houses (17%).
  • Among respondents who reported experiencing assault, 24% of women and 10% of men contacted at least one program or resource; 80% of students who experienced sexual assault told a friend.

These campus-wide responses offer context about reported experiences and help-seeking, but they cannot establish what happened in a particular encounter or show that Greek-life affiliation caused an assault.

What the reputation claim means in this case

ABC News reported that Doe wrote in an October 23, 2024 text, “My reputation is destroyed and I’m utterly ashamed.” That is her reported description of her experience, not evidence that the reputation of fraternities as a whole has been measured or uniformly damaged. The case has renewed attention to fraternity oversight and campus response, but the allegations, the university’s process, and the still-active criminal inquiry must remain distinct from any broader judgment about all fraternities or their members.
